AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
MENDING ORDINANCE NO. 3117 OF SAID CITY; SAID
ORDINANCE BEING A ZONING PLAN; SAID AMENDMENTS
CHANGING THE ZONING OF A PORTION OF THAT
CERTAIN PROPERTY LYING BETWEEN AIRPORT
BOULEVARD AND JERRY AVENUE AND BETWEEN
MCCHACKEN ROAD AND ACADEMY AVENUE FROM RI~I,
RESTRICTED INDUSTRIAL, TO PD, PLAiqNED
DEVELOPMENT; PROVIDING FOR SEVERABILITY,
CONFLICTS AND EFFECTIVE DATE.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That Ordinance No. 3117 of the City of Sanford,
Florida passed and adopted July 27, 1992, said Ordinance being the
Comprehensive Zoning Ordinance of the City of Sanford, Florida,
regulating and restricting the location and use of buildings,
structures, land, and water from trade, industry, residence or
other purposed, be and the same is hereby amended as follows:
All of Blocks 73 and 78, M.M. Smith's Subdivision
according to the plat thereof as recorded in Plat Book 1,
Page 55 of the Public Records of Seminole County,
Florida, lying Southerly of McCracken Road (50'R/W), and
lying Easterly of Airport Blvd. (50'R/W); LESS the
Westerly (as measured along McCracken Road) 200.00' of
the Northerly (as measured along Airport Blvd.) 200.00
feet thereof; together with that vacated (per City
Ordinance No. 1806) portion of that certain unnamed 30'
road lying Southerly of said Blocks 73 and 78; and being
more particularly described as follows:
From the SW corner of Section 26, Township 19 South,
Range 30 East, Seminole County, Florida run N.00°05'29"E
along the West line of said Section 26, a distance of
15.00 fee; thence run N.89°42'07"E, 25.00 feet to the
intersection of the East Right-of-Way line of Airport
Blvd. (50'R/W) with the South line of Block 73, said M.M.
Smith's Subdivision, said point also being the Point of
Beginning; thence continue N.89o42'07.E along said
unnamed 30' road; thence run S.00~26'26',E along said West
line a distance of 15.00 feet; thence run N.80°42'07.E
parallel to the South lines of said Blocks 73 and 78, a
distance of 891.37' to a point lying 15 feet South Of the
SE corner Of said Block 78; thence run N.00°26'26"W, to
and along the East line of said Block 78, a distance of
567.31 feet to the South Right-of-Way of McCracken Road;
thence run S.81°34'29"W, along said Right-of-Way line
1100.43 feet to a point lying 200 feet; thence run
S.81~34'29"W, 200.00 feet to a point on the said East
Right-of~Way line of Airport Blvd., thence run
S.00~05'29"W, 168.47 feet to the Point of Beginning
Containing 13.02 acres more or less.
be and the same is hereby rezoned from RI-1, Restricted Industrial,
to PD, Planned Development, and the McCracken Planned Development
Master Plan attached as Exhibit ~A" is incorporated herein by
reference as if fully set forth herein. An additional condition of
development is that prior to issuance of any site development
permit or building permit, dedication to the City of a sewage lift
station site to coincide with the existing City lift station
presently located on site shall be accomplished.
SECTION 2: Severability. If any section or portion of a
section of this Ordinance proves to be invalid, unlawful or
unconstitutional it shall not be held to in~Dair the validity, force
or effect of any other section or part of a section of this
Ordinance.
SECTION 3: Conflicts. That all ordinances or parts of
ordinances in conflict herewith be and the same are hereby revoked.
SECTION 4: Effective Date. That this Ordinance shall become
effective immediately upon its passage and adoption.
