HISTORIC PRESERVATION BOARD OF THE CITY OF SANFORD
DEVELOPMENT ORDER NO.22-28 RELATING TO 212 W. 4TH STREET AND
DENYING
CERTIFICATE OF APPROPRIATENESS
The Historic Preservation Board (HPB) of the City of Sanford issued this Development
Order denying a Certificate of Appropriateness under the provisions of Schedule "S" of the
City's Land Development Regulations (LDRs) relating to and touching and concerning the
following described property: 212 W. 411, Street, which is assigned Tax Parcel Identification
Number: 25-19-30-5AG-0505-009A by the Seminole County Property Appraiser.
FINDINGS OF FACT

Applicant: Anthony H. Roy
Orange Avenue Enterprises LLC

Casselberry, FL 32707
Project: A request for a Certificate of Appropriateness for after the fact alterations relative to
property located at 212 W. 4th Street.
Requested Development Approval: The Applicant submitted an application requesting
approval for after the fact alterations to replace a second story window with wood siding to
match surrounding area, relative to property located at, and addressed as, 212 W. 0' Street.
Additional Findings: The project is located at 212 W. 4th Street and was built in 1900 as a
single-family home. Additions were added and the structure was converted to three (3) units.
The two story, frame vernacular building has been altered but retains some architectural integrity.

The Applicant has received approvals for siding repair, replacement of aluminum windows with
wood windows, and porch repairs, and also after the fact approval to introduce a new door with
landing and steps on the west side.
The Applicant is presently seeking after the fact approval for the elimination of a small second
story window on the east elevation and fill the gap with wood siding to match the surrounding
area. A photograph of the window opening prior to the window replacement was provided.
Schedule S, Historic Preservation, City of Sanford LDRs states:
Windows and Doors
(S-34) Only when the change is appropriate to the style and period of the building, shall windows be
relocated, enlarged, reduced or introduced.
The HPB determined that the elimination of the small second story window will significantly alter
the character of the building and is not appropriate for the style and period of the building.
CONCLUSIONS OF LAW
(1). Pursuant to Section 3.5 of the City's LDRs, it is the burden of the Applicant to
prove compliance with the City's LDR standards prior to the issuance of a development order.
the granting of a Certificate of Appropriateness.
(2). The Certificate of Appropriateness must be consistent with the goals, objectives
and policies of the City's Comprehensive Plan and the City's LDRs.
(3). The HPB has determined that the elimination of the small second story window
significantly alters the character of the building and is not appropriate for the style and period.
(3). The HPB also has determined that the proposed alterations are not consistent with
the purpose and intent of the City's LDRs, Schedule S, requirements.
NOW, THEREFORE, IT IS ORDERED THAT:
(1). As a result of the determination by the HPB that the elimination of the small
second story window significantly alters the character of the building and is not appropriate for
the style and period, and that the proposed alterations are not consistent with the purpose and
intent of the City's LDRs, Schedule S, requirements, it is hereby determined that the

aforementioned application for a Certificate of Appropriateness be, and hereby is, DENIED.
(2). This Development Order denying approval of a Certificate of Appropriateness
touches and concerns the aforedescribed property.
Done and Ordered on the date first written below.
As approved and authorized for execution by the Historic Preservation Board of the
City of Sanford at its meeting of July 27, 2022.
