AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING,
VACATING, AND ABANDONING THAT CERTAIN TEN (10) FOOT WIDE
NORTH-SOUTH UTILITY EASEMENT LYING BETWEEN LAKE MARY
BOULEVARD AND NORTH WAY AND BETWEEN SANFORD AVENUE AND
SR 427; PROVIDING FOR SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
WHEREAS, the owners of that certain ten (10) foot wide North-South utility
easement lying between Lake Mary Boulevard and North Way and between Sanford
Avenue and SR 427, applied to the City of Sanford, Florida, their application to have
said property closed, vacated and abandoned; and
WHEREAS, a public hearing was held on November 23, 1992, for consideration
and determinations to whether or not the closing, vacating and abandoning of that
easement should be allowed; and
WHEREAS, the City Commission has determined that the closing, vacating and
abandoning of that certain property does not conflict with the Comprehensive Plan
of the City of Sanford, Florida, and that the public health, economy, comfort,
order, convenience, and welfare will be promoted by such closing, vacating and
abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That portion of that certain 10 foot wide North-South utility
easement lying between Lake Mary Boulevard and North Way and Between Sanford
Avenue and SR 427, more particularly described as follows:
That certain 10 foot wide utility easement lying along the east property
line of Lots 7, 8 and 9 of Keyes Seminole Industrial Park Replat as
recorded in Plat Book 33, Page 40, Public Records of Seminole County,
Florida,
be and the same is hereby closed, vacated and abandoned.
SECTION 2: If any section or portion of a section of this ordinance proves to
be invalid, unlawful or unconstitutional, it shall not be held to impair the validity,
force or effect of any other section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances in conflict herewith
be and the same are hereby revoked.
SECTION 4: That this ordinance shall become effective immediately upon its
passage and adoption.
