AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ORDINANCE NO. 3018, SAID ORDINANCE
BEING A COMPREHENSIVE PLAN, AMENDING THE
FUTURE LAND USE PLAN ELEMENT TO PROVIDE SMALL-
SCALE COMPREHENSIVE PLAN AMENDMENT OF THE
COMPREHENSIVE PLAN TO DESIGNATE A PORTION OF
THAT CERTAIN PROPERTY LYING BETWEEN AIRPORT
BOULEVARD AND JERRY AVENUE AND BETWEEN
MCCRACKEN ROAD AND ACADEMY AVENUE FROM
INDUSTRIAL TO MEDIUM DENSITY RESIDENTIAL-10;
PROVIDING FOR SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
WHEREAS, the City Commission, as the City's governing body,
held a public hearing on March 27, 1995, to consider amending the
Future Land Use Concept Map of the Future Land Use Plan Element of
the Comprehensive Plan, Sanford, Florida; and
WHEREAS, the City of Sanford has complied with requirements
and procedures to amend adopted comprehensive plans as set forth in
Florida Statutes.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That portion of the Future Land Use Plan
Element referenced as the Future Land Use Concept Map be amendedby
changing the designation from Industrial to Medium Density
Residential-10 for that certain property lying between Airport
Boulevard and Jerry Avenue and between McCracken Road and Academy
Avenue. Said property being more specifically described as
follows:
THE EAST 10.00 ACRES OF THE FOLLOWING
DESCRIBED PARCEL OF LAND:
All of Blocks 73 and 78, M.M. Smith's
Subdivision according to the plat thereof as
recorded in Plat Book 1, Page 55 of the Public
Records of Seminole County, Florida, lying
Southerly of McCracken Road (50' R/W), and
lying Easterly of Airport Boulevard (50' R/W);
LESS the Westerly (as measured along McCracken
Road) 200.00' of the Northerly (as measured
along Airport Boulevard) 200.00 feet thereof;
Together with that vacated (per City Ordinance
No. 1806) portion Of that certain unnamed 30'
Road lying Southerly of said Blocks 73 and 78.
SECTION 2: If any section or portion of a section of this
Ordinance proves to be invalid, unlawful or unconstitutional, it
shall not be held to impair the validity, force or effect of any
other section or part of this Ordinance.
SECTION 3: That all Ordinances or parts of ordinances in
conflict herewith be and the same are hereby revoked.
SECTION 4: That this Ordinance shall become effective
inunediately upon the issuance of a final order by the state land
planning agency determining this adopted amendment to be in
compliance in accordance with Section 163.3184(9), Florida
Statutes, or upon the issuance of a final order by the
Administration Commission determining this adopted amendment to be
in compliance in accordance with Section 163.3184(10), Florida
Statutes, whichever order is issued first.
