Ordinance No. 2022-4664
An ordinance of the City Commission of the City of Sanford, Florida substantially and
comprehensively revising and amending the provisions of Schedule "B", City of
Sanford Cade/Land Development Regulations (LDRs), relating to residential uses in the
SC -3, Special Commercial, zoning district/classification; providing for a savings
provision; providing for conflicts; providing for severability; providing for an exhibit,
codification and the correction of scrivener's errors; and providing for an effective date.
Be it enacted by the People of the City of Sanford, Florida:
Section 1. Revision And Amendment of Schedule "B", City of Sanford Code/Land
Development Regulations, to residential uses in SC -3, Special Commercial, Zoning
District/Classification; Legislative Intent.
(a). Schedule "B" of the City of Sanford Cade/Land Development Regulations is
substantially revised and amended to read as set forth in the Exhibit to this Ordinance which, by this
reference thereto, is incorporated herein as if fully set forth herein verbatim.
(b). Current City land development regulations require a conditional use to be granted for
all residential requests in the SC -3, Special Commercial, Zoning District/classification. Ongoing recent
activity and growth in the downtown has led the City to reconsider this requirement for residential
opportunities on the second floors of structures and above. Projects with residential approvals in
downtown are becoming relatively common and other projects with residential on the first floor would
still require consideration of a conditional use is granted upon a determination being made if the
location is appropriate. All projects will, however, be required to meet the parking standards in place at
the time of development..
Section 2. Conflicts.
All ordinances or part of ordinances in conflict with this Ordinance are hereby repealed.
Section 3. Severability.
If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid,
unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force
or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise
determined to be invalid, unlawful, or unconstitutional.

SCHEDULE "B" — PERMITTED USES
Section 4. Savings; Effect Of Ordinance.
The prior actions of the City of Sanford in terms of the matters relating to any and all actions
and activities of the City pertaining to the City's Land Development Regulations/Land Development
Code, or of an associated nature, are hereby ratified and affirmed.
Section 5. Codification; Scrivener's Errors.
(a). The Exhibit referenced in Section 1 of this Ordinance shall be codified and all other
sections of this Ordinance shall not be codified.
(b). The sections, divisions and provisions of this Ordinance may be renumbered or re -
lettered as deemed appropriate by the Code codifier.
(c). Typographical errors and other matters of a similar nature that do not affect the intent
of this Ordinance, as determined by the City Clerk and City Attorney, may be corrected with the
endorsement of the City Manager, or designee, without the need for a public hearing.
Section 6. Effective Date.
This Ordinance shall become effective immediately upon enactment.

SYNOPSIS:

Zoning District.
Modifications to the City of Sanford Land Development Regulations (LDR) related to residential
uses in SC -3, Special Commercial Zoning District has been prepared.
FISCAL/STAFFING STATEMENT:
There is no anticipated cost to the City to implement the new regulations.
BACKGROUND:
Current regulations require a Conditional Use for all residential requests in the SC -3, Special
Commercial Zoning District. Ongoing recent activity and growth in downtown has led staff to
reconsider this requirement for residential opportunities on the 2nd floor and above. Projects with
residential approvals in downtown include:
Accessory Dwelling Unit
• 101 Park Avenue
• 200 North Park Avenue
Multi -Family 2nd Floor and Above
• San Leon
• Gateway at Riverwalk
In addition, other projects such as Heritage Park and First Street Station with residential on the
first floor would still require consideration of a Conditional Use to determine if the location is
appropriate. All projects will be required to meet the parking standards in place at the time of
development.

RECOMMENDATION:
Chapter 163.3174 of the Florida Statutes requires the local planning agency to review proposed
land development regulations and make recommendations to the City Commission as to the
consistency of the changes with the adopted comprehensive plan. Accordingly, staff recommends
that the Planning and Zoning Commission recommend the City Commission approve an ordinance
to adopt the modifications to the City of Sanford Land Development Regulations to update
Schedule B to allow residential uses on the 2nd floor and above in SC -3 as a permitted use.
Additional comments or recommendations may be presented by staff at the meeting
LEGAL REVIEW:
The Assistant City Attorney has reviewed this item and drafted the proposed Ordinance No. 4664.
The City Commission approved the first reading of Ordinance No. 4664 on January 10, 2022.
The City Clerk published notice of the 2nd Public Hearing in the Sanford Herald on January 16,
2022.
SUGGESTED MOTION:

SCHEDULE "B" — PERMITTED USES

(2) Day care is only permitted as an accessory use to a residential complex or development and is not permitted in an individual residential
unit.

(5) In addition to the parking requirements of Schedule H, the rental use shall provide parking for rental vehicles and/or equipment.

Sales, Travel Trailer Sales and Automotive Specialty Sales.

(||) If such use is in conjunction with a church and/or an elementary school, such use is allowed as a conditional use.
(12) Such use iuallowed within the corresponding zoning district/classification only after being approved as a conditional use and after
approval hythe City Commission.
(13) Such use shall hoallowed provided that such use shall not be located within uradius of\.000' vfanother existing Community
Residential Home.
(14) Such use shall be allowed provided that such use shall not be located within xradius ofl200'of another home inuMuUi-Fanlily Zone
mwithin 5NYofosingle family zone boundary.
(\j) Such use shall be allowed provided that such use shall not be located within 500'of a single family zone.
(16) Such use shall he allowed as a conditional use provided that such use shall not be located within a radius of 1200'of another residential
care facility or a community residential home in a inulti-family zone or within 500' of a single family boundary.
(17) Crematory facilities only allowed in Rl- I and MI -2 zoning district/classifications.
(18) Adult Performance Establishments shall comply with all requirements andprovisions set forth io adult entertainment regulations o[the
City Code" and all other applicable provisions ufthe City Code and State law,
(19) Communication towers up to a maximum height of 200' shall be allowed by right. Communication towers greater than 200'iuheight
shall be allowed only after being approved as a conditional use. Such use is allowed within corresponding zoning district/classification
only after being approved as a conditional use. Further, such use shall not be located within a radius Of 1,500'of another such use nor
shall such use be located within 300' of a school, church, park or residentially zoned land.
