Residential Swimming Pool Contract
This Agreement is made and entered into this 16 day of November , 20 10 , by and between Premier
Pools of Central Florida, Inc. (Premier),
and Kevin Weidner (Owners).
1. Agreement: Premier agrees to build and the owner agrees to pay for one swimming pool in accordance with
and subject to the following provisions of the contract. Construction shall take place at:

3. CHANGE ORDERS: The owner shall not submit any change or amendment to the plan and
specification set forth herein unless agreed to in advance in writing by both Owner and Premier. In the event
any such change or alteration shall be approved, said change or alteration shall be in written form signed by
Owner and Premier. Each change order shall specify any increase in price as addressed in paragraph 2, above,
and shall be paid by Owner to Premier prior to performing or commencing to perform any process subject to the
change order (including purchasing of parts and equipment).
4. FINANCING: Owner is solely responsible for ANY financing unless the parties agree otherwise in
writing.
5. POOL SITE ACCESS: Owner shall provide pool site access and shall obtain written permission if
access is across any other's property. Owner agrees and acknowledges that by executing this contract they will
indemnify, defend, and hold Premier harmless for any and all damages occasioned in access area and to be
solely responsible for access damages. Access areas to include, but are not limited to, driveway and rights -of -
way.
6. UTILITIES: Owner agrees to provide adequate water and electrical services as required for
construction, filling, and operation of the pool.
7. EXCAVATION: Normal excavation and dewatering of hole is included. Abnormal excavation is when
machine time exceeds five hours. Abnormal dewatering is exceeding the use of two (2) H.P. Electric pumps to
control water. Rock removal, muck removal, and foundation solidification are abnormal conditions. In the
event that abnormal conditions are discovered during excavation, Owner may elect to terminate this Agreement.
In the event Owner elects to terminate this :Agreement, Premier shall have no further liability to owner and,
because Premier will suffer actual damages. which would be difficult to determine, owner and Premier agree
that owner shall be liable for all actual costs incurred by Premier to date of Termination plus $500.00 as
liquidated damages. Termination under this paragraph may be made only in writing and delivered to Premier
via certified mail at the address above.
8. CONCEALED CONDITIONS: Should any soil, subsurface, or latent conditions, which would
adversely effect the construction of the pool (including, but not limited to, underground pipes, conduits, hard
pan, rock, excessive ground water, inadequate soil -bearing capacity, falls, water seepage, septic tanks and drain
fields, muck or any other surface or subsurface soil conditions), be encountered, then the owner agrees that the
purchase price, as set forth in paragraph 2, above, shall be increased according to the extent necessary to
construct the pool despite said concealed conditions. The Owner shall be completely responsible for the

increase in the purchase price due to said conditions. Premier, upon discovering any such conditions, shall
notify the owner in writing of the existence of such conditions and shall give the owner an approximate cost
estimate to remove or eliminate such conditions.
9. LIMITED WARRANTY: Premier takes responsibility solely for the following conditions:
A. Lifetime warranty on pool shell cracking or until owner transfers property.
B. Lifetime warranty on underground plumbing or until owner transfers property.
C. Pool and Patio elevation and location on property.
D. Sidewalk repairs if broken during construction.
E. One year for substantial defects resulting from pump and filter installation.
Premier shall not be liable for any damages caused to the pool or its surrounding structures resulting from the
acts of any third party or through failure of Owner or any person to properly maintain the pool or its
surrounding structures.
Routine maintenance items such as light bulbs, hoses, brushes, gaskets, etc., have no warranty beyond ninety
days. Pool decking is not warranted against cracks, checking or discoloration, as these items are common and
natural occurrences given the nature of the pool and its composite parts. Additionally, pool tile, brick and grout
are not warranted against cracking or color variations.
Seawalls are assumed to be structurally sound. Interior finish of pool is not warranted against stains,
discoloration, checking, pitting, or cracking. Premier is not responsible for any damages resulting from caverns
or channels under or through seawall structural defects. All warranties are non -transferable by owner.
All pool and/or spa dimensions are approximate with up to six inches tolerance either way. Buyer(s) and
Contractor agree it would be impractical to fix the actual damages in the event of any deviation in pool and/or
spa dimensions greater than any such six inch deviation in dimensions. Therefore, liquidated damages for such
greater deviations in the water surface area of the pool and/or spa as specified on the pool plan shall be $6.00
per square foot; and liquidated damages for any such greater deviations in depth of the pool and/or spa as
specified on pool plan shall be $12.00 per one -quarter inch. The depth of the pool and/or spa is determined by
measuring from the top of tile down to the top of the main drain of the pool and/or spa. Buyer(s) and
Contractor agree that the pool and/or spa will be within three-quarters of an inch being level. Buyer(s) and
Contractor agree it would be impractical to fix the actual damages in the event of any deviation in the pool
and/or spa level greater than three-quarters inch deviation, therefore liquidated damages for such deviations
shall be $25.00 per one -quarter inch. It is a condition of Contractor's obligations hereunder that Contractor's
Pool Counselor has not exceeded his limited authority to commit contractor on price, time of construction,
equipment or other material term or condition of this Contract. Approval by an inspecting building department
is deemed to be completion of that work in a workmanlike manner. Payment schedules must be met regardless
of the over-all incompletion of the contract, or the necessity of repairing previously completed work.
Warranties are only effective once payment is made in full.
PREMIER MAKES NO WARRANTIES REGARDING THIS AGREEMENT EXPRESSED OR
IMPLIED EXCEPT AS PROVIDED HEREIN.
10. DEFAULT OF PAYMENT: In the event of payment default, Premier shall have the right to stop all
work, until payment is made or waive the default and continue working. If the default in payment continues for
10 days, Premier may declare the Owner in breach of this agreement, stop all work and the Owner shall be
responsible for the full balance due on the contract.
In the event suit is filed to collect any amounts due under this contract, Owner shall be responsible for
all attorney's fees and costs incurred by Premier as well as interest at a rate of 18% per annum from the date of
default on all monies due under the contract.
11. DIVING BOARDS AND SLIDES: Premier assumes no liability for injures through use or misuse of
diving boards or slides. If diving boards or slides are installed after construction, their installation creates no
liability to Premier and such installation shall void all warranties.
12. LIMITATIONS: The following limitations apply to this contract:

13. BUYER'S RIGHT TO CANCEL: This is a home solicitation sale. If you do not want the goods and
services, you may cancel this agreement by mailing a notice to Premier. This notice must indicate that you do
not want the goods and services and must be postmarked before midnight of the third business day after you
sign this agreement.
14. ARBITRATION: The parties hereby elect binding arbitration as their exclusive method of resolving
controversies existing between them relating to this Contract. Arbitration proceedings shall be conducted in

Binding arbitration is recognized. under Florida law as a judicially enforceable means of dispute resolution. The
parties to this Contract release the officers, members, and staff of the Florida Pool and Spa Association, and its
Chapters, from all liabilities, claims or demands whatsoever arising from any arbitration proceeding. This
release is given freely and voluntarily by the undersigned who are authorized representatives of the parties to

15. CONSTRUCTION OF CONTRACT: The terms set forth in this were negotiated and mutually agreed

the following methods will be used to meet the requirements of Florida Statute in
Chapter 515.
The pool will be isolated from access to the home by an enclosure that
meets the pool barrier requirements of Florida Statute 515.29;
The pool will be equipped with an approved safety pool cover that
complies with ASTM F1346-91 (Standard Performance Specifications for
Safety covers for Swimming Pools, Spas, and Hot Tubs);
All doors and windows providing direct access from the home to the pool
will be equipped with an exit alarm that has a minimum sound pressure
rating of 85 decibels at 10 feet;
All doors providing direct access from the home to the pool will be
equipped with self -closing, self -latching, devises with release
mechanisms placed no lower that 54" above the floor or deck;
I (We) understand that not having one of the above installed at the time of final
inspection, or when the pool is completed for contract purposes, will constitute a
violation of Chapter 515, F.S. and will be considered as committing a misdemeanor
of the second degree, punishable by fines up to $500 and/or up to 60 days in jail as
established in Chapter 775, F.S.

GENERAL NOTES
1. For pool plan, size, deck, and special details, see Contractor's Pool Plan.
2. Pool Walls shall be 5' thick and Floors shall be 6' thick and shall be pneumatically
applied Concrete with a Compressive Strength of 3,000 psi in 28 days. Concrete
Decks shall be 2,500 psi. Concrete construction will conform to ACI Standard 318.
3. All Pool construction shall comply with Florida Building Code Building 2007 and
Florida Building Code Residential 2007, together with 2009 Revisions, ANSI/NSP
National Standard-5 for Residential Inground Swimming Pools, ANSI/NSP National
Standard-3 for Permanently Installed Residential Spas, ANSI/APSP-7 American
National Standard for Suction Entrapment Avoidance In Swimming Pools, Wading
Pools, Spas, Hot Tubs and Catch Basins and the Latest Adapted National Electric
Code (NEC).
4. All Pool Piping to be Schedule 40 PVC, bearing the mark of NSF Approval unless
otherwise noted.
5. All Reinforcing Steel to conform to ASTM 615, Grade 40. Reinforcing shall be #3
bars at 12' on center in each direction, w/ 15" lap joints in walls and floors up
to 6'. Over 6' use #3 bars at 6' on center in each direction in the areas over
6'.
If Concrete is cast against Bare Earth without a Separation Barrier, the minimum
cover shall be 3'. With a Barrier (Steeltex) between Concrete and Earth, the
minimum cover shall be 1)'.
6. All Metallic Pool Fittings within 5' of the inside wall and deck reinforcing steel to be
bonded to the Pool Reinforcing Steel with #8 AWG Copper Wire. The #8 Copper
Wire to be run internally and externally with the NEC approved PVC Light Conduit
form the Light Niche to the Junction Box. Completion of the pool grounding to the
Electrical Panel Ground to be by Electrician.
7. Bond all Sheathed Cables, Raceways, Metal Piping and all Fixed Metal Parts not
separated by a permanent barrier, if within 5'-0' Horizontally from Water and
12'-0' Vertically of Maximum Water Level.
8. Equipotential Bonding to be accomplished in accordance with Article 680 of the
Latest Adapted National Electrical Code (NEC).
9. Pool or Patio shall bear only on Rock or Clean Sand, which shall be compacted to
provide a Structurally Safe Bearing Capacity. Any Unsuitable Material encountered in
excavation shall be removed in its entirety and the area shall be backfilled with
acceptable material and properly compacted. Where unsuitable Material cannot be
removed, the pool must be redesigned.
10. The Contractor must protect Existing Structures from failure by acceptable methods
if required. The Engineer accepts no responsibility for the safety of Existing
Structures.
11. The Design Engineer assumes no responsibility for pool construction in Easements or
Required Setback areas. Pool Contractor and/or Owner shall verify the layout and
all dimesions shown prior to construction.
12. Contractor shall determine the location of all Utilities in relation to the Pool and its
Equipment and ensure minimum clearances in accordance with Local Regulations
and Ordinances.
13. Contractor shall provide adequate Temporary Fencing around the construction area
to prevent unauthorized entry into the Pool Area.
14. If a water supply is provided, a minimum 3' Atmospheric Break will be provided.
15. All Structural, Filtration and Electrical details outlined in these drawings also relate
to Spa Construction.
16. All Pool and Spa Heaters shall be equipped with an On/Off Switch mounted for
easy access to allow the Heater to be Shut Off without adjusting the Thermostat
settings and to allow restarting without relighting the Pilot Light.
17. WARNING! To empty the Pool for any reason, the Hydrostatic Uplift Pressure must
be eliminated. The Owner must consult a Contractor experienced in eliminating
Uplift Pressure.

the Turndown is Level (>4 to 1). Turndown may abut Ribbon Footer and be tied
into Footer if Appropriate, with #3 Rebar.
2. Turndown shall bear on Rock, Clean Sand or Structurally Sound Soils (>1,500 PSF)
that shall be compacted to provide Optimum Bearing Capacity and prevent Settling
or Shifting.
3. All Reinforcing Steel is to Conform to ASTM 615, Grade 40.
4. Concrete shall contain Fiber Mesh and have a 28 Day Compressive Strength of
2,500 PSI,
5. All Construction to Conform to Florida Building Code Building 2007, Florida Building
Code Residential 2007, together with 2009 Revisions.
6. Refer to Contractor's Plan on file with the Building Department for Details on
Turndown Location.
7. If the Base of the Turndown does not extend into the Old (Existing) Ground, a 4"0
Pilaster will be required every 5'-0' that will be either 2'-0" into the Ground or
to 6" into the Indigenous Material, Whichever is Deeper. The Pilaster will have a
3 Rebar tied into the #5 Rebar in the base of the Vertical Pour.
8. A Deck Turndown is NOT intended to be a substatute for a Retaining Wall. If the
Vertical Dimension from the Top of the Concrete Deck to the Old (Existing) Ground
reaches 42' for a 12" Turndown, 48" for a 18" Turndown or 54" for a 24"
Turndown, for more than 20% of the Turndown Length or the Finished Grade Slope
exceeds (steeper than) 4' Horizontally and 1' Vertically, a Turndown should not be
used.
9. For a Paver Deck, if the Vertical Dimension from the Top of the Deck to the Old
Existing) Ground reaches 30.0" for a 12' Turndown, 36.0" for a 18" Turndown or
42.0" for a 24" Turndown, for more than 20% of the Turndown Length or the
Finished Grade Slope exceeds (steeper than) 4' Horizontally and 1' Vertically, a
Turndown should not be used.
10. If a Screen Enclosure is to be installed on top of the Turndown, the Swimming
Pool Contractor must Coordinate attachment of the Screen Enclosure to the
Turndown with the Screen Contractor.
FOOTER NOTES
1. If a Screen Enclosure is to be installed, the Swimming Pool Contractor must
Coordinate Construction of any required Footer with the Screen Contractor.
