THIS AGREEMENT is made and entered into this hAday of January ,
20 14 , by and between BLACK STREET ENTERPRISES, LLC, duly authorized to conduct
business in the State of Florida, whose address is 535 NW Mercantile Place, Unit 107, Port Saint
Lucie, Florida 34986, hereinafter referred to as "CONTRACTOR", and SEMINOLE COUNTY, a
political subdivision of the State of Florida, whose address is Seminole County Services Building,
1101 East First Street, Sanford, Florida 32771, hereinafter referred to as "COUNTY".
WITNESSETH:
WHEREAS, COUNTY desires to retain the professional residential Rehabilitation services
of a competent and qualified contractor to provide for an identified HOME funded residential
Rehabilitation project benefitting an income -qualified household in Seminole County; and
WHEREAS, COUNTY has allocated funds from its currently available HOME Program
funding allocation from the United States Department of Housing and Urban Development
HUD") for completion of the Project herein described; and
WHEREAS, COUNTY has requested and received competitive proposals for the retention
of residential Rehabilitation services from qualified contractors; and
WHEREAS, CONTRACTOR has been deemed competent and qualified to furnish
contractor services to COUNTY and desires to provide professional services according to the terms
and conditions stated herein,
NOW, THEREFORE, in consideration of the mutual understandings and covenants set
forth herein, COUNTY and CONTRACTOR agree as follows:

Section 1. Incorporation of Recitals. The above recitals are true and form a material part
of the mutual understandings upon which the Parties have relied in entering into this Agreement.
Section 2. Definitions.
a) "CFR" means the Code of Federal Regulations.
b) "Contract Documents" shall mean the documents and forms attached as the
several Exhibits to this Agreement, the terms and conditions of which shall be complied with as
part of the required Project services rendered.
1) The Contract Documents shall comprise the entire agreement between the
Parties; are an integral part of this Agreement, incorporated herein by reference and shall
specifically include the following:
Exhibit A - This Agreement, including the Scope of Services attached as
Exhibit A;
Exhibit B - Bid Form;
Exhibit C — Seminole County Rehabilitation Standards
Exhibit D - EPA's Lead Based Paint Renovation, Repair and Painting
Program; and
2) As the Project progresses, additional documents shall become part of this
Agreement between COUNTY and CONTRACTOR. These documents are:
A) Performance Bond;
B) Payment Bond;
C) Material and Workmanship Bond;
D) Specifications;
E) Technical Specifications provided in the Contract Documents;

F) General Conditions;
G) Supplementary Conditions, including any utility -specific forms
provided by the applicable utility service provider;
H) Notice to Proceed;
1) Change Orders;
J) Certificate of Substantial Completion;
K) Certificate of Final Inspection;
L) Certificate of Engineer;
M) Certificate of Final Completion;
N) CONTRACTOR's Release;
0) Drawings and Plans;
P) Supplemental Agreements;
Q) CONTRACTOR's Waiver of Lien (Partial);
R) CONTRACTOR's Waiver of Lien (Final and Complete);
S) SubcontractorNendor's Waiver of Lien (Final and Complete);
T) Consent of Surety to Final Payment;
IT) Instructions to Bidders; and
V) CONTRACTOR's Insurance Requirements, Certificate and
Insurance Policies.
c) There are no Contract Documents other than those listed above in this Section.
The Contract Documents may only be altered, amended or repealed by a modification as
provided in the General Conditions.

d) "CS Director" means the Community Services Director or his/her designee within
COUNTY's Community Services Department.
e) "COUNTY Approval" means written approval by the CS Director or the Board of
County Commissioners as may be necessary from time to time.
f) "HOME" or "HOME Program" shall mean the federally funded, affordable
housing program authorized by 42 USC, Sections 12701, et seq. and administered by HUD
pursuant to Title 24, CFR Part 92, and comprising the sole funding source for the Project through
COUNTY.
g) "HUD" shall mean the United States Department of Housing and Urban
Development.
h) "Parties" shall mean CONTRACTOR and COUNTY with respect to this
Agreement.
i) "Property" shall mean the real property parcel located at 804 Orange Avenue,
Sanford, Florida 32771 and bearing parcel identification number 25-19-30-5AG-100E-0030.
0) "Rehabilitation" / "Project" shall mean the renovation of the existing residential
structure on the Property and site work in a manner complaint with all applicable State and local
building, fire and health codes, all as more specifically described in the Exhibits A and B. The
terms Project and Rehabilitation are sometimes used interchangeably herein.
k) "USC" means United States Code.
Section 3. Services. COUNTY does hereby retain CONTRACTOR to furnish professional
Rehabilitation services and perform those tasks as further described in and in accordance with the
Contract Documents. CONTRACTOR shall also be bound by all requirements as contained in this
Agreement, the attendant Contract Documents, bid solicitation package and any addenda thereto.

Required services shall be specifically enumerated, described and depicted in the Notice to Proceed
authorizing performance of the Rehabilitation Project. This Agreement standing alone does not
authorize the commencement of any work in the absence of the appropriate Notice to Proceed nor
does it require COUNTY to issue any Notice to Proceed.
Section 4. Term. This Agreement shall take effect on the date of its execution by
COUNTY and shall run for a period of one (1) year, provided, however, that the Project must be
completed and have obtained a certificate of occupancy from the Building Official by no later than
ninety (90) days from issuance of a Notice to Proceed for the Project (sixty (60) days to substantial
completion and an additional thirty (30) days to final completion). CONTRACTOR's failure to
meet that deadline shall be a material breach of this Agreement. Expiration of the term of this
Agreement shall have no effect upon a Notice to Proceed issued pursuant to this Agreement and
prior to the expiration date. Obligations entered therein by both Parties shall remain in effect until
completion of the work authorized by the Notice to Proceed. The foregoing notwithstanding,
Sections 10, 111 14, 20 and 21 shall survive for their respective purposes and to comply with the
public records retention requirements.
Section 5. Authorization for Services. Authorization for performance of professional
services by CONTRACTOR under this Agreement shall be in the form of a written Notice to
Proceed issued and executed by COUNTY and signed by CONTRACTOR. Said Notice to Proceed
shall describe the Project services required, state the dates for commencement and completion of
work, and establish the amount and method of payment. The Notice to Proceed will be issued under
and shall incorporate the terms of this Agreement.
Section 6. Time for Completion and Liquidated Damages. The services to be rendered
by CONTRACTOR shall be commenced as specified in the Notice to Proceed to be issued

hereunder and shall be completed within the time specified therein. It is agreed that in the event the
Rehabilitation Project assignment is not completed within the specified time frame,
CONTRACTOR shall pay COUNTY, as liquidated damages and not as a penalty, TWO
HUNDRED FIFTY AND, N0/100 DOLLARS ($250.00) for each day of delay beyond the
originally scheduled completion date.
Section 7. Compensation. COUNTY agrees to compensate CONTRACTOR for the
professional services called for under this Agreement a Fixed Fee in the amount of FIFTY-ONE
THOUSAND NINE HUNDRED TWENTY-SIX AND N01100 DOLLARS ($51,926.00).
CONTRACTOR shall perform all work required by the Scope of Services, but in no event shall
CONTRACTOR be paid more than the negotiated Fixed Fee amount stated above.
CONTRACTOR shall be compensated based on prices listed on the Bid Form attached as Exhibit
B. Upon review and approval of CONTRACTOR's invoice, COUNTY shall, in accordance with
the terms as set forth in Chapter 218, Part VII, Florida Statutes, pay CONTRACTOR the approved
amount, subject in all respects to the provisions of Sections 8 and 9 of this Agreement.
Section 8. Retainage. All authorized Project services shall be governed by the retainage
provisions herein. If COUNTY determines that work is substantially complete and the amount
retained is considered to be in excess, COUNTY may, at its sole and absolute discretion, release the

and/or death) which may result from such: use, except where such loss or damage shall be due solelytothegrossnegligenceofBSE's employees operating equipment owned or leased by, BSE.
e) Subcontractor shall. indemnify, defend, and hold harmless the Indemnified Parties, including theOwner, BSE, their officers, affiliates, independent. contract associates; and employees from liabilities; damages, losses and costs; including but not limited to reasonable.attorney'.s fees to the extentcaused byfifenegligence, recklessness, or intentional wrongful misconduct of the Subcontractor and/or all personsemployedorutilizedbytheSubcontractorintheperformanceoftheAgreement. SubcontractorshaltassumeonbehalfofOwnerand/or BSE and all Indemnified Parties;and conduct with
due diligence and in good faith the defense thereof with counsel satisfactory'to BSE; provided, that
the Indemnified Parties shall have the right to be represented by counsel of its own selection; and provided
further, that if the defendants in any such action include Subcontractor. and any or all of the Indemnified
Parties, then the Indemnified Parties shall have reasonably concluded _that there.may be legal
defenses available to it which are different from or additional to; or inconsistent with, those available
to Subcontractor, Construction Manager and/or Owner shall have the rightto have and select. separate
counsel to participate in the defense of such action on either one or both's behalf at Contractor'
s expense. In the event of failure, by Contractor to fully perform in accordance with this subsection,
the Indemnified Parties, at its option and without relieving Subcontractor of its obligations hereunder,
mayso perform. In that event all costs and expenses so incurred by the Indemnified.Parties from
the date any such expense was,paid by it or them until reimbursed bySubcontractor, shall also bear
interest at the highest rate allowable by law. 8)

c) At BSE's sole discretion, BSE may withhold from any payments due Subcontractor, reasonable
amounts to secure Subcontractor's performance of its warranty obligations hereunder and offset
against such amounts any warranty costs.
14) Liens
a) In the event that liens are filed by anyone working under Subcontractor, Subcontractor agrees to have
the same released,. discharged, or transferred to bond or cash deposit pursuant to Florida Statute
713.24 within five (5) days of written notice from BSE. In the event such lien is not.timely released,.
discharged, or transferred the Subcontractor may be terminated or BSE may bond the lien. and back
charge all costs, at BSE's option.
b) Prior to final payment Subcontractor shall provide BSE a release of all liens and claims, and releases
or waivers of all liens and claims of all persons furnishing labor.and/or materials through Subcontractor,
and a final Subcontractor's affidavit truthfully reflecting no unpaid lienors under Subcontractor (See
Exhibit "D.2").
c) As a condition precedent to entitlement to any subsequent payment, Subcontractor shall famish
uncondfional releases of lien with respect to all prior payments, as part of each request for partial
payment other than the initial request (See Exhibit"DA).
d) BSE may issue joint checks to the. Subcontractor and any unpaid subcontractor, laborer, orsupplier.
15) Shop Drawings, Submittals, and Samples
a) Subcontractor shad deliver to BSE 3 copies of shop drawings, cut sheets, samples and material lists
required by. BSE, or the Construction Documents within sufficienttime so as not to delay performance of
the Work and within sufficient time for BSE to submit the same to the design professional for review. Any
deviation or change` from the Construction Documents must be clearly, identified on shop drawings
and be accompanied by a letter describing such deviation or.change in detail along with the effect,
if any; on the Subcontractor's Work and time of performance. b)
BSE's review of shop drawings, cut sheets, samples and material lists is :only for the convenience of the
BSE in following. the Work and: shall not relieve the Subcontractor from responsibility for any deviations
from the requirements of the Construction Documents. 16)
Clean Up Subcontractor
shall daily, and upon completion of the Work, clean the site to BSE's satisfaction, including removal
of all debris and other materials left.by Subcontractor, to a place designated by BSE for such: purpose. If
Subcontractor fails to do so, Construction BSE may impose a cleanup back .charge for each day the Subcontractor
fails to do so. 17)
Subcontractor's Representatives An
authorized, competent representative of Subcontractor fluent in English shall be on site at the Project site during
all working hours. This representative must be able to read and understand all Hazardous Material literature
relevant to the Work. This representative shall be authorized to make binding decisions on behalf of Subcontractor.
Subcontractor shall provide BSE with. the proper names, phone numbers, mobile phone numbers
and:e-mail addresses of its key field and home office personnel. 18)
Back Charges Subcontractor
shall resolve all back charges received from BSE within thirty (36) days after receipt of a back charge,
and if the.same are not resol.ved within;said thirty (30) days, Subcontractor shall be deemed to have waived
any assertions relating to the back charges. 19)
Assignment and Subcontracting Subcontractor
shall not assign or transfer Agreement or funds due hereunder, withoutthe prior written consent of
BSE. All subcontracts and change orders awarded by Subcontractor are intended to be for the benefit of the
BSE. All subcontracts of lower tier subcontractors shall be assignable by each such subcontractor to BSE upon

11) Changes a) BSE
may, at
any time, without notice, make changes in the Work. Any Change Order shall be in writing. Subcontractor shall performtheworkinaccordancewiththeChangeOrder- b), Subcontractor shall submit
any claims for adjustment in the price or time of performance to BSE within seven (7) days ofthereceiptofthe.Change Orderi and before beginning any changed or extra work. BSE shall review theSubcontractor's requestand shall notify Subcontractor if such request has been accepted or rejected. Iftherequestisrejected, SSE shall discuss with Subcontractor the reasons for the denial of thepriceadjustment. If the parties are unable to agree on a price adjustment, both patties shall have the righttoterminatethisAgreement: Failure to timely give written notice.of sucha claim(s) shall be a waiver
of any claimfor extra cost or extra time. c) Subcontractor shall, within
seven (7) days of any request from HSE. Submit a reasonable price quotation for proposed changes.
12) Termination of Agreement

or part of Subcontractor's right to perform the Work under this Agreement or any Change Order
upon forty-eight (48) hours written notice to Subcontractor. upon receipt of such notice, unless directedotherwise, Subcontractor will immediately discontinue prosecution of the Work and the
placing of orders for materials, equipment, machinery and supplies in connection therewith and will, if
requested, make every reasonable effort to procure cancellation of all existing orders for contracts upon
terms satisfactory to BSE. Then, unless otherwise directed by BSE, INITIAT
Subcontractor will only do such work as may be necessary to preserve and protect that portion of
the Work that has been incorporated into the Work and to protect materials, supplies and equipment
at or about the site or in transit thereto.
b) On the date set for the termination, the obligations of the parties to continue performance under
this Agreement or Change Orders will cease. If, in the sole. opinion of BSE, the Subcontractor' shall
at anytime (1) refuse or fail to provide sufficient and properly skilled workmen, or materials of the
proper quality and sufficient quantity to maintain the progress of the work (2) fail in any respect to
perform the Work according to the current schedule, (3) cause, by any actor omission, the stoppage
or delay of or interference with the Work or the work of any other subcontractor, (4) fail to comply with
any provision of this Agreement or the Construction Documents, (5) be adjudicated bankrupt; or make
a general assignment for the benefit of its creditors, (6) have a receiver appointed, or (7) become
insolvent or a debtor in reorganization proceedings, then, after serving three (3) days' written notice,
unless the condition specified in such notice shall have been eliminated within such 'three (3) days,
BSE; at its option (i) may take such steps as are necessaryto address the failure or condition, including
but not limited to supplementation of the Subcontractor's workforce by other personnel supplied, in
which case the Subcontractor shall be liable to BSE for the cost thereof, (ii) terminate the Agreement
for default. In the event.of termination for default, BSE may, at its option, (a) enter upon the premises
and take possession, for the purpose of completing the Work, of all materials, tools and appliances,
supplies, and equipment of Subcontractor, (b) require Subcontractor to assign to BSE any or all of
Subcontractor's subcontracts or purchase orders involving the Work, or (c) complete the Work by
whatever method. BSE may deem reasonable. to case of termination for default;. Subcontractor or
shall not be entitled to receive any further payment until the Work shall be fully completed and accepted
by BSE. At such time, if the unpaid" balance of the price shall exceed the "expense incurred by BSE to
complete; such excess shall be paid by BSE to Subcontractor. If such amount to complete and correct
shall exceed such unpaid balance, then Subcontractor shall pay BSE the difference. Upon a default
by Subcontractor, BSE may retain from any sum owed to Subcontractor all sums as may be owed
from Subcontractor to BSE. BSE may retain a sufficient sum to protect, itself from any claim or demand
asserted against it by a`third party as a result of work performed by Subcontractor hereunder until
such claim or demand has been satisfied.
c) Notwithstanding any other provision to the contrary, the termination of this Agreement or any
Change Order will not prejudice any claim of either party arising prior to termination, or relieve
either party from :any liability arising prior to termination, nor will it affect :Subcontractor's guarantee
of the portion of the Work performedor relieve Subcontractor of its duty to correct any defective Work
performed or to indemnify, defend and hold BSE harmless in those instances required by this Agreement..
d)
BSE may terminate this agreement for convenience, without cause. In the event of a termination for convenience,
the Subcontractor shall be paid the reasonable value of the work in place and any reasonable
demobilization cost, but no lost profit on unperformed work. 13)
Warranty a)
The Subcontractor warrants to 13SE that materials and equipment fumished under the Agreement will be
of specified quality and new unless otherwise required or permitted, that the Work will be free from defects,
and that the Work will conform to the requirements of the Agreement. Work not conforming to
these requirements including substitutions not previously approved and authorized before installation,
may be considered defective. If required by BSE, the Subcontractor shall furnish satisfactory
evidence as to the kind and quality of materials and equipment. The Warranty provided shall
continue for a period of one (1) year next following the issuance of a Certificate of Occupancy for the
building in which the work is done. b)
Subcontractor shall remove and, repair or replace any defective workmanship, material, and/or equipment
which defect occurs within one (1) years after acceptance of the work or within such longer period
as may be provided in the Agreement at Subcontractor's expense and BSE's convenience. Subcontractor
shall also pay all expenses incurred in removing, replacing or repairing any work that results
from removing, replacing or repairing any part of its defective work: 2

a) Subcontractor will supervise, administer and protecttheWork against loss or damage from any causeandberesponsibleforallpartsoftheWork, temporary or permanent; finished or not, until inspected
and accepted by BSE. Subcontractor will take reasonable precaution. n d maintain reasonable
safeguards to protect against loss or damage to persons or property 9 to weather conditions
including, but not limited to bracing and reinforcing where necessary. b)
Subcontractor shall maintain the site in a neat and orderly condition consistent with reasonable conditionsassociatedwithaconstructionjob. This shall require removal of debris and garbage on a.
daily basis. The site shall at all times be maintained consistent with local government requirements.
All garbage and debris shall be stored in containers maintained at or adjacent to the site
in approved locations 9)
Prepara bon Immediately
following execution and delivery of this Agreement; Subcontractor shall make appropriate preparationstoperform .the Work, including all of the following; which must be completed within 10 days followingfromEffectiveDate.or prior to the commencement of the Work, whichever is sooner: a)
Insurance i)
Subcontractor; at its cost, through the term of this Agreement; shah obtain and maintain in force andeffectthefollowinginsurance (with such insurance company rated no less than A- by AM BEST)
with respect to.Subcontractoes operations under this Agreement: n)
Worker's Compensation: Worker's compensation insurance covering all employees of Subcontractor
in the amount of Subcontractor's full statutory liability. Exemptions are not permitted.
iii)
Employer's Liability: Employer's liability insurance with a.limitation of liability of at least $500,000 per
accident or disease. iv)
General Liability Insurance: Comprehensive General Liability Insurance with coverage limitations of
not less than $1,000,000 combined single limit v) '
Contractual liability, completed operations; and environmental insurance. vi)
Automobile Liability: Automobile liability insurance for personal injury or death with coverage limits of
not less than $1,000,060 combined single limit. b) '
Subcontractor will `supply BSE with Certificate(s) of Insurance evidencing the required coverage at leastten (10) business days prior to Subcontractor's commencing the. Work. No certificate will be acceptableunlessitprovidesthatanychangeorterminationwithinthepolicyperiodswillllenotunder

unless and until BSE has received thirty(30) days prior written notice. Any. anyinsurancepolicyshallbepayablebySubcontractor. If Subcontractor's insurance coverage is not inforce; BSE may withholdpayment until the required insurance is obtained and evidence is submitted to BSE.
c) If
Subcontractor fails to obtain or maintain any required insurance, BSE shall have the option, but not the duty, to obtain or maintain such insurance for the account of Subcontractor, with all costs.incurred by BSE
to be reimbursed by Subcontractor upon demand. d) All
insurance must.name Owner, BSE and Subcontractor as co-insured, must be written by companies authorized todobusiness.in the State of Florida that are acceptable to BSE and must not contain any right of
subrogation against Owner or BSE. e) Site
Requirements Subcontractor shall.
deliver to BSE a detailed written statement specifying the particulars, if any, in which the site
is not in proper condition to receive the Work. Failure.to furnish such statement shall constitute an acceptance of
the site, and act as a waiver of all claims by Subcontractor against BSE. f) Permits
Subcontractor will
obtain at itssole cost and expense all permits necessary for the Work. 10) Health

20) Taxes and permits
Except as -otherwise provided by the Agreement, Subcontractor agrees to pay and hold the BSE and ,BSE
harmless from the payment of all contributions, taxes, and/or premiums which may be payable bySubcontractorarisingoutoftheperformanceofthis .Agreement; as well as all sales, use, or other taxes of
whatever nature levied or assessed arising out of this Agreement including any interest or penalties.
Subcontractor waives any and all claims for additional compensation because of any increase in theaforementionedtaxesunlesspaymentforsaidincreaseisspecificallyprovidedforintheAgreement. Subcontractor shall obtain and pay for all permits, licenses, fees and certificates of inspection necessaryfor the
prosecution and completion of.its work, and shall arrange for all necessary inspection and.approvals by public
officials. 21)
Laws, Regulations' and Ordinances a)
Subcontractor agrees to be bound by, and, at its own cost, comply with all federal, state, and local laws,
codes, ordinances and regulations applicable to this Agreement and the performance of the Work
whether by reason of -general law or by reason of provisions in the Agreement. Subcontractor shall
be duly licensed to operate under the law of the applicable jurisdictions. b)
Subcontractor shall comply with Section 3 of the Housing and Urban Development Act of 1968.(12 U.
S.C. 1701 u), (Section 3) to ensure that employment and other, economic opportunities generated by. certain
HUD financial assistance shall, to the greatest"extent feasible, be directed to low and very low income
persons, particularly those who are recipients of government assistance of housing. As part of this
project, subcontractor will be responsible for compliance with all applicable requirements as defined
in Parti35 of Section 3 regulations (See ExhibitH): 22}
Severability and Waiver. A
partial or complete invalidity of any one or more provisions of this Agreement shall not affect the validity of the
remainder of the, contract. Any such invalid clause shall be considered severable. 23).
Jurisdiction; Service Of Process This
Agreement contains the entire Agreement between the Parties hereto and. shalll-supersede all other agreements,.
either oral or written, between the Parties. This Agreement cannot be modified or amended without
the express written consent of the Parties. This Agreement shall be construed in accordance with thelawsoftheStateofFlorida. In.the event of litigation between Parties, the venue will be the courts of the State
of Florida, St, Lucie County and the Parties will accept service of process of such `courts. 24)
Dispute Resolution Subcontractor
and BSE;;hereby knowingly, voluntarily and intentionally waive the right to atrial by jury for any litigation
arising rout, of under, or in connection with this Agreement; In connection with any such litigation, the prevailing partyshallbeentitledtorecoveritsreasonableattomey's fees and costs, incurred at both trial. and appellate levels. Such fees are limited to 50 000.. These provisions are material inducements.for the parties to enterintothisAgreement. Venue for any such litigation shall be in a court of competent, jurisdiction in St., Lucie County,
Florida. 26) Independent
Contractor. Per Exhibit "
FA, Subcontractor is an independent contractor with respect to the Work, and neither Subcontractor nor
anyone employed by Subcontractor will be deemed for any purpose to be the :agent,. employees, servant
or representative of BSE in the performance of the Work. 26) Moisture
Intrusion Prevention and Mold Action Plan b) Any
moldy, wet, or damaged materials will be segregated and retumed by Subcontractor to.his suppliers, and
is not to be used. c) Any
water on the surfaces of building.construction materials and packages should be wiped dry before:storing
to avoid adding moisture to storage areas. d) Subcontractor
must follow manufacturer's direction for .material storage. These instructions must. be followedforwood; wood products, insulation materials, drywall, carpet, fabric, and paper products. 2

e) Subcontractor to provide immediate notification to BSE of any and all moisture intrusion, includingbutnotlimitedtopipeleaks, condensation, flooding, window leaks, roof leaks, door threshold leaks
or sliding glass door leaks.
f) Subcontractor shall visually inspect building materials delivered to the site prior to storage to ensure
building materials were delivered in original, factory sealed, .unopened packages containers orbundles. Wet or moldy packages must be rejected and returned or segregated from clean materials
for. resolution.
g) Segregate those packages with mold and/or water damage to eliminate spread of mold to clean
materials in the storage area. Do not use drywall which has been exposed.to the elements.
h) All piping (mechanical, electrical, plumbing, and fire sprinkler) risers should extend above slabs aminimumof4" and be caulked or foamed to prevent moisture intrusion through slabs.
27) Subcontractor's Commitment. to Customer Service
The Subcontractor agrees to provide excellent Customer Service and follow the Customer Service Policy
fisted below:
b) Be on time for appointments and call BSE if more than 15 minutes late.
c) Will not criticize the work of other subcontractors in front.
d) Will not argue with or disrespect Owner, Owner's representatives or BSE.
e) No smoking in any structure or building on the Property at any time or at any stage.
f) No eating in the house at any time or at any stage.
g) No tools or materials on countertops or other finished surfaces, regardless of protection.
h) No shoes worn inside the Job after flooring installed.
i) Close all windows and doors at the conclusion of a workday, or Subcontractor may be responsible
for water damage.
j) All service personnel to be dressed and groomed neatly when with Owners.
k) Ask BSE to sign the service ticket when the work has been completed. Return these to BSE, within10daysofissue, or BSE will not know that the work has been completed. SSE, reserves the righttowithholdanymoniesdueSubcontractorifserviceworkisnotcompletedonatimelybasis. ,
