ORDER RELATING TO NO. 21-381020 ELM AVENUE AND ISSUING
CERTIFICATE OF APPROPRIATENESS
The Historic Preservation Board (HPB) of the City of Sanford issued this
Development Order issuing a Certificate of Appropriateness relating to and touching
and concerning the following described property which is assigned Tax Parcel
Identification Number: 25-19-30-5AG-1207-0050 by the Seminole County Property
Appraiser.
FINDINGS OF FACT
Property Owner/Applicant: Sally J. Oyler
1020 Elm Avenue
Sanford, Florida 32771

Project: The construction of a wraparound front porch relative to property located
at 1020 Elm Avenue.
Requested Development Approval: The Applicant has requested the HPB to
approve the construction of a wraparound front porch relative to property located at
1020 Elm Avenue.
Additional Findings: The project is located at 1020 Elm Avenue in the City's
Residential Historic District.
The frame vernacular building located on the subject property was constructed in 1915

(as established in 1986 survey research). No photographs have been located showing
a porch on this building. However, the 1929 and 1945 Sanborn Maps depict a single -
story porch the entire face of the primary elevation. A photo from 2002 shows a front
deck and roof overhang above the door that had been removed as evidence by a
photograph taken in 2006. The applicant proposed to replace the existing front deck
with a wraparound front porch (east and north elevations) with hipped roof, wood
columns, a 42" high railing, tongue and groove decking and bead board ceiling which
generally meet the criteria of Schedule "S" of the City's Land Development Regulations
(LDRs). The proposed railings were, as noted, 42" high, but the standard height of 36"
seems better proportioned in relation to the placement of the front window and the
applicant agreed to that modification of her application and the hearing on this matter.
The porch roof will be finished with shingles to match the main roof and porch fascia
and trim will match the main roof.
CONCLUSIONS OF LAW
(a). Pursuant to Section 8.0 of Schedule "S" of the City's LDRs, the HPB has
reviewed the proposed Certificate of Appropriateness and all application documentation
and matters relating thereto in accordance with the procedures for altering historic
landmarks or structures within historic districts as set forth in Schedule "S" of the City's
LDRs.
(b). Specifically, Schedule "S" of the City's LDRs provides as follows:
(1). Porch flooring shall be wood, tongue and grove, and must match
original porch flooring in size, shape, orientation and texture.
(2). Porch flooring shall be oriented perpendicular to the

building's facade, or shall match the original orientation.
(3). New porch elements, such as, by way of example only, and
not as a limitation, balusters and columns, brackets, trim and
architectural embellishments shall be compatible with the style and
period of the building and shall be substantiated by physical and/or
pictorial evidence of the subject property.
(4). Porch additions shall have a roof type that is either similar to
the existing roof or is in character with the style and period of the
(c). To the extent that a conclusion of law as set forth herein also constitutes a
factual finding, then such shall be taken to be so as part of this Development Order.
(d). The proposed Certificate of Appropriateness is hereby found and
determined to comply with the aforestated.
(e). Additionally, the Certificate of Appropriateness sought is hereby found and
determined to be consistent with the City of Sanford Comprehensive Plan and
development of the property as proposed would be consistent with and in compliance to
applicable land development regulations and all other applicable regulations and
ordinances as set forth in the Code of Ordinances of the City of Sanford.
(f). This is a development order and shall not create contractual rights of the
property owner against the City nor contractual obligations of the City to the property
owner and, to that end, the property owner shall have no contractual rights or remedies
against the City with regard to any land use action of the City.
(g). The City has not waived any rights or remedies by taken the action set
