CITY OF SANFORD DEVELOPMENT ORDER NO. 17-12 ISSUED BY PLANNING AND ZONING COMMISSION RELATING TO 121 WEST 1ST STREET On March 2, 2017, the Planning and Zoning Commission of the City of Sanford issued this Development Order relating to and touching and concerning the following described subject real property: 121 West 1st Street which is assigned Tax Parcel Identification Number: 25-19-30-5AG-0304-002A by the Seminole County Property Appraiser; provided, however, that it is noted that the Property Owner owns property that is proximate thereto and said proximate property is subject to the provisions of this Development Order. FINDINGS OF FACT Property Owner: 115 West Development, LLC 5224 West State Road 46 306 Sanford, Florida 32771 Applicant: Jonathan B. Wolverton — Deviant Wolfe Brewing, LLC 121 West 1 st Street Sanford, Florida 32771 Project: Application for a Conditional Use for Urban Infill Redevelopment to establish a craft brewery with an associated tasting room (microbrewery and sidewalk cafe) at 121 West 1 st Street. The subject real property totals 17,409 square feet or 0.40 acre in size and is located within the SC-3, Special Commercial, zoning district. Requested Development Approval: The Applicant requested that the Planning and u Zoning Commission approve a Conditional Use for Urban Infill Redevelopment to establish a craft brewery with an associated tasting room (microbrewery and sidewalk cafe) at 121 West 1st Street. The subject real property totals 17,409 square feet or 0.40 acre in size and is located within the SC-3, Special Commercial, zoning district. Additional Findings: The existing 8,042 square foot building was originally built in 1920. The applicant is proposing to utilize a 2,874 square foot tenant space to manufacture beer as well as serve it in a tasting room within the facility. The main brewing equipment will be in the rear of the building with a barrier between the brewery and taproom. The brewery will be an asset to adjacent businesses and encourage more patronage to the downtown area as well as add to the tax base for the City of Sanford. The applicant is requesting an Urban Infill Redevelopment project in order to facilitate manufacturing and wholesale uses along with an associated tasting room to compliment the business activities in the downtown area. Conditional Use for Urban Infill Redevelopment allows flexibility to certain land development regulations to allow better urban design and other project enhancements. The urban infill redevelopment program encourages the redevelopment of properties that may be problematic or otherwise unique. Acknowledging that it may not be economically feasible or attractive to develop or redevelop many of the smaller properties throughout the City under the existing land development regulations, the urban infill program gives the City the ability to negotiate design standards on a site by site basis. The process largely seeks to create flexibility in design while safeguarding the integrity of the surrounding properties. Multiple craft breweries have been approved and established within the City's SC-3, Special Commercial zoning district including the following: Address Business Name Date of P&ZC Approval 200 S. Myrtle Avenue Local 28 Brewing March 20, 2014 419 Sanford Avenue Wo 's Hops Brewing Company May 1, 2014 400_ Sanford Avenue Sanford Brewing Company March 5, 2015 200 E. 2nd Street Second Street Station March 5, 2015 Applying the urban infill redevelopment flexibility for this property will unify the west end of the City's Downtown Commercial Historic District by tapping into the City's growing craft beer community and will spur economic growth within the City's Downtown Commercial Historic District. A Citizens Awareness and Participation Plan meeting was held on February 20, 2017 with notice being provided to the adjacent property owners that the Property Owner was seeking to develop the site as stated herein and was seeking a development order to approve the use as set forth herein. CONCLUSIONS OF LAW a). The proposed use will be generally consistent with the requirements of the City's Land Development Regulations. b). Additionally, the overall development approval sought is hereby found and determined to be consistent with the City of Sanford Comprehensive Plan. c). The Applicant has proven the necessary requirements such as to be entitled to the approval authorized under the controlling provisions City's Land Development Regulations subject to the conditions set forth herein. d). Since much of the work is interior, I do not want to hold up the permit so am releasing it with the caveat that the back wall may not be worked on until after the HPB has made their determination. Joy is amenable to this and will write a Condition Letter which will need to be signed when picking up the permit. The permit is not ready however, as Joy has advised that a request for additional information has not yet been responded to. He will need to receive that information before we release the permit with the condition letter. Please let me know if you have any questions.
