An ordinance of the City of Sanford, Florida relating to a Planned
Development (PD) by rezoning 108 acres of the parent parcel of 214
acres in size and amending a portion of the Seminole Towne Center
PD Master Plan; providing for the rezoning of real property generally
addressed and located at the Seminole Towne Center Mall site and
generally addressed as 200 Towne Center Boulevard which property
is assigned Tax Parcel Identification Numbers:
29-19-30-5LW-0100-0000, 29-19-30-5LW-1300-0000,
32-19-30-5MR-2100-0000, 29-19-30-5LW-0400-0000,
29-19-30-5LW-0300-0000, 29-19-30-5LW-1200-0000,
29-19-30-5LW-010A-0000, 29-19-30-5LW-010E-0000 and
29-19-30-5LW-0200-0000 by the Seminole County Property Appraiser
all of which parcels are located within the City Limits (map of the
subject property attached); providing for findings and intent,
development conditions and the resolution of disputes by the
Planning and Zoning Commission; providing for the taking of
implementing administrative actions; providing for the adoption of a
map and approving an amendment to a portion of the Seminole
Towne Center PD Master Plan; providing for conflicts; providing for
severability; providing for non -codification and providing for an
effective date.
Whereas, an application has been submitted proposing to amend a portion of
the Seminole Towne Center PD Master Plan which development is a Planned
Development (PD) zoning classification/district the property having been rezoned to the
Seminole Towne Center PD when enacted by Ordinance 3006 on July 9, 1990 and
amended subsequently, as needed, to address individual elements of development; and
Whereas, amendments to the Seminole Towne Center PD included
modification to the land boundaries and changes, modifications, additions and deletions
of allowable uses as listed on the PD Master Plan to individual parcels and sections of the
PD with additional variances being approved regarding signage and other area and
dimensional standards including, but not limited to landscaping and parking - the site
being, therefore, subject to the zoning restrictions contained within the Seminole Towne
being, therefore, subject to the zoning restrictions contained within the Seminole Towne
Center PD and associated amendments; and
Whereas, an a result of the number of changes and the incomplete nature of
the files for Seminole Towne Center PD; amendments to any given portion of the overall
PD is not an option and, as e majority owner of the mall recently changed hands, the
applicant is implementing a process to amend the PD to allow for a change in uses, in an
effort to generate interest in re -investing and redeveloping the mall; and
Whereas, the property owner (majority mall property owner) is Seminole Mall
Realty Holding, LLC of Great Neck, New York which property is the subject of this
Ordinance and assigned Tax Parcel Identification Numbers: 29-19-30-5LW-0100-0000,
29-19-30-51-W-1300-0000, 32-19-30-5MR-2100-0000, 29-19-30-5LW-0400-0000,
29-19-30-5LW-0300-0000, 29-19-30-51-W-1200-0000, 29-19-30-51-W-010A-0000,
29-19-30-5LW-010B-0000 and 29-19-30-51-W-0200-0000 by the Seminole County
Property Appraiser; and
Whereas, Mehran Kohansieh is the sole manager of Seminole Mall Realty
Whereas, the total subject property 214 acres, more or less, in size; and
Whereas, approximately 108 acres of the parent 214 acres of real property is
generally addressed as 200 Towne Center Boulevard and is located is generally located
south of State Road 46, North of State Road 417, East of Interstate Highway 4 and West
of Towne Center Boulevard; and

Whereas, the referenced 108 acres is graphically depicted as follows within the
context of the parent parcel of land:

Whereas, the overall planning goal for the actions being taken with regard to
the current PD and former Development of Regional Impact (DRI) development plan
(which currently encompasses more parcels than those being rezoned in this action), is
the high quality redevelopment of the parcels in question to create an overall
redevelopment effect for the Seminole Towne Center Mall which will generate additional
tax revenue for the City; and
Whereas, Pursuant Objective FLU 2.2: Implement Redevelopment and
Renewal Program, of the City's Comprehensive Plan, the City is committed to continuing

to implement redevelopment programs within several target areas on of which is "The
Seminole Towne Center"; and
Whereas, the first step in achieving both PD rezoning effectuated in this
Ordinance, subject to a subsequent entering of a development agreement, and the
aforementioned Objective FLU 2.2, the former DRI in place over the entire 214 acre
property needed to be rescinded in order to appropriately redevelop the Seminole Towne
Center to a multi -purpose mixed use development and its surrounding properties which
action took place on December 15, 2020 when the majority owner for the Seminole
Properties DRI filed an application with the City requesting to rescind the DRI pursuant to
Section 380.115(1)(b), Florida Statutes, and after a full review of the request, the City
confirmed that the mitigation required for the existing development within the DRI had
been met or was no longer relevant or needed with the City Commission approving an
Order, on March 22, 2021, effectuating the Rescission of Seminole Properties DRI
Development Order; and
Whereas, the original DRI/PD Development Program included the following:

; and
Whereas, inasmuch as the DRI has been rescinded, each of the properties
within the Seminole Properties DRI shall have the rights and entitlements authorized
under the City's Comprehensive Plan and Land Development Regulations (LDRs); and

Whereas, Javier Omana, P.E., CPH Engineers, Inc. of Sanford has made
application on behalf of the Property Owner; and
Whereas, attorney Julie P. Kendig of the Orlando office of the Greenberg
Traurig, P.A. law firm provided legal representation during the course of the proceedings;

Whereas, Mr. Omana the CAPP (Citizens Awareness and Participation Plan)
process for the Property Owner and mailed out a CAPP letter as part of the public hearing
for the DRI and pending PD Rezone on December 28, 2020, which letters were mailed by
the City to all property owners within 500 feet of the subject property on February 19,
2021, and, further, he caused a newspaper advertisement to be published in Sanford
Herald on February 21, 2021; and
Whereas, the City's Planning and Development Services Department has
conducted a thorough review and analysis of the demands upon public facilities and
recommended that the subject rezoning application be approved having determined that
the proposal is technically sufficient and consistent with the goals, objectives and policies
of the Comprehensive Plan of the City of Sanford, the City's LDRs, and the controlling
provisions of State law; and
Whereas, the City planning and development staff recommended approval of
this Ordinance subject to normative development detailed development requirements
and conditions some of which, if not later resolved, shall be subject to resolution by the
Planning and Zoning Commission; and
Whereas, the City of Sanford's Planning and Zoning Commission, as the City's

local planning agency, held a public hearing on December 2, 2021 to consider amending
the zoning of the subject property and recommended approval of the action taken herein
as requested by the Property Owner; and
Whereas, the City Commission has determined that the proposed rezoning of
the subject property as set forth in this Ordinance is consistent with the Comprehensive
Plan of the City of Sanford, the City's LDRs, and the controlling provisions of State law;
and
Whereas, the City Commission of the City of Sanford, Florida has taken all
actions relating to PD rezoning action set forth herein in accordance with the
requirements and procedures mandated by State law.
Now, therefore, be in enacted by the People of the City of Sanford, Florida.
Section 1. Legislative findings and intent.
(a). The City Commission of the City of Sanford hereby adopts and
incorporates into this Ordinance the City staff report and City Commission agenda
memorandum relating to the application relating to the proposed rezoning of the subject
property as well as the recitals (whereas clauses) to this Ordinance.
(b). The approval set forth in this Ordinance is subject to the specific conditions
that are set forth subsequently in this Ordinance and the Property Owner has agreed that
no requirement herein lacks an essential nexus to a legitimate public purpose and is not
roughly proportionate to the impacts of the proposed use that the City seeks to avoid,
minimize, or mitigate.
(c). The City of Sanford has complied with all requirements and procedures of

Florida law in processing and advertising this Ordinance.
(d). This Ordinance is consistent with the goals, objectives and policies of the
Comprehensive Plan of the City of Sanford.
Section 2. Rezoning of real property/implementing actions; amending a
portion of the Seminole Towne Center PD.
(a), Upon enactment of this Ordinance the subject property, as depicted in the
map attached to this Ordinance shall be rezoned to Seminole Towne Center PD, as
amended.
(b). The City Manager, or designee, is hereby authorized to execute any
documents necessary to formalize approval of the rezoning action taken herein with
regard to the Seminole Towne Center PD, as amended, and to revise and amend the
Official Zoning Map or Maps of the City of Sanford as may be appropriate to accomplish
the action taken in this Ordinance and as set forth herein.
(c). The conditions to be incorporated into the pertinent development order
relating to the action taken in this Ordinance include the following:
(1). All development shall be consistent with the Amended
Seminole Towne Center PD Master Plan, revision dated November 2,
2021, unless otherwise specifically set forth in any associated development
agreement; provided, however, that all subsequent development orders
shall be consistent with the provisions of this Ordinance.
(2). Unless specifically requested and approved on the
referenced PD Master Plan, any required elements missing from or not
shown on the PD Master Plan shall comply with the City's LDRs or the

conditions set forth within this Ordinance.
(3). All new development, including any change of use within an
existing building, shall be subject to the development review process and
shall be subject to required site approvals and issuance of appropriate site
development permits.
(4). New development on the subject PD Property shall be served
by adequate parking resources which shall include, at a minimum, off-street
parking sufficient to serve each proposed new development either on the
specific parcel or through the provision of a shared parking agreement as
approved by the City Attorney with regard to a site approved by the
Administrative Official based upon reasonable proximity and sound and
generally accepted planning and land development principals relating to
planning matters and pedestrian traffic.
(5). Any redesign or redevelopment of parking areas shall be
subject to the requirements of Schedule H - Parking Requirements,
Schedule G — Architectural Design Standards and Schedule J —
Landscape, Buffer and Tree Requirements, all of the City's LDRs.
(6). The final design and location of any new or revised driveways
or access points including, but not limited to, cross access locations, shall
be proposed within and shall be subject to City approval during, the
development plan review and approval process and cross access
easements shall be subject to City Attorney review and approval.

(7). Any modification to the central stormwater system and its
associated retention areas shall be subject to and redesigned to meet
Schedule 0 - Drainage, Easements & Site Preparation/Excavation
Requirements, of the City's LDRs of the City's LDRs, and modifications
approved by the St. Johns River Water Management District, as required,
subject to the limitations of Section 166.033, Florida Statutes.
(8). A decorative and functional fountain shall be installed in all
wet retention ponds as part of development approval which approval shall
provide for ongoing maintenance requirements and responsibilities upon
the appropriate party, but not the City.
(9). Lighting and pedestrian amenities shall be included to
improve the overall image of the pedestrian network
(10). A comprehensive signage program meeting the standards of
the City's LDRs shall be required for the entire development including, but
not limited to, the commercial and multiple family residential uses at said
time when the overall mall signage is amended.
(11). A comprehensive landscape design including, but not limited
to, landscape and hardscape elements shall be provided during
redevelopment and said design shall incorporate landscape/hardscape
elements to screen the parking areas and any mechanical
equipment/appurtenances from the public right of way.
(12). There shall be no development on Tract 13 until a future land

use amendment is adopted and all required mitigation and stormwater
reconfiguration is approved in accordance with controlling law subject to the
limitations of Section 166.033, Florida Statutes.
(13). If City staff and the Property Owner are unable to agree to the
details of this Development Order in any way, the matter will be submitted
to the Planning and Zoning Commission for resolution at a public hearing,
and the matter will be adjudicated by means of a development order or
denial development order relating thereto.
(14). In agreeing to the above conditions in the subsequent PD
development agreement, the Property Owner will agree that, in
accordance with the provisions of Section 70.45, Florida Statutes,
pertaining to governmental exactions, the City has not imposed any
prohibited exaction. The term "prohibited exaction" is defined by that statute
to mean ". . . any condition imposed by a governmental entity on a property
owner's proposed use of real property that lacks an essential nexus to a
legitimate public purpose and is not roughly proportionate to the impacts of
the proposed use that the governmental entity seeks to avoid, minimize, or
mitigate."
Section 3. Incorporation of map and Seminole Towne Center PD, as
amended, Master Plan for the Seminole Towne Center PD, as amended.
The map attached to this Ordinance is hereby ratified and affirmed and
incorporated into this Ordinance as a substantive part of this Ordinance establishing
Seminole Towne Center PD, as amended.

Section 4. Conflicts.
All ordinances or part of ordinances in conflict with this Ordinance are hereby

Section 5. Severability.
If any section, sentence, phrase, word, or portion of this Ordinance is determined
to be invalid, unlawful or unconstitutional, said determination shall not be held to
invalidate or impair the validity, force or effect of any other section, sentence, phrase,
word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or
unconstitutional.
Section 6. Non -codification; Implementation.
(a). This Ordinance shall not be codified in the City Code of the City of Sanford
or the City's LDRs; provided, however, that the actions taken herein shall be depicted on
the zoning maps of the City of Sanford by the City Manager, or designee.
(b). The City Manager, or designee, shall implement the provisions of this
Ordinance by means of a non -statutory development agreement which shall be executed
by the Property Owner , or their successor(s) in interest within 60 days of the effective
date of this Ordinance or the subject property's zoning classification shall revert to an
un-zoned property status.
(c). The non -statutory development agreement referenced in Subsection (b).of
this Section shall be and constitute a development order and shall not create contractual
rights of the Property Owner against the City nor contractual obligations of the City to the
Property Owner and, to that end, the Property Owner shall have no contractual rights or

law including, but not limited to, the protections under the laws pertaining to sovereign
immunity.
Section 7. Effective Date.
This Ordinance shall take effect immediately upon enactment by the City
Commission.

The majority property owner of the project is Seminole Mall Realty Holding LLC. The applicant
is Javier Omana of CPH Engineers, Inc. who was responsible for completing the required CAPP
(Citizens Awareness and Participation Plan) meeting. A request to amend a portion of the Seminole
Towne Center PD Master Plan has been received.
The Affidavit of Ownership and Designation of Agent forms are attached and additional
information is available in order to ensure that all potential conflicts of interest are capable of being
discerned.
FISCAL/STAFFING STATEMENT:
The overall mall PD is an approximate +/- 214 acre project site generally located South of State
Road 46, North of State Road 417, East of Interstate Highway 4 and West of Towne Center
Boulevard with a project address of 200 Towne Center Circle. The overall PD and former
Development of Regional impact currently encompasses more parcels than those being rezoned,
but for the purposes of this statement, the intended redevelopment of the parcels in question will
create an overall redevelopment effect for the mall and will generate additional tax revenue for the
City.
No additional staffing is anticipated if the requested Planned Development rezone is approved.

BACKGROUND:
The site is approximately 108 acres of the total 214 acres and is generally located South of SR 46,
North of SR 417, East of Interstate 4 and West of Towne Center Boulevard with a project address
of 200 Towne Center Circle. The property is currently zoned PD, Planned Development and has
a future land use designation of HI, 1-4 High Intensity.
The property was rezoned to the Seminole Towne Center PD as adopted by Ordinance No. 3006
on July 9, 1990 and amended subsequently as needed to address individual elements of
development. Amendments include modification to the land boundaries and changes,
modifications, additions and deletions of allowable uses as listed on the Planned Development
Master Plan to individual parcels and sections of the PD. Additional variances were also approved
regarding signage and other area and dimensional standards including landscaping and parking.
The site is therefore subject to the zoning restrictions contained within the Seminole Towne Center
PD and associated amendments on file, however, due to the number of modifications, a complete
copy of the Planned Development Ordinance is not available.
Due to the number of changes and the incomplete nature of the files for Seminole Towne Center,
amendments to any given portion of the PD is no longer an option. The majority owner of the mall
recently changed hands and the applicant has come forward and requested to amend the PD to
allow for a change in uses, in an effort to generate interest in re -investing and redeveloping the
mall.
Pursuant Objective FLU 2.2: Implement Redevelopment and Renewal Program. The City shall
continue to implement redevelopment programs within the following target areas:
• Goldsboro area, as designated by the Choice Neighborhoods Initiative;
• Georgetown area, situated between Sanford and Mellonville Avenues and North Celery
Avenue;
• Downtown Historic Residential District;
• Waterfront/Downtown Business District;
• The US 17-92 Transportation Concurrency Exception Area (TCEA); and
• The Seminole Towne Center.
The first step in achieving both the PD Rezone and Objective FLU 2.2, the former DRI in place
over the entire 214 acre property needed to be rescinded in order to appropriately redevelop the
Seminole Towne Center to a multi -purpose mixed use development and its surrounding properties.
Therefore, on December 15, 2020, the majority owner for the Seminole Properties Development
of Regional Impact (DRI) filed an application with the City requesting to rescind the DRI pursuant
to Section 380.115(1)(b), Florida Statutes. After a full review of the request, the City confirmed
that the mitigation required for the existing development within the DRI had been met or was no
longer relevant or needed. Accordingly, on March 22, 2021, the City of Sanford City Commission
approved the Order approving the Rescission of Seminole Properties DRI Development Order.
The original DRI/PD Development Program included the following:

Now that the DRI has been rescinded, each of the properties within the Seminole Properties DRI
shall have the rights and entitlements authorized under the HI, High Intensity Future Land Use and
zoning designations assigned, including all PD Master Plans and PD Development Orders as laid
out in the applicable provisions of the City's Comprehensive Plan and Land Development
Regulations.
The owners and their representatives, of the portion of the Seminole Towne Center, has presented
the attached documents to request to establish a new PD Master Plan and Development Order to
establish new development standards and a wider variety of uses to facilitate a future mixed use
redevelopment project to revitalize the existing mall, a generally retail center.
In the recommendation section, staff has included additional standards to be adopted with the
Planned Development Master Plan to guide appropriate exterior improvements of the individual
site areas as the interiors of the buildings are modified.
LEGAL RFviFw:
The City Attorney may or may not have reviewed the staff report and the specific analysis provided
by City staff, but has noted the following that should be adhered to in all quasi-judicial decisions.
Section 166.033, Florida Statutes, as amended in the 2022 Legislative Session, in Chapter 2021 -
224, Laws of Florida (deriving from Committee Substitute for Committee Substitute for House
Bill Number 1059) provides as follows (please note emphasized text):
"166.033 Development permits and orders.—
(1) Within 30 days after receiving an application for approval of a development
permit or development order, a municipality must review the application for
completeness and issue a letter indicating that all required information is submitted
or specifying with particularity any areas that are deficient. If the application is
deficient, the applicant has 30 days to address the deficiencies by submitting the
required additional information. Within 120 days after the municipality has deemed
the application complete, or 180 days for applications that require final action
through a quasi-judicial hearing or a public hearing, the municipality must
approve, approve with conditions, or deny the application for a development
permit or development order. Both parties may agree to a reasonable request for
an extension of time, particularly in the event of a force majeure or other
extraordinary circumstance. An approval, approval with conditions, or denial of the
application for a development permit or development order must include written
findings supporting the municipality's decision. The timeframes contained in this
subsection do not apply in an area of critical state concern, as designated in s.
380.0552 or chapter 28-36, Florida Administrative Code.
(2)(a) When reviewing an application for a development permit or
development order that is certified by a professional listed in s. 403.0877, a
municipality may not request additional information from the applicant more
than three times, unless the applicant waives the limitation in writing.
(b) If a municipality makes a request for additional information and the applicant
submits the required additional information within 30 days after receiving the
request, the municipality must review the application for completeness and issue a
letter indicating that all required information has been submitted or specify with

particularity any areas that are deficient within 30 days after receiving the
additional information.
(c) If a municipality makes a second request for additional information and the
applicant submits the required additional information within 30 days after receiving
the request, the municipality must review the application for completeness and
issue a letter indicating that all required information has been submitted or specify
with particularity any areas that are deficient within 10 days after receiving the
additional information.
(d) Before a third request for additional information, the applicant must be offered
a meeting to attempt to resolve outstanding issues. If a municipality makes a third
request for additional information and the applicant submits the required additional
information within 30 days after receiving the request, the municipality must deem
the application complete within 10 days after receiving the additional information
or proceed to process the application for approval or denial unless the applicant
waived the municipality's limitation in writing as described in paragraph (a).
(e) Except as provided in subsection (5), if the applicant believes the request for
additional information is not authorized by ordinance, rule, statute, or other legal
authority, the municipality, at the applicant's request, shall proceed to process the
application for approval or denial.
(3) When a municipality denies an application for a development permit or
development order, the municipality shall give written notice to the applicant.
The notice must include a citation to the applicable portions of an ordinance,
rule, statute, or other legal authority for the denial of the permit or order.
(4) As used in this section, the terms "development permit" and "development
order" have the same meaning as in s. 163.3164, but do not include building
permits.
(5) For any development permit application filed with the municipality after July
1, 2012, a municipality may not require as a condition of processing or issuing
a development permit or development order that an applicant obtain a permit
or approval from any state or federal agency unless the agency has issued a
final agency action that denies the federal or state permit before the municipal
action on the local development permit.
(6) Issuance of a development permit or development order by a municipality
does not create any right on the part of an applicant to obtain a permit from a state
or federal agency and does not create any liability on the part of the municipality
for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill
the obligations imposed by a state or federal agency or undertakes actions that result
in a violation of state or federal law. A municipality shall attach such a disclaimer
to the issuance of development permits and shall include a permit condition that all
other applicable state or federal permits be obtained before commencement of the
development.
(7) This section does not prohibit a municipality from providing information to
an applicant regarding what other state or federal permits may apply."
The above -referenced definition of the term "development permit" is as follows:
"(16) 'Development permit' includes any building permit, zoning permit,
subdivision approval, rezoning, certification, special exception, variance, or any
other official action of local government having the effect of permitting the
development of land." (Section 163.3164(16), Florida Statutes).

The term "development order" is defined as follows and, as can be seen, refers to the "granting,
denying, or granting with conditions [of] an application":
"(15) 'Development order' means any order granting, denying, or granting with
conditions an application for a development permit." (Section 163.3164(15),
Florida Statutes).
Thus, if this application is denied, a denial development order must be issued which must cite to
the applicable portions of each ordinance, rule, statute or other legal authority supporting the denial
of the application. For example, if a goal, objective or policy of the Sanford Comprehensive Plan
were to be the basis for a denial, then such goal, objective or policy must be part of the motion
proposing the denial. A denial development order would be drafted to implement the actions of
the City Commission in the event of such occurrence. Accordingly, any motion to deny must state,
with particularity, the basis for the proposed denial.
The City Commission has also expressed its desire for all who vote against the majority decision
to express the rationale for their vote with regard to all matters.
When voting on matters such as whether to recommend approval of an amendment to the City's
Comprehensive Plan or the enactment of, or amendment to, a land development regulation, those
matters are legislative in nature and not quasi-judicial matters.
The City Commission approved the first reading of Ordinance No. 4663 on January 10, 2022.
The City Clerk published notice of the 2 nd Public Hearing in the Sanford Herald on January 16,
2022.
RECOMMENDATION:
Staff recommends the Planning and Zoning Commission recommend that the City Commission
adopt an ordinance rezoning the legally referenced parcels from the current Seminole Towne
Center PD to the Amended Towne Center PD zoning district/classification to establish updated
design standards and allowable uses for future redevelopment based on consistency with the goals,
objectives and policies of the City's Comprehensive Plan. The following conditions should be
considered to accompany any approval in the ordinance and its associated development order:
1) All development shall be consistent with the Amended Seminole Towne Center PD
Master Plan, revision dated November 2, 2021, unless otherwise specifically set
forth in any associated development order; provided, however, that all subsequent
development orders shall be consistent with the provisions of this Ordinance. The
Amended Seminole Towne Center PD Master Plan and Development Order shall
be valid for a Period of five (5) years from approval date with the opportunity to
have a five (5) year extension granted by the City Commission.
2) Unless specifically requested and approved on the referenced PD Master Plan, any
required elements missing from or not shown on the PD Master Plan shall comply
with the City's LDRs or the conditions set forth within this Development Order.
3) All new development, including any change of use within an existing building, shall
be subject to the Development Review Process and shall be subject to required site
approvals and issuance of appropriate Site Development permits.
4) New development on the subject real property shall be served by adequate parking
resources which shall include off-street parking sufficient to serve each proposed

new development either on the specific parcel or through the provision of a shared
parking agreement as approved by the City Attorney with regard to a site approved
by the Administrative Official based upon reasonable proximity and sound and
generally accepted planning and land development principals relating to pedestrian
traffic.
5) Any redesign or redevelopment of parking areas shall be subject to the requirements
of Schedule H - Parking Requirements, Schedule G — Architectural Design
Standards and Schedule J — Landscape, Buffer and Tree Requirements. ' Overall
Seminole Towne Center parking is not to fall below 4.8 spaces per 1,000 FT of
development.
6) The final design and location of any new or revised driveways and/or access points
including, but not limited to, cross access locations, shall be proposed within and
shall be subject to City approval during, the development plan review and approval
process.
7) Any modification to the central stormwater system and its associated retention areas
shall be subject to and redesigned to meet Schedule 0 - Drainage, Easements &
Site Preparation/Excavation Requirements and to modify the St. Johns River Water
Management Permit as required.
8) A decorative and functional fountain shall be installed in all wet retention ponds as
part of development approval which approval shall provide for ongoing
maintenance requirements and responsibilities upon the appropriate party, but not
the City.
9) Lighting and pedestrian amenities shall be included to improve the overall image
of the pedestrian network.
10) A comprehensive signage program meeting the standards of the City's LDRs, shall
be required for the entire development including, but not limited to, the commercial
and multiple family residential uses at said time when the overall mall signage is
amended.
11) A comprehensive landscape design, including landscape and hardscape elements
shall be provided during redevelopment and said design shall incorporate
landscape/hardscape elements to screen the parking areas and any mechanical
equipment/appurtenances from the public right of way.
12) If City staff and the property owner are unable to agree to the details of this
Development Order in any way, the matter will be submitted to the Planning and
Zoning Commission for resolution at a public hearing, and the matter will be
adjudicated by means of a development order or denial development order relating
thereto.
In agreeing to the above conditions, the property owner will agree that, in accordance with the
provisions of Section 70.45, Florida Statutes, pertaining to governmental exactions, the City has
not imposed any prohibited exaction. The term "prohibited exaction" is defined by that statue to
mean ". . . any condition imposed by a governmental entity on a property owner's proposed use
of real property that lacks an essential nexus to a legitimate public purpose and is not roughly
proportionate to the impacts of the proposed use that the governmental entity seeks to avoid,
minimize, or mitigate."
On December 2, 2021, the Planning and Zoning Commission recommended the City Commission
amend the Seminole Towne Center PD at 200 Towne Center Boulevard subject to the above noted
conditions.

I. Overview
A virtual neighborhood meeting for Seminole Towne Center took place on Wednesday,
January 6, 2021 via Zoom. A copy of the Zoom presentation is attached (Appendix A).
The meeting was required as part of the (CAPP) protocols submitted in conjunction with
the forthcoming Planned Development Amendment application. The subject site is
located at 220 Towne Center Circle, Sanford Florida. The Seminole County Property
Appraiser parcel identification number associated with the subject property is generally
29-19-30-5LW-0100-0000.

invited to the Neighborhood Meeting.

A. A Seminole County resident who identified herself as Wafa wanted to ensure that
retail was being included as a part of mixed use in the project.
• Javier Omana addressed the attendee's concerns by explaining that retail
would indeed be included in the project as a part of the vertical mixed use
development.
B. Steve Strang a Seminole County resident and property owner stated that the plan
looked good, he was glad that we were being proactive and that the different uses
don't matter to "us."

C. A Central Florida Transportation Authority (LYNX) employee by the name of Jeff
Reine was concerned about an existing Lynx bus connection/stop and wanted to know
whether or not it would remain.
• Javier Omana addressed the attendee's concern by explaining that there is no
intention to remove the bus connection.
D. Jeff Reine is also a Seminole County resident and he voiced his concern as a resident
about a wetland near the site and questioned whether it would become part of storm
water plan or if it would be developed.
• Javier addressed the attendee's concerns by informing him that an
environmental study has been conducted on the wetland. The wetland is
stressed. The action to be taken in regards to the wetland is yet to be
determined.
E. Seminole County resident Ameer Robinson wanted to know about the owner of the
development, their past and other ongoing projects, the timeline of the Seminole
Towne Center Mall project and questioned whether or not existing tenant of the mall
would have first right of refusal over incoming tenants.
Javier Omana addressed the attendee's concerns about the owner and their
past and ongoing project and also explained the timeline of the project.
• The applicant's attorney Julie Kendig Schrader addressed Mr. Robinson's
question regarding existing mall tenant/ first right of refusal. She explained
that the applicant has been communicating with other property owners and
tenants to obtain their input. She does not know if applicant is offering tenants
first right of refusal.
F. Kimberly King, an attorney representing Dillard's, inquired about whether or not a
parking study had been conducted and if it was available.
Mr. Omana explained that a parking study has not yet been conducted due to the fact
that final uses have not been determined.

The Seminole Towne Center Planned Development was originally approved on April 9, 1990 as a Development of
Regional Impact (DRI) and concurrent Planned Development (PD). Approved uses include 1,415,000 SF
commercial; 400,000 SF office; 60,000 SF office/showroom; and 400 hotel rooms.
The proposed Amendment will at a minimum:
A) Introduce new uses;
B) Introduce a land use trip matrix;
C) Allow for redevelopment of certain parcels and/or portions of the existing Towne Center structure
(Mall); and
D) Propose new parking, setbacks and other design standards
