The applicant has had correspondence with the City regarding the allowance of a pool to encroach into an HOA easement if it were vacated by the HOA. The application package has provided written agreement to abandon the easement; however, please submit evidence that the easement has been formally vacated. The required rear enclosure setback is 10 feet. Approval of a variance is also required in order to construct any closer to the rear property line than 10 feet as proposed. The fee to apply for a Single Family Variance is $150 and the applications can be located on the City's website at: http://www.sanfordfl.gov/media/pdf/plan dev/20101005_variance.pdf In addition, as part of the review for the zoning sign off, this department is responsible for verifying open space requirements are met. Additional costs incurred due to subsurface conditions including excessive ground water, poor soils, muck, rocks, tree stumps, buried structures and soil with inadequate bearing capacity soil up to 3 yards of rock included.
