An ordinance of the City Commission of the City of Sanford, Florida
substantially and comprehensively revising and amending the
provisions of Schedule "N", City of Sanford Code/Land Development
Regulations (LDRs), relating to an array of subdivision requirements;
providing for a savings provision; providing for conflicts; providing for
severability; providing for an exhibit, codification and the correction of
scrivener's errors; and providing for an effective date.
Be it enacted by the People of the City of Sanford, Florida:
Section 1. Substantial And Comprehensive Revision And Amendment Of
Schedule "N", City of Sanford CodelLand Development Regulations, Subdivision
Requirements.
(a). Schedule "N" of the City of Sanford Code/Land Development Regulations
is substantially revised and amended to read as set forth in the Exhibit to this Ordinance
which, by this reference thereto, is incorporated herein as if fully set forth herein verbatim.
(b). The Exhibit to this Ordinance is, to a large extent, legislatively coded with
underling representing additions or amendments and strike-throughs as deletions.
(c). Regardless as to whether the coding is present or not, the City Commission
adopts the text that is not stricken through as part of the text that is enacted by this
Ordinance.
Section 2. Conflicts.
All ordinances or part of ordinances in conflict with this Ordinance are hereby
repealed.
Section 3. Severability.
If any section, sentence, phrase, word, or portion of this Ordinance is determined
to be invalid, unlawful or unconstitutional, said determination shall not be held to
invalidate or impair the validity, force or effect of any other section, sentence, phrase,
word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or
unconstitutional.
Section 4. Savings; Effect Of Ordinance.
The prior actions of the City of Sanford in terms of the matters relating to any and
all actions and activities of the City pertaining to the City's Land Development
RegulationslLand Development Code, or of an associated nature, are hereby ratified and
affirmed.
Section 5. Codification; Scrivener's Errors.
(a). The Exhibit referenced in Section 1 of this Ordinance shall be codified and
all other sections of this Ordinance shall not be codified.
(b). The sections, divisions and provisions of this Ordinance may be
renumbered or re -lettered as deemed appropriate by the Code codifier.
(c). Typographical errors and other matters of a similar nature that do not affect
the intent of this Ordinance, as determined by the City Clerk and City Attorney, may be
corrected with the endorsement of the City Manager, or designee, without the need for a
public hearing.

Section 6. Effective Date.
This Ordinance shall become effective immediately upon enactment.

Subdivision Requirements; Ordinance N . 461.2; Legislative Matter.

SYNOPSIS:
Amendments to Schedule "N" of the City's Land Development Regulations (LDRs) relating to
subdivision Requirements has been prepared to provide for improved drainage, updated materials
specifications and construction practices in order to protect the public health, safety and welfare
and otherwise benefit the City and its citizens and property owners. The changes are set forth in
Ordinance No. 4612.
FISCAL,ISTAFFING STATEMENT:
There is no anticipated cost to the City to implement the new regulations. However, improved
drainage and construction practices will benefit property owners and the City and the regulations
will be clearer and more legally defensible in the event of a challenge.
BACKGROUND:
All subdivisions, streets, lots, tracts and related improvements in the City are required to be
developed and improved in accordance with minimum standards and requirements necessary to
protect the safety of the public.
A meeting was held on August 4, 2020 with members of the development community and
engineering professionals to provide an opportunity for feedback related to the proposed
modifications. All comments have been evaluated and considered in the course of drafting the
proposed amendments.
On June 3, 2021, the Planning and Zoning Commission reviewed the proposed amendments and
recommended the City Commission adopt an ordinance to approve the revisions to Schedule "N"
of the City's LDRs. A synopsis of the proposed modifications follows:

0 Fill Material Requirements: Currently the City has no specifications to
cover fill used on development sites. Ordinance No. 4612 adds gradation and
testing requirements.
Drainage Related Improvements: Minimum slopes for Miami Curb (also
Lown as a Florida Department of Transportation "Drop Curb" which look like a
concrete gutter and channels water into a storm drain/curb inlet) are raised to 0.5%
due to issues with spread and flow outside the roadway. F Type curbing is still
allowed at 0.3%.
0 Phased Construction: Each Phase of construction must be able to stand-
alone. For example, a temporary cul-de-sac will be required to be addressed with
the grant of an easement matching the right-of-way requirement that can be vacated
with the next phase of construction.
• Updates to outdated specifications and materials: Specifications for
lighting, asphalt, and other items that have changed over the years due to new
products and innovations have been addressed. Light -emitting diode lighting (a
semiconductor diode which glows when a voltage is applied and referred to as
"LED lighting") is included as are "Superpave" (an acronym for "Superior
Performing Asphalt Pavements" which evolved from partnerships created among
Federal Highway Administration, the American Association of State Highway and
Transportation Officials and other organization) specifications have been added.
LEGAL REVIEW:
The Assistant City Attorney has reviewed this item and drafted Ordinance No. 4612.
The City Commission approved the first reading of Ordinance No. 4612 on June 14, 2021.
The City Clerk published notice of the 2nd Public Hearing in the Sanford Herald on June 27, 2021.
RECOMMENDATION:
Section 163.3174, Florida Statutes, requires the City's "local planning agency" or LPA to review
proposed land development regulations and make recommendations to the City Commission as to
the consistency of the changes with the adopted comprehensive plan. Accordingly, on June 3,
2021, the Planning and Zoning Commission (serving as the City's LPA) unanimously
recommended the City Commission adopt Ordinance No. 4612.
Additional comments or recommendations may be presented by staff at the meeting.
