THE AIA GENERAL CONDITIONS, THE SUPPLEMENTAL GENERAL CONDITIONS AND
GENERAL REQUIREMENTS; AS AMENDED BY OWNER SHALL BE CONSIDERED AN

SUB 'CONTRACTORS AND THE GENERAL CONTRACTOR SHALL BE GOVERNED BY
ALL APPLICABLE SECTIONS OF THESE DOCUMENTS WITH REFERENCE TO THEIR
RESPECTIVE AREAS OF WORK, IT SHALL BE THE RESPONSIBILITY OF THE
GENERAL CONTRACTOR TO ADVISE HIS SUB --CONTRACTORS AND SUPPLIERS OF
THESE REQUIREMENTS.
FIELD CONDITIONS: CONTRACTOR SHALL VERIFY ALL CONDITIONS, AS WELL AS
ALL DIMENSIONS & CONDITIONS INDICATED ON THE DRAWINGS, PRIOR TO
ACTUAL CONSTRUCTION. ANY VARIATION FROM CONDITIONS INDICATED IN THE
DRAWINGS SHALL BE BROUGHT TO THE ATTENTION OF THE ARCHITECT AND
OWNER'S REPRESENTATIVE PRIOR TO COMMENCING WORK.
COORDINATION OF WORK: THE CHARACTER AND SCOPE OF THE WORK ARE
ILLUSTRATED BY THE DRAWINGS. THE CONTRACTOR SHALL EXAMINE ALL THE
DRAWINGS AND SHALL BE RESPONSIBLE FOR THE PROPER INSTALLATION OF HIS
WORK AND PROPER CONSIDERATION FOR THE WORK OF OTHERS.
BUILDING CODES & REGULATIONS: ALL WORK SHALL CONFORM TO ALL
GOVERNING CODES AND REGULATIONS. CONTRACTOR SHALL FILE, PAY FOR
AND OBTAIN ALL REQUIRED PERMITS TO PERFORM THE WORK. UPON
COMPLETION OF THE WORK, CONTRACTOR SHALL OBTAIN ALL REQUIRED
APPROVALS FROM GOVERNMENTAL AGENCIES INVOLVED PRIOR TO FINAL
PAYMENTS. APPROVALS BY LOCAL BUILDING OFFICIALS SHALL BE OBTAINED.
THE CONTRACTOR (AND ANY OF HIS SUB —CONTRACTORS AS HE DEEMS
NECESSARY) SHALL VISIT THE JOB SITE TO INSPECT AND FAMILIARIZE HIMSELF
WITH EXISTING CONDITIONS AND BUILDING STANDARDS PRIOR TO SUBMITTING
A BID PRICE OR EXECUTING THE CONSTRUCTION CONTRACT. THE OWNER SHALL
HAVE NO ADDITIONAL EXPENSES UNLESS ADDITIONAL WORK IS EXPRESSLY
REQUESTED.
VERIFY ALL DIMENSIONS, EXISTING CONDITIONS AND BUILDING STANDARDS,
EITHER SHOWN ON THE DRAWINGS, OR WHICH MAY AFFECT THE WORK SHOWN
ON THE DRAWINGS. NOTIFY THE ARCHITECT IMMEDIATELY OF ANY
DISCREPANCIES OR CONFLICTS.
UNLESS OTHERWISE NOTED, PROVIDE ALL MISCELLANEOUS FASTENERS,
HARDWARE AND ACCESSORIES AS REQUIRED FOR COMPLETE INSTALLATION,
EVEN THOUGH SUCH ITEMS MAY NOT HAVE BEEN SPECIFICALLY MENTIONED IN
THE DRAWINGS AND SPECIFICATIONS. NOTIFY THE ARCHITECT OF ANY
REVISIONS OR ADDITIONAL INFORMATION OBTAINED FROM THE
MANUFACTURER OF SPECIFIED MATERIALS OR EQUIPMENT WHICH MAY AFFECT
THE CONTRACT TIME, COST, OR QUALITY OF WORK.
PROMPTLY SUBMIT ALL SHOP DRAWINGS AND PRODUCT SUBMITTALS CALLED
FOR IN THE DRAWINGS AND SPECIFICATIONS, OR AS REQUIRED TO PROPERLY
EXECUTE THE WORK. ALLOW UP TO TWO (2) WEEKS FOR APPROVAL AND
RETURN OF SHOP DRAWINGS FROM THE ARCHITECT.
IMMEDIATELY NOTIFY THE ARCHITECT OF ANY CHANGES OR DEVIATIONS TO
THE DRAWINGS THAT ARE PROPOSED OR REQUIRED DURING BIDDING OR
CONSTRUCTION OF THE PROJECT.
MAINTAIN A SEPARATE SET OF PRINTS ON THE JOB SITE. MARK THIS SET OF
PRINTS CHANCES AND PRESENT TO THE OWNER AT THE END OF THE

JOB AS "AS BUILT" DRAWINGS OF THE WORK.
DIVISION OF WORK FOR SUB —CONTRACTORS PURPOSE SHALL BE ACCORDING TO
THE GENERAL CONTRACTOR'S DIRECTIONS.
IT SHALL BE THE RESPONSIBILITY OF ALL SUB —CONTRACTORS TO HAVE
EXAMINED AND REVIEWED THE COMPLETE SET OF DRAWINGS AND/OR
SPECIFICATIONS AND TO PROVIDE ALL LABOR AND MATERIALS FOR THEIR
RESPECTIVE AREAS OF WORK, FOR A COMPLETE AND FINISHED INSTALLATION
WHETHER INDICATED OR NOT. ALL WORK WHETHER INDICATED OR NOT SHALL
BE IN ACCORDANCE WITH ALL BUILDING CODES AND ORDINANCES WHICH ARE
APPLICABLE TO THE PROJECT.
SUB -CONTRACTORS SHALL COOPERATE WITH EACH OTHER AND WITH THE
GENERAL CONTRACTOR TO PROVIDE MATERIALS AND LABOR THAT ARE
NECESSARY IN EACH OTHERS' WORK AT THE PROPER TIMES SO THAT THE
CONSTRUCTION SCHEDULE IS NOT AFFECTED, AND INSTALLATION OF WORK IS
PERFORMED WITHOUT CREATING CONFLICTS BETWEEN THE WORK OF THE
VARIOUS TRADES. THESE INTERFACINGS SHALL BE THE RESPONSIBILITY OF THE
SUB --CONTRACTORS WHOSE WORK IS AFFECTED,

WHEN A DETAIL, DIMENSION OR REFERENCE IS INDICATED AS "TYPICAL" OR
"TYP", IT APPLIES TO ALL SIMILAR CONDITIONS, WHETHER INDICATED OR NOT,
SECTIONS OR DETAILS (UNLESS OTHERWISE NOTED) APPLY TO ALL SIMILAR
SITUATIONS. WRITTEN DIMENSIONS SHALL HAVE PRECEDENCE OVER SCALED

OWNER, KIMCO REALTY CORP. AND THEIR SUBSIDIARIES, AFFILIATES OR
ASSIGNS AND ANY PARTNERSHIP IN WHICH OWNER AND/OR KIMCO REALTY
CORP. MAY BE A PARTNER, AS DESIGNATED BY OWNER AND/OR KIMCO REALTY
CORP.
B. COMPREHENSIVE GENERAL LIABILITY, INCLUDING AUTO: MINIMUM LIMITS
FIVE MILLION DOLLARS BODILY INJURY AND $250,000 PROPERTY DAMAGE,

WRITTEN NOTICE OAT LEAST THIRTY (30) DAYS AND WAIVE ANY RIGHT OF
SUBROUTINES OF THE INSURERS AGAINST OWNER, KIMCO REALTY CORP. IF
CONTRACTOR FAILS TO CARRY ANY INSURANCE PROVIDED FOR HEREIN, OWNER
MAY, BUT SHALL NOT BE OBLIGATED TO, PROCURE THE SAME AND CHARGE THE
COST THEREOF TO THE CONTRACTOR.
HOLD HARMLESS AGREEMENT: HOLD HARMLESS AGREEMENT PERTAINS TO THE
WORK TO BE PERFORMED AT THIS PROJECT BY CONTRACTOR AND IS PART OF
THE CONTRACT WITH KIMCO REALTY CORP. (HEREIN REFERRED TO AS OWNER,
ALSO REFERRED TO AS KIMCO) FOR SAID WORK. THE CONTRACTOR WILL AND
DOES AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS THE OWNER, THE
ARCHITECT KRES MIHELICH, INC. AND ASSIGNS, OF AND FROM ALL CLAIMS, LOSS
DAMAGE, INJURY CAUSES AND ACTIONS, SUITS OF WHATSOEVER NATURE FOR
PERSONAL INJURY, INCLUDING DEATH RESULTING THEREFROM AND FOR
PROPERTY DAMAGE ALLEGED TO ARISE OUT OF, OR ANY CONDITIONS OF THE
WORK PERFORMED UNDER THIS CONTRACT, WHETHER BY HIS CONTRACTORS
