LOWE'S DEFINED. "'It is understood that various independent and separate"corporations use this form. Therefore, within this Agreement, the term "Lowe's" shall
refer individually to one of the following corporations as evidenced on the signature page of'this Agreement: "Lowe's Home Centers, Inc." (a North Carolina corpora-
tion and wholly owned subsidiary of Lowe's Companies, Inc., a North Carolina corporation) "L'owb''s HAW; lnc:"`(a Washington corporation and wholly owned subsid-
iary of Lowe's Companies,- Inc., a North Carolina corporation) or "The Contractor Yard, Inc." (a North -Carolina corporation and wholly owned -subsidiary of Lowe's
Companies, Inc., a North Carolina corporation).
GENERAL DESCRI'PLtION, By this installed sal escontract (the'"Contract"), Customer -agrees to putchase and Lowe's agrees to sell the goods and/or materials
the "Goods") and the services to install same (the "Installation Services") in or on the above identified Premises, for the stated total cash price (the, "Price") and
according to the specifications -and other provisions of the Contract documents, including (a) this' Contract form,,(b) the Addendumrif eind'to the extent applicable, (c)
and any attached sketches, materials lists, floor plans and/or specification sheets.
INSTALLATION SERVICES. Customer authorizes Lowe's (a) to arrange for the Installation Serv'iaes'to be performed by an experienced Installer (licensed when
legally required), (b):to issue a work -order to the Installer to.perform,,the Installation, Services;(r,)-tbinspect the -Installer's work, and (d) 3o paytk6,installer, after
completion of the work and after receipt of a -certificate, signed and dated by Customer, that the-workT been satisfactorily completed (the "Certificate of Comple-
tion"). Customer understands that Lowe's will rely upon. the Certificate of bompletion,in paying the Installer for the Installation Services. ._, N
GOODS. Lowe's will arrange for delivery of the Goods to the Premises. Any surplus materials upon completion of the Installation Services shall remain - the property
of Lowe's and shall be returned to Lowe's by the Installer: - -
PRICE. The Price owed by Customer to Lowe's covers the Goods, Installation Services, applicable -taxes, and'the-cost.of purchasing any required building permit.
The Price assumes sound existing substructures; superstructure and points of attachments The price shall beincreased:by the cost -and reasonable, profit to Lowe's of
having to provide additional Goods and/or Installation Services as a result of defective substructures, superstructures, or points of attachments. PAYMENT.
Payment of the Price by Customer to Lowe's is due in full upon execution of the Contract.' WAIVER
OF LIENS FOR CONTRACTS OF $3,000 OR LESS. If this Conf r,act is fora Price`of $8 000 or Iess; Lowe_s, _on behalf of itself'rtslnstaller'and..any subcontractor(
s), hereby fully and unconditionally relinquishes, waives and -releases any and all n) chanic's-liens,-materiaiman's liens and -other liens in the Premises which
Lowe's might have or acquire, byoperation of law or otherwise, as a result of this Contract. In addition, because responsibility for paying`its Installer belongs to
Lowe's and not to Customer, Lowe's has required the Installer, on be -half of itself and any subcontractor(s), to fully and unconditionally relinquish, waive and release any
and all mechanic's liens, materialman's liens and other liens in the Premises -which the Installer or sukicontractoprniighthave or;acquire,now, or in the future, by operation
of law or otherwise, as a result of this Contract. ENTIRE
AGREEMENT. This Contract accurately states the _entire agreement between Customer and Lowe's concerning this sale of Goods and Installation Services
and replaces and supersedes all prior agreements and understandings relating thereto, both oral and written. Any additions or changes to this Contract must be
in writing signed by Customer and Lowe's.,'S MANUFACTURER
WARRANTY FOR GOODS / LOWE'S WARRANTY FOR INSTALLATION SERVICES. Customer is entitled to any warranty'provided by a manufacturer:
of_the Coods sold,under;this Contract. The Installer will provide Customer with any manufacturer consumer warranty information accompanying,the Goods,
and Customer may alsoobtain;such information by contacting Lowe's: Lowe's does not warrant the Goods. Lowe's does warrant that the Installation Services will
be performed by the Installer in.a good and "workmanlike manner." Lowe's warranty for Installation Services shall extend for a period of one year from the date the Certificate
of Completion is signed by Customer or for such greater period as may be required by applicable law governing consumer warranties for workmanship (the Warranty
Period"). Customer must give Lowe's written notice within the Warranty,Period of any warTnty claim relating to Installation Services. Customer agrees,that its
sole and exclusive remedy against Lowe's for a warranty claim is reinstallation ih,-good and•workmafiriike manner, rncluding'the repair or replacement of any Goods if
and to the extent, reasonably necessary to correct the defective Installation Services. Customer shall have no other remedy against Lowe's for a warranty claim,
including without limitation remedy for loss or damage caused by normal wear and tear;ioss or'damage which has not been ie'asoriably mitigated, loss
or damage caused by acts of God, incidental or consequential damages for lost profits,tsales, injuries to persons or property, or any other incidental or
consequential damages. Lowe'
s warranty for Installation Services shall be in lieu of any other warranty expressed or implied including without limitation any implied warranty of
merchantability or fitness for a particular purpose. In connection with any warranty claim, Customer agrees, at no cost to Lowe s 3o;prepa eahe Premises; including
the removal and replacement of fixtures incident to the repairarea,'so that`Lowes, of its de's'ignee can correct th'e defective Ihstallation Services without undue
delay. . 'A: l LICENSES.
PERMITS, SAFETY RULES, BUILDING CODES, ZONING ORDINANCES: AND OTHER LAWS. Lowe's shall_be responsible to .Customer for obtain- ing
any and all licenses and building permits which are legally required to perform the Contract. If Customer obtains permits on his own;Customer will be,precluded from
claiming against certain state guaranty funds relating to home improvements. Lowe's shall also be responsible to Customer for the Contract's being performed in
compliance with all applicable safety rules and all existing building codes, zoning ordinances and;other laws.'L6we's shale notbe--responsible for-any pr6ezisfing violations
of safety rules, building codes,, zoning ordinances or otherlaws.- if a_change occurs tgany applicable safety rule, building code, zoning ordinance or other law
which requires additional Goods and/or Installation Services to perform the Contract, Customer agrees to pay,Lovre's they -cost and reasonable, profit for such additional
Goods and Installation Services and to execute a resulting change order or new replacement Contract as requested by Lowe's CUSTOMER'
S WARRANTY AGAINST VIOLATIONS OF EASEMENTS, COVENANTS, AND THIRD P T'Y RIGHTS. Customer warrants fhat performance of this Contract
by Lowe's and its Installer will not violate any existing real property easements, covenants, or rights of third partids hdlding an inY`ere'St in the real property being

CONDITIONS IN PREMISES,;, Customer, represents, and warrants that arly defect or weakness in the Prem ises's structure, substructure, super- structure or
points of attachment that might affect performance by Lowe's or its Installer has been'specifically and fully disclosed.and described'in this Contract. If any undisclosed defect
or weakness is later discovered after performance of the Cont?3a has 66m'i `en'ced and such'defecf or ve'akness makes additional Goods and/or Installation Services
necessary, Customer agrees'to -pay Lowe's the cost and reasonable profit for such additional Goods and Installation Servicesand to execute a resulting change
order or new replacement Contract as requested by Lowe's. ARBITRATION. If
Customer has any questions or complaints regarding the Contract, Customer may contact the Lowe's Manager or Installed Sales Specialist whose names
and teidphone number appear -elsewhere on the Contract: All disputes and.cFa ins between Customer, and_Lowe's concerning this Contract which,either party believes
cannot be resolved informally, including without limitation any warranty claims, shall be resolved by binding -arbitration conducted by a single arbitrator under the
auspice's, rules and procedures: ofthe'American`Art itrationlAssociation and:in accordance-_withtap'pl cable fed'eeal arid -state "arbitration statutes' 'The arbitration shall
be held in the city or county where -the Premises are located was made or in such other convenient location_ as the parties may mutually agree. No discovery shaiLbe,
allowed except as maybe agreed to in writing by the parties. Either party maydemand arbitration,"and'the arbitrator's find award `shall be issued within ninety (
90) days- after service of the arbitration demand on the other party. REMEDY FOR
BREACH. If Customer breaches this Contract, Lowe's, or its_absigns,-shall b entitled to recover-the,greater of liquidated damage's-in'th'e arr obnt of 20%
cef the total Contract price or, such actual'damages as Lowe's, or its assignees, prove. Also, if Customer fails to pay Lowe's in accordance with this Contract; Lowe's
shall be` entitled to recover its legal costs, including reasonable attorney's fees, in connection with arbitrating, obtaining judgment on an arbitration award, or otherwise: -pursuing
Customer. forcollection. Customer agrees that Lowe's reasonable attorney's fees shall constitute 15% of the amount owed under the Contract, arbitration award
orjudgment. : UNAVOIDABLE DELAY
OR FAILURE IN PERFORMANCE EXCUSED. Any delay or failure by Lowe's or its Installer in performing this Contract because of strike, fire, flood,
acts of God, inability to obtain Goods, or any other causes beyond the reasonable control of Lowe's or its installer shall be excused and shall not be breaches of
this Contract. - MISCELLANEOUS. This
Contract shall be interpreted under and governed by the law of North Carolina. If any provision of this Contract is contrary. to. -any law to which it
is -subject, such unlawfulprovision. shall be ineffective_ without invalidating the other provisions which shall remain in full force and effect. All parties to
this Agreement acknowledge that it this Agreement is.executed :onto the extent thisQgreement.is to be performed within the states of Alaska,; Arizona, California, Colorado, Hawaii,
Idaho, Montana, Nevada, Oregon,!Utah, Washington Wyoming, it is an Agreement.exclusively with Lowe's HIW,.Inc. and no rights or remedies shall be
available from any other Lowe's entity. F If this Agreement is executed, or to the extent this Agreement is to be performed, outside of Alaska Arizona; California; Colorado, Hawaii,
Idaho, Montana, Nevada, Or'egon,' Utah;'Washington, 1Nyoming it is an Agreement with, Lotve's Home Centers, Inc. and no nghfs or remedies shall be
available from any other Lowe's entity. - The terms of
this Agreement shall inure tc the'beriefit of Lowe's Companies, Inc:, as well as its'whollyowned subsidiaries'"' It.is agreed that Lowe's (:companies, Inc. or any of

NOTICE OF ACCEPTANCE: STANDARD CONDITIONS
1. Renewal of this Acceptance (approval) shall be considered after a renewal application has been filed and the
original submitted documentation, including test supporting data, engineering documents, are no older than
eight (8) years.
2. Any and all approved products shall be permanently labeled with the manufacturer's name, city, state, and the
following statement: "Miami -Dade County Product Control Approved", or as specifically stated in the specific
conditions of this Acceptance.
3. Renewals of Acceptance will not be considered if:
a) There has been a change in the South Florida Building Code affecting the evaluation of this product and the
product is not in compliance with the code changes;
b) The product is no longer the same product (identical) as the one originally approved;
c) If the.Acceptance holder has not complied with all the requirements of this acceptance, including the
correct;; installation of the product;
d) The engineer who originally prepared, signed and sealed the required documentation initially, submitted is
no longer practicing the engineering profession.

4 Any revision or change in the materials, use, and/or manufacture of the product or process shall automaticallybecauseforterminationofthisAcceptance, unless prior written approval has been requested (through the filing
of a revision application with appropriate fee) and granted by this office.
5. Any of the following shall also be grounds for removal of this Acceptance:
a) Unsatisfactory performance of this product or process.
b) Misuse of this Acceptance as an endorsement of any product, for sales, advertising or any other
purpose.
6. The Notice of Acceptance number preceded by the words Miami -Dade County, Florida, and followed by the
expiration date may be displayed in advertising literature. If any portion of the Notice of Acceptance is
displayed, then it shall be done in its entirety.
Z. A copy of this Acceptance as well as approved drawings and other documents, where it applies, shall be
provided to the user by the manufacturer or its distributors and shall be available for inspection at the job site at
all time. The engineer need not reseal the copies.
8. Failure to comply with any section of this Acceptance shall be cause for termination and removal of

NOTICE OF ACCEPTANCE: SPECIFIC CONDITIONS
1. SCOPE
1.1 This renews the Notice of Acceptance No. 97-0204.08, which was issued on August 25`, 1997: It
approves an outswing / inswing residential insulated steel door, as described in Section 2 of this
Notice of Acceptance, designed to comply with the South Florida Building Code (SFBC), 1994
Edition for Miami -Dade County, for the locations where the pressure requirements, as determined
by SFBC Chapter 23, do not exceed the Design Pressure Rating values indicated in the approved
drawings.
2. PRODUCT DESCRIPTION
2.1 The "Entergy' Series Single Flush (Embossed) Outswing / Inswing Residential Insulated Steel
Doors — Large Missile Impact Resistant and its components shall be constructed in strict
compliance with the following documents: Drawing No 31-1015-EW, titled "Entergy Wood Edge
Steel door," Sheets 1 through 6 of 6, prepared by manufacturer, dated 2/18/97 and latest revised on
08-21-00, bearing the Miami -Dade County Product Control approval stamp with the Notice of
Acceptance number and approval date by the Miami -Dade County Product Control Division. These
documents shall hereinafter be referred to as the approved drawings.
3. LIMITATIONS
3.1 This approval applies_ to single unit applications of a single outswing / or inswing door, as shown in
approved drawings.
3.2 Refer to corresponding design pressure table, for water infiltration requirements.
4. INSTALLATION
41 The outswing / or inswing residential insulated steel door and its components shall be installed in
strict compliance with the approved drawings.
4.2 Hurricane protection system (shutters): the installation of this unit will not require a hurricane
protection system.
5. LABELING.
5.1 Each unit shall beara-permanentlabel with the manufacturer's name or logo, city, state and following
statement: "Miami, -Dade County Product Control Approved". 5.
2 The door, slab itself shall also bear a permanent label, at the door inside edge, with the manufacturer'
s name or logo, city and state. 6.
BUILDING PERMIT REQUIREMENTS 6.
1 Application for building permit shall be accompanied by copies of the following: 6.

Your application for Notice of Acceptance (NOA) of:
Entergy Series Single Flush(Embossed) Outswing/Inswing ,.Residential Insulated Steel Door -Impact
under`Chapter 8 of the Code of Miami -Dade County governing the use of Alternate Materials and Types of
Construction; and completely described herein, has been recommended for acceptance by the Miami -Dade
County Building Code Compliance Office (BCCO) under the conditions specified herein.
This NOA shall not be valid after the expiration date stated below. BCCO reserves the right to secure this
product or material at any time from a jobsite or manufacturer's plant for quality control testing. If this
product or material fails to perform in the. approved manner, BCCO may revoke, modify, or suspend the
use of such product or _material immediately. BCCO reserves the, right to revoke this approval, if it is
determined by. BCCO "that this product" or material fails to meet the requirements of the South Florida
Building Code.
The expense of such testing will be incurred,by the manufacturer.
