Mr. Loader called the meeting to order at 10:05 AM.

Mr. Fiorentino moved to excuse the absence of Zachary Miller and Maverick Von Herbulis. Mrs. Wilson
seconded. Motion carried, 5-0.
Minutes
Mr. Fiorentino moved to approve the minutes for the June 3, 2021 meeting. Mrs. Wilson seconded.
Motion carried, 5-0.
Regular Meeting
RM -1 Consider a Resolution pertaining to Quasi -Judicial evidence submissions.

Dominick Fiorentino moved to adopt Planning and Zoning Commission Resolution No. 2021-1.
Mrs. Wilson seconded. Motion carried, 5-0.

Hold a Public Hearing to rezone approximately 3.06 acres frorn.RMOI, Multi Family
Residential -Office -Institutional to I"D, Planned Development to establish the Vistas at Lake
Monroe PD, a proposed 100 -unit multiple family residential development with a project address
of 1100 E. I,' Street.

Citizen Participation:
- Veil Sequencias (114 N. Surnmerline Avenue): States that overall City claims that this project is
consistent; however, lie states that it is not consistent with the Comprehensive Plan, FLU, and
LDR. Moreover, states, that it is not consistent with parking, 150 vs 127 spaces,
- Jim Clark (114 Shirley Avenue): States that we bene fit the developers and not the citizen
- Debbie Vangal (239 N. Scott Avenue): States her views about on MTD (Midtown Density) and
deviation on this project.
- Mary Pen (152 Casainarina): States that this prqjcct is a setback for the city with this intense
development in the downtown district
- Ven Gerdes (1407 E. 2nd Street): States the infiltration of the sewage flow and the impact this
project will have on it. Moreover, states on the site geometry and the parking influx.
- Carin Gerdes (1407 E. 21111 Street): States when the Water analysis will be down with this project.
States about the problem the area is having with sewage.
- Teresa Clem (4011, S. Sunimer Avenue): States that she is against the project
Mrs. Wilson moved to ileny the request based on the 4111 District Court of Appeals application of
strict scrutiny when reviewing the: comprehensive plan, Mrs. Wilson then cited Polic.),, F -L U 1.1.6,
number 2, 3 as well as b, d and g..Mrs. Woodard seconded the motion to deny which passed by a
vote of 4 to 1. Mr. Dominick Fiorentino was the dissenting vote: and provided an explanation that
lie agreed with staff's recommendation and finds the request to be consistent with the City's
Comprehensive Plan.

Following the public hearing, it was noted on the record that the policy cited in the motion, Polic.),
P -L U 1.1.6, is a regulatory policy for the City to implement and revise the City's LDRs, as needed,
in order to regulate, protect and implement the Goals, Objectives and Policies in the
comprehensive plan.

After further discussion, Mv Fiorentino made a motion to rescind the previous motion to deny.
Mr� Thomas seconded, The motion to rescind Mrs. Wilson's previous motion to deny the request
passed unanimously.
Mi -s. Wilson made it, second motion to deny the request based on Goal INF I and Policy JNF 1.1.1.
Ms. Woodai°d seconded and the motion to deny passed 4 to 1. Mr. Fiorentino was the dissenting
vote, again stating he agreed with staff s recon-imendation and finds the request to be consistent
with the City's Cc niprehensive Plan. Mrs. Woodard added that her reason to recommend denial
was due to the requested deviation to the parking requirements and the request not applying strict
provision of the code for the MT overlay district/classification, The remaining members, Mr.
Derek Thomas and the Chair Mr. Mike Loader did not provide a reason for their recommendation
to deny.
PH -2 Hold a Public Hearing to consider a Comprehensive Plan Amendment to change the Future Land
Use of a 0,42 acre parcel and a portion of a 0.83 acre parcel at 600 French Avenue from 1,
Industrial to GC, General Commercial,

establish the nonconforming site at 700 Historic Goldsboro Boulevard with modified
development standards for a proposed daycare/school.
