An Ordinance of the City of Sanford, Florida amending
the City of Sanford Comprehensive Plan, as previously
amended; providing for amendment of the Future Land
Use Map of the Future Land Use Element of the City of
Sanford Comprehensive Plan relative to certain real
property, approximately 3.17 acres in size owned by the
Sanford Airport Authority (Tax Parcel Identification
Numbers 06-20-31-503-0700-0010, 06-20-31-503-0700-
0020, 06-20-31-503-0700-0030, 06-20-31-503-0700-0060,
06-20-31-503-0400-0010, 06-20-31-503-0400-0020, 06-20-
31-503-0400-0030, 06-20-31-503-0400-0040, 06-20-31-503-
0400-0060, 06-20-31-503-0400-0070 and 06-20-31-503-
0300-0010) said property being generally located north
of Wylly Avenue and east of Grandview Avenue;
providing for the future land use designation to be
amended from Low Density Residential - Single Family
(LDRSF) to Airport Industry and Commerce (AIC);
providing for legislative findings and intent; providing
for assignment of the land use designation for the
property; providing for severability; providing for
ratification of prior acts of the City; providing for
conflicts; providing for codification and directions to the
Code codifier and providing for an effective date.
Whereas, the Sanford Airport Authority (SAA) is the owner of the property
which is the subject of this Ordinance (Tax Parcel Identification Numbers 06-20-31-503-
0700-0010, 06-20-31-503-0700-0020, 06-20-31-503-0700-0030, 06-20-31-503-0700-
0060, 06-20-31-503-0400-0010, 06-20-31-503-0400-0020, 06-20-31-503-0400-0030,
06-20-31-503-0400-0040, 06-20-31-503-0400-0060, 06-20-31-503-0400-0070 and 06-
20-31-503-0300-0010 as assigned by the Seminole County Property Appraiser); and
Whereas, the subject real property totals 3.17 acres in size and is generally
located north of Wylly Avenue and east of Grandview Avenue; and
Whereas, the City is the applicant on behalf of the SAA and no Citizens
Awareness and Participation Plan (CAPP) is needed as a result of the future land use

amendment being required by the text of the City's Comprehensive Plan; and
Whereas, the subject property is located in the Airport Layout Plan (ALP)
relating to the Orlando Sanford International Airport (OSIA); and
Whereas, the City Commission has worked collaboratively with the SAA
including, but not limited to, actions taken relating to the (ALP) pertaining to the OSIA;
and
Whereas, the actions taken to change the future land use designation of the
11 parcels, as set forth in this Ordinance, is occurring pursuant to the City's
Comprehensive Plan which requires the City to assign the Airport Industry and
Commerce (AIC) future land use designation to the property as stated in Policy FLU
1.9.1.d which reads as follows:
Upon annexation of lands that are currently within the jurisdiction of
Seminole County and are included in the ALP, the lands will be
automatically given the land use designation of Airport Industry
Commerce and a zoning designation consistent with the existing zoning of
the Airport.
and
Whereas, the City's Planning and Development Services Department has
conducted a thorough review and analysis of the ALP, the demands upon public
facilities and general planning and land development issues should the subject
application be approved and has otherwise reviewed and evaluated the application to
determine whether it comports with sound and generally accepted land use planning
practices and principles as well as whether the application is consistent with the goals,
objectives and policies set forth in the City's Comprehensive Plan and determined that
the proposed amendment of the City's Comprehensive Plan relative to the subject

property as set forth in this Ordinance is internally consistent with the Comprehensive
Plan of the City of Sanford and is consistent with the controlling provisions of State law;
and
Whereas, the City of Sanford's Planning and Zoning Commission, as the
City's local planning agency, held a public hearing on March 3, 2022 to consider
amending the Future Land Use Map of the Future Land Use Element of the City of
Sanford Comprehensive Plan and recommended approval of the proposed Future Land
Use Map amendment to the Comprehensive Plan for the subject property; and
Whereas, Section 163.3187, Florida Statutes, relates to the amendment of
adopted local government comprehensive plans and sets forth certain requirements
relating to small scale amendments and which are related to proposed small scale
development activities and provides, among other things, that such amendments may
be approved without regard to statutory limits on the frequency of consideration of
amendments to the City of Sanford Comprehensive Plan; and
Whereas, the City of Sanford has complied with all requirements and
procedures of Florida law in processing this amendment to the City of Sanford
Comprehensive Plan including, but not limited to, Section 163.3187, Florida Statutes;
and
Whereas, the City of Sanford has complied with Florida's Community
Planning Act which was amended during the 2021 Legislative Session by the passage
of Committee Substitute for Committee Substitute for Committee Substitute for House
Bill Number 59 (initially codified as Chapter Number 2021-195, Laws of Florida) to
require every city and county within the State "to include in its comprehensive plan a

property rights element" (Section 163.3177(6)(i)1, Florida Statutes).
Now, therefore, be in enacted by the People of the City of Sanford, Florida:
Section 1. Legislative findings and intent.
(a). The City of Sanford has complied with all requirements and procedures of
Florida law in processing and advertising this Ordinance.
(b). The City Commission of the City of Sanford adopts the recitals (whereas
clauses) of this Ordinance as legislative findings.
(c). This Ordinance is internally consistent with the goals, objectives and
policies of the Comprehensive Plan of the City of Sanford and the proposed
Comprehensive Plan amendment does not trigger any urban indicators and adoption of
this amendment will discourage the proliferation of urban sprawl within the City of
Sanford.
Section 2. Amendment to Future Land Use Map.
(a). The Future Land Use Plan Element of the Comprehensive Plan of the City
of Sanford and the City's Future Land Use Map is hereby amended by changing the
land use designation from Low Density Residential - Single Family (LDRSF) to Airport
Industry and Commerce (AIC), with regard to the real property which is the subject of
this Ordinance as set forth herein.
(b). The property which is the subject of this Comprehensive Plan amendment
is assigned Tax Parcel Identification Numbers 06-20-31-503-0700-0010, 06-20-31-503-
0700-0020, 06-20-31-503-0700-0030, 06-20-31-503-0700-0060, 06-20-31-503-0400-
0010, 06-20-31-503-0400-0020, 06-20-31-503-0400-0030, 06-20-31-503-0400-0040,
06-20-31-503-0400-0060, 06-20-31-503-0400-0070 and 06-20-31-503-0300-0010 by

the Seminole County Property Appraiser.
Section 3. Implementing Administrative Actions. The City Manager,
or designee, is hereby authorized to implement the provisions of this Ordinance as
deemed appropriate and warranted.
Section 4. Ratification Of Prior Actions. The prior actions of the City
Commission and its agencies in enacting and causing amendments to the
Comprehensive Plan of the City of Sanford, as well as the implementation thereof, are
hereby ratified and affirmed.
Section 5. Severability. If any section, sentence, phrase, word, or
portion of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not
be held to impair the validity or effect of any other action or part of this Ordinance.
Section 6. Conflicts. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
Section 7. Codification/Instructions to Code Codifier. It is the intention of
the City Commission of the City of Sanford, Florida, and it is hereby ordained that the
provisions of this Ordinance shall become and be made a part of the codified version of
the City of Sanford Comprehensive Plan and/or the Code of Ordinances of the City of
Sanford, Florida in terms of amending the Future Land Use Map of the City.
Section 8. Effective Date. The small scale Comprehensive Plan
amendment set forth herein shall not become effective, in accordance with Section
163.3187(5)(c), Florida Statutes, until 31 days after the enactment of this Ordinance. If
challenged within 30 days after enactment, the small scale amendment set forth in this
Ordinance shall not become effective until the State land planning agency or the

Administration Commission, respectively, issues a final order determining that the
subject small scale amendment is in compliance with controlling State law; provided,
however, that this Ordinance shall not take effect until the annexation ordinance
annexing the property that is the subject of this Ordinance is final.

SYNOPSIS:
A request to amend the future land use designation assigned to 11 parcels, which total 3.17 acres,
which are located in the Airport Layout Plan (ALP) at the Orlando Sanford International Airport
(OSIA) has been initiated.
The 11 parcels are owned by the Sanford Airport Authority (SAA). The City is the applicant on
behalf of the SAA. No Citizens Awareness and Participation Plan (CAPP) is needed due to the
fixture land use amendment being required by the text of the City's Comprehensive Plan.
FISCAL/STAFFING STATEMENT:
According to the Property Appraiser's records, the I 1 parcels are designated as "Vacant Airport",
with the assessed tax values and total tax bills for 2021 shown below (the property is government
owned and, thus, tax exempt with this action resulting in no additional tax revenues):

BACKGROUND:
The 3.17 acres are generally located north of Wylly Avenue and east of Grandview Avenue. The
request to change the future land use designation of the 11 parcels is occurring pursuant to the
City's Comprehensive Plan which requires the City to assign the Airport Industry and Commerce
(AIC) future land use designation to the property as stated in Policy FLU 1.9. Ld which reads as
follows:
"Upon annexation of lands that are currently within the jurisdiction of Seminole County
and are included in the ALP, the lands will be automatically given the land use designation
of Airport Industry Commerce and a zoning designation consistent with the existing zoning
of the Airport."
City staff finds that the proposed small scale Comprehensive Plan amendment is appropriate and
suitable for the subject site and is compatible with the surrounding land uses and is internally
consistent with the goals, policies and objectives of the City's Comprehensive Plan, the JPA and
Chapter 163, Florida Statutes.
In accordance with the recommendation of staff, on March -3 ), 2022, the Planning and Zoning
Commission recommended that City Commission approve the request to amend the future land
use designation for 11 parcels totaling 3.17 acres from Low Density Residential - Single Family
(LDRSF) to Airport Industry and Commerce (AIC) as set forth in the ALP relating to the OSIA.
LEGAL REVIEW:
This matter is not a quasi-judicial matter as amendments to local government comprehensive plans
are legislative in nature. When lands are subject to a text provision (goal, objective or policy) of
the City's Comprehensive Plan or the provisions of the City/County JPA; the City is bound to
adhere to the provisions of the text of the City's Comprehensive Plan or the JPA. Also, Section
171.062, Florida Statutes, pertaining to the effects of annexations or contractions, anticipates that
cities will expeditiously incorporate annexed properties into their comprehensive plans and land
development regulations upon being located within the city limits of the annexing municipality.
Likewise, comprehensive plans must be implemented in an ongoing manner and internal
consistency must be maintained at all times. SAA legal counsel has been apprised of this matter
and invited to attend the hearings of the City.
The City Commission approved Ordinance No. 4676 of first reading on March 14, 2022.
The City Clerk published notice of the 2 "d Public Hearing in the Sanford Herald on March 16,
2022.
RECOMMENDATION:
City staff recommends that the City Commission adopt Ordinance No. 4676.
