AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
CREATING SECTION 17-13 OF THE SANFORD CITY
CODE TO PROHIBIT LOUD, DISTURBING AND
EXCESSIVE NOISES EMANATING FROM MOTOR
VEHICLES; PROVIDING FOR PENALTIES; PROVIDING
FOR SEVERABILITY, CONFLICTS AND EFFECTIVE
DATE.
WHEREAS, the City Commission of the City of Sanford,
Florida finds that some sounds may be such that they are not
measurable, but they may be loud, disturbing, excessive,
unnatural, prolonged and unusual. Such sounds emanating from a
motor vehicle are a detriment to the health, safety and welfare
of the citizens of the City of Sanford; and,
WHEREAS, the City Commission desires to protect the
health, safety and welfare of the citizens of the City of Sanford
by prohibiting loud, disturbing and excessive noises emanating
from motor vehicles.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA:
SECTION-l: Section 17-13 of the Sanford City Code is
hereby created to read as follows:
Se'c. 17~13.
LOUD, DISTURBING ANDsEXCESSIVE-NOISE.
(a) It shall be unlawful to play, use
or operate, or permit the playing, use or
operation of any radio, tape or record,
cassette or compact disc player, amplifier,
musical instrument, or other machine or
device used for the production, reproduction
or emission of sound within a motor vehicle,
in or upon a public street, highway,
thoroughfare, park or public access area,
such as a shopping mall or parking lot, when
the sound can be heard more than fifty (50')
feet from the motor vehicle.
(b) It shall be prima facie evidence of
a violation of this section if the sound can
be heard more than fifty (50') feet from the
motor vehicle.
(c) Any person found guilty of
violating this section shall be subject to
the civil penalties provided in Section
316.655(2) of the Florida Statutes.
SECTION 2: If any section or portion of a section of
this ordinance proves to be invalid, unlawful or unconstitutional
it shall not be held to impair the validity, force or effect of
any other section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby revoked.
SECTION 4: That this ordinance shall become effective
immediately upon its passage and adoption.
