Property Owner/Applicant: NVC Holdings, LLC , a Florida limited liability company. 7901 4th Street North Suite 300 St. Petersburg, Florida 33702 Allen Arthur, Allen Arthur Architect, L.L.C., of Orlando, is the architect for the project. Project: Approval of the HPB for alterations to a vacant warehouse building relative to property located at the 207 South Oak Avenue. Requested Development Approval: The Applicant requested approval of the HPB for alterations to a vacant warehouse building relative to property located at the 207 South Oak Avenue. I I P a " 0 Additional Findings: The project is located at 207 South Oak Avenue in the City's Downtown Commercial Historic District as described and depicted in Schedule "S" of the City's Land Development Regulations (LDRs). The subject lot is a corner lot. The painted masonry vernacular building was constructed as a warehouse in 1901 (as determined by the records of the Seminole County Property Appraiser). The detail of this utilitarian structure is the cornice on the elevation facing 2nd Street and the wood window and door shutters which are in poor condition. The north elevation has an attached aluminum carport which is not compatible with the character and period of the former warehouse. The applicant is seeking approvals through a separate process to establish use of the building as an event venue. The proposed scope of work includes the following: (1). Creation of a main entrance on the east facade by installing a glass storefront in the existing opening, and accenting the entrance with a porte cochere with a gable roof finished with standing seam metal, rough sawn wood columns and brick piers. (2). Installing storefronts to existing door openings to the left of the main entrance and on the south elevation, both with shed roof metal EMM (3). Installing 2 2/2 light metal windows on the south portion of the front elevation (4). Repairing and/or fabricating new non-operable wood window and door shutters to match existing (5). Replacing damaged service doors on the west and north elevations 2 1 P a g e with plain metal doors painted to match the building The integrity of the building would not be impaired by the introduction of the storefronts, which are essentially a transparent or neutral design element utilizing existing openings. The new work is differentiated from the old and can be reversed without damaging the historic materials. The proposed gable roof porte cohere and shed roof overhangs conform with the standards for building form and style compatibility, and can be removed in the future without damage to the historic materials. The proposed metal panels are a bronze color. Although this building did not previously have a traditional storefront, the proposed storefront alterations generally conform to the standards above. No existing doors or windows are proposed to be introduced, eliminated or varied in size. Most of the window openings previously were blocked in and are now covered with shutters. The 2 new windows to be installed meet the standards of Schedule "S" of the City's LDRs. The wood shutters are to be restored and/or fabricated to match existing and are fixed, non-operable. The proposed metal, secondary elevation doors meet the standards of Schedule "S" of the City's LDRs. There will be the creation of an entrance on Oak Avenue, but that entrance will not be the main entrance CONCLUSIONS OF LAW (a). Pursuant to Section 8.0 of Schedule "S" of the City's LDRs, the HPB has reviewed the proposed Certificate of Appropriateness and all application documentation and matters relating thereto in accordance with the procedures for altering historic 3 1 P a g e landmarks or structures within historic districts as set forth in Schedule "S". (b). Specifically, Schedule "S" of the City's LDRs provides as follows which includes applicable standards related to the Secretary of the United States Department of the Interior's Standards for Rehabilitation: (1). A property shall be used for its historic purpose or be placed in a new use that requires minimal change to the defining characteristics of the building and its site and environment. (2). New additions, exterior alterations, or related new construction shall not destroy historic materials that characterize the property. (3). new work shall be differentiated from the old and shall be compatible with the massing, size, scale and architectural features to protect the historic integrity of the character of the property and environment. (4). New additions and adjacent or related new construction shall be undertaken in such a manner that if removed in the future, the essential form and integrity of the historic property and its environment would be impaired. (5). Primary customer entrances shall be clearly defined and highly visible through the use of architectural detail in all structures. (6). Protection from the sun and adverse weather conditions for patrons shall be considered for the entranceways. (7). Overhangs/awnings shall be no less than 3' deep to function to protect pedestrians from inclement weather. 4 1 P a g e (8). Porch additions shall have a roof type that is either similar to the existing roof or is in character with the style and period of the (9). Metal roofs shall be standing seam, stamped metal shingle, full corrugated, 5 V crimp or must simulate the appearance of standing seam. (10). Metal roofs may be copper, galvanized, silver or gray in color, or otherwise emulate a historic patina. (11). Windows and display cases are encouraged along pedestrian corridors. (12). Clear glass, at least 88% opacity light transmission, shall be installed on the first floor. (13). Storefront windows shall be similar in placement, size and configuration to the storefront windows found on contributing buildings in the historic district. (14). Storefront frames shall be built entirely of wood, steel or aluminum. (15). The covering of storefront windows with plywood, vinyl, and/or metal adversely impacts the character and vibrancy of the commercial historic district and is prohibited. (16). Storefront windows shall be similar in placement, size and configuration to the storefront windows found on contributing windows in the historic district. 51Page (17). Storefront frames shall be built entirely of wood, steel or aluminum. The storefront side piers shall be the same material as the upper facade, or covered in stucco. (c). To the extent that a conclusion of law as set forth herein also constitutes a factual finding, then such shall be taken to be so as part of this Development Order. (d). The proposed Certificate of Appropriateness is hereby found and determined to comply with the aforestated requirements and provisions. (e). Additionally, the Certificate of Appropriateness sought is hereby found and determined to be consistent with the City of Sanford Comprehensive Plan and development of the property as proposed would be consistent with and in compliance to applicable land development regulations and all other applicable regulations and ordinances as set forth in the Code of Ordinances of the City of Sanford. (f). This is a development order and shall not create contractual rights of the property owner against the City nor contractual obligations of the City to the property owner and, to that end, the property owner shall have no contractual rights or remedies against the City with regard to any land use action of the City. (g). The City has not waived any rights or remedies by taken the action set forth herein or any successive development orders and reserves any and all rights and remedies available to the City under controlling law including, but not limited to, the protections under the laws pertaining to sovereign immunity. NOW, THEREFORE, IT IS ORDERED THAT: (1). The aforementioned application for a Certificate of Appropriateness is 6 1 P a g e GRANTED; provided, however, that any modification to the parte cochere and metal roof overhangs shall require a revision to this Certificate of Appropriateness. (2). This Development Order granting a Certificate of Appropriateness touches and concerns the aforedescribed property touches and concerns the aforedescribed property and is subject to code enforcement action in accordance with the controlling provisions of law.
