A CERTIFICATE OF APPROPRIATENESS
The Historic Preservation Board (HPB) of the City of Sanford issues this Development
Order relating to an application submitted for a Certificate of Appropriateness under the
provisions of Schedule "S" of the City's Land Develolmient Regulations (LDRs) relating to and
touching and concerning the following described property: 208 Sanford Avenue, which is
assigned Tax Parcel Identification Number: 25-19-30-5AG-040 1 -001 B by the Seminole County
Property Appraiser.
FINDINGS OF FACT
Property Owner: WETC Prop 2 LLC, a Florida limited liability company

Applicant: Zachary R. Miller, Manager
Miller Construction Services, LLC

Project: Approval of the HPB for alterations relative to property located at 208 Sanford Avenue.
Requested Development Approval: The Applicant requested approval for a metal awning on
the north side of the property located at 208 Sanford Avenue.
Additional Findings: The property is a non-contributing building located at 208 Sanford
Avenue in the Downtown Historic District. The building was built c.1930 and the architectural
style is masonry vernacular. The Applicant recently received approval to introduce a window
with sliding barn door -type shutter on the North wall, which is visible from the right-of-way. The

Applicant is seeking approval to add a structural metal canopy on the North wall, starting at the
building corner and extending back to cover the new window and beyond.
Schedule S, Historic Preservation, City of Sanford LDRs provides regarding commercial
building form:
(S-28) Structural canopy supports shall be symmetrical across face of fagade.
(S-28) Protection from the sun and adverse weather conditions for patrons shall be
considered for the entranceways. Overhangslawnings shall be no less than three feet (3 ) deep to
function to protect pedestrians from inclement weather.
The awning is proposed for a secondary elevation, covering the pedestrian entrance and bar
accessed from the courtyard. It does not extend the entire length of the building but terminates
at the West end of the last paired window before reaching an exterior stair. It is the same height
as the balcony and drop awning on the front facade. The proposed awning is 5 feet deep and
provides additional interest at the pedestrian level.
CONCLUSIONS OF LAW
(a). Pursuant to Section 8.0 of Schedule "S" of the City's LDRs, the HPB has
reviewed the proposed Certificate of Appropriateness and all application documentation and
matters relating thereto in accordance with the procedures for altering historic landmarks or
structures within historic districts as set forth in Schedule "S".
(b). Specifically, Schedule "S" of the City's LDRs provides as follows:
(1). New additions, exterior alterations, or related new construction shall not
destroy historic materials that characterize the property.
(2). New work shall be differentiated from the old and shall be compatible
with the massing, size, scale, and architectural features to protect the architectural integrity of the
property and its environment.
(3). Fabric awnings located on the second story and above shall match in
design, color, texture, dimensions, and other physical features.
(4). Overhangs/awnings shall be no less than three feet (3') deep to function to

protect pedestrians from inclement weather.
(5). The use of vinyl or plastic awnings is prohibited and unlawful.
(c). To the extent that a conclusion of law as set forth herein also constitutes a factual
finding, then such shall be taken to be so as part of this Development Order.
(d). The proposed Certificate of Appropriateness is hereby found and determined to
comply with the aforestated.
(e). Additionally, the proposed changes are consistent with the purpose and intent of
Schedule S and complies with the design guidelines in Schedule S.
(f). This is a Development Order and shall not create contractual rights of the property
owner against the City nor contractual obligations of the City to the property owner and, to that
end, the property owner shall have no contractual rights or remedies against the City with regard
to any land use action of the City.
(g). The City has not waived any rights or remedies by taken the action set forth herein
or any successive development orders and reserves any and all rights and remedies available to
the City under controlling law including, but not limited to, the protections under the laws
pertaining to sovereign immunity.
NOW, THEREFORE, IT IS ORDERED THAT:
(1). The HPB grants approval for the metal awning on the north side of the building at
208 Sanford Avenue per the reviewed plans submitted by Applicant based on the finding that the
proposed alterations are consistent with the purpose and intent of Schedule S.
(2) This Development Order granting approval of a Certificate of Appropriateness
touches and concerns the aforedescribed property and is subject to code enforcement action in
accordance with the controlling provisions of law.
