FINDINGS OF FACT Property Owners: Robert J. Lees and Mary J. Lees 1215 Oak Avenue Sanford, Florida 32771-2841 Applicant: Mary Jane Lees 1215 Oak Avenue Sanford, Florida 32771-2841 Project: Approval of the HPB to modify a front porch railing relative to property located at 1215 Oak Avenue. Requested Development Approval: The Applicant requested approval of the HPB to modify a front porch railing relative to property located at the 1215 Oak Avenue. Additional Findings: The project is located at 1215 Oak Avenue in the City's Residential Historic District as described and depicted in Schedule "S" of the City's 11 P a g e Land Development Regulations (LDRs). The structure located on the subject property was constructed in 1925 according to a review of the Seminole County Property Appraisers records, but it appears on the 1917 Sanborn map. The existing porch columns, railings and turned spindles are deteriorated and the applicant is proposing simple wood replacements, for these items that research shows were added sometime after 1987 but before 2010. It is not known what type, or if any railing was in place before a 1987 photograph that is of record. No railings or very simple porch elements are in character with this style and period. There is no physical or pictorial evidence to suggest the subject porch had railing installed along the front and sides, but this simple style wood railing has been approved on numerous porches in the Residential Historic District.. CONCLUSIONS OF LAW (a). Pursuant to Section 8.0 of Schedule "S" of the City's LDRs, the HPB has reviewed the proposed Certificate of Appropriateness and all application documentation and matters relating thereto in accordance with the procedures for altering historic landmarks or structures within historic districts as set forth in Schedule "S". (b). Specifically, Schedule "S" of the City's LDRs provides as follows: (1). Porches or porch elements that are in good condition or repairable and in character with the style and period of the building shall be retained. Porches and porch features shall be repaired so the match the original in materials, size and configuration. Replacement of existing porches with a design or 21P a g e materials not in character with the style and period of the building are prohibited and unlawful. (4). New porch elements, such as, by way of example only and not as a limitation, balusters and columns, brackets, trim and architectural embellishments shall be compatible with the style and period of the building and shall be substantiated by physical and/or pictorial evidence of the subject property. (c). To the extent that a conclusion of law as set forth herein also constitutes a factual finding, then such shall be taken to be so as part of this Development Order. (d). The proposed Certificate of Appropriateness is hereby found and determined to comply with the aforestated requirements and provisions. (e). Additionally, the Certificate of Appropriateness sought is hereby found and determined to be consistent with the City of Sanford Comprehensive Plan and development of the property as proposed would be consistent with and in compliance to applicable land development regulations and all other applicable regulations and ordinances as set forth in the Code of Ordinances of the City of Sanford. NOW, THEREFORE, IT IS ORDERED THAT: (1). The aforementioned application for a Certificate of Appropriateness is APPROVED. (2). This Development Order granting approval of a Certificate of Appropriateness touches and concerns the aforedescribed property and is subject to code enforcement action in accordance with the controlling provisions of law. 31Page As approved and authorized for execution by the Historic Preservation Board of the City of Sanford at its meeting of June 16, 2021.
