AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
CLOSING, VACATING, AND ABANDONING THAT CERTAIN 15
FOOT WIDE EAST-WEST UTILITY EASEMENT LYING ON THE
NORTHERLY PORTION OF THE PROPERTY AT 2524 HIAWATHA
AVENUE; PROVIDING FOR SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
WHEREAS, an application has been filed with the City of Sanford to close,
vacate and abandon that certain 15 foot wide East-West utility easement lying on the
Northerly portion of the property at 2524 Hiawatha Avenue; and
WHEREAS, a public hearing was held on December 12, 1994, for consideration
and determinations to whether or not the closing, vacating and abandoning of that
certain 15 foot wide East-West utility easement lying on the Northerly portion of the
property at 2524 Hiawatha Avenue should be allowed; and
WHEREAS, the City Commission has determined that the closing, vacating and
abandoning of that certain property does not conflict with the Comprehensive Plan
of the City of Sanford, Florida, and that the public health, economy, comfort,
order, convenience, and welfare will be promoted by such closing, vacating and
abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That certain 15 foot wide East-West utility easement lying on the
Northerly portion of the property at 2524 Hiawatha Avenue should be allowed, more
particularly described as follows:
All of that certain 15 foot utility easement lying within 7.5
feet on either side of the common lot line between Lot 1 and
Lots 19 and 20, Block 19, DREAMWOLD, according to the
Plat thereof as recorded in Plat Book 3, Pages 90 and 91,
of the Public Records of Seminole County, Florida, LESS
that part lying within 7.5 feet of the West line of said Lot
1 and its Northerly extension,
be and the same is hereby closed, vacated and abandoned.
SECTION 2: If any section or portion of a section of this ordinance proves to
be invalid, unlawful or unconstitutional, it shall not be held to impair the validity,
force or effect of any other section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances in conflict herewith
be and the same are hereby revoked.
SECTION 4: That this ordinance shall become effective immediately upon its
passage and adoption.
