UTILITIES: Buyer aUrees to provide adequateester and
electrical services as rek--Juired for the duration of the Construction
project, including filling am operation of the pool.
5. EXCAVATION: formal excavation and dewatering of the
hole is included in the purchase price. Abnormal dewatering is
exceeding the use of two (2) h.p. pumps to control water. Rock
formations, muck, hard can conditions, subterranean water,
boulders, septic tanks, gas lines: water pipes, sewer pipes, drain:
pipes, irrigation pipes, underground electrical conduit, or other
undergroLInd obstructions are abnormal conditions. In the event
that abnormal conditions are discovered during excavation, Buyer
may elect to terminate jibs Apreement. In the event BLi}per Plects
to terminate this agreemecit, iMasterpiece shall have no further
liability to the Buyer. Miasterpiece at its option may terminate the
contract with nr) furti per iia bility to either the Buyer or Masterpiece,
except that Buyer agrees to pay Masterpiece the actual cost of
labor, materials, eouipment, permits already furnished and costs
required to restore the premises. The Buyer shall be completely
responsible for the increase in the purchase price due to
concealed conditions. Masterpiece, upon discovering such
conditions will notify the Buyer in writing of the existence of snit'
conditions and give an approximate cost to correct and proceed
with construction.
C. FINANCING- The Buyer rill be solely responsible for any
Inancing unless both parties agree other%/ise in writing.
7. "HANGE ORDERS: The Bever shall not n-iake any,
changes to the plan or specifications unless agreed to in writing by
both Buyer and iVlasterpiece. If approved, any increase in price
shall be paid to Masterpiece in full before performing any \;.lurk or
process related to the change order including purchasing of
materials, parts or egL!ipmFnt.
8. DIVING BOARDS AND SUDES: Masterpiece assumes
no liability for injury through use of diving boards siides. If
diving boards or slides are installed af--r construction, Masterpiece
assumes no liability as a result of such installation.

4.) Sidewalk repair if broken during construction.
5.) One year for substantial defects resulting from pump and
filter installation)
K/lasterpiece shall not be liable for any damages caused to the pool or
it's surrounding structures resulting from the act of any third party or b;r
failur e of th a Beyer t properly maintain the pool cr it's surroundings.
Routir:e mainter-anc items such as light bulbs, hoses, brushes, gaskets
etc. have no warran v beyond ninety days. Pool decking is not
warranted against c ack=,, checking, discoloration, Additionally, pool tiie
brick, and grout is nit warranted against cracking or color vari^tions.
Interior finish of poo is not warranted against stains, discoloratio
ch.-eking pitting, or cracking. All warranties are non -transferable
by owner. Warranties are not effective until payment is made in full.
Masterpiece snakes no warranties expressed or implied except as
provided in this con race.
10. LIMI ATEO : the following limitations apply to this contract:
1.) C'onstrL ction is complete upon filling of pool and connection
of pum and filter, not after completion of punch out list or

2.) Mastei piece is not responsible for damage to such items as
lawns, landscaping, trees, sprinkler systems, sevver lines
and a purtenances.

5.) Nio col ipletion Rate is either expressed or implied.
6.) 1V{aste piece is not responsible for improvements to
existing structures in crier to install pool.
7. j Masterpiece is not responsible for pride work that
Extends more than four feet past perimeter of deck.
11. DEFAULT OF PAYMENT: In the evesIt of payment default,
Masterpiece shall have the right to stop all tnrorK, until payment is made
or waive the default cand continue working. If the default in payment
continues for 10 days. Masterpiece may declar:, the buyer in breach of
this contract, stop all work and the buyer shall be responsible for the full
balance due on this contract. In the event suit is filed to collect any
amounts due under this contract, Buyer shall be responsible for all
attorney's fees and cost incurred by Masterpiece as well as interest
at a rate of 18% per annum from the date of default on all monies due
under the contrac.-.
12. NOTICE OF RIGHT TO RESCINID- Pursuant to section
520.72 FLORIDA STATUTES, you have the right to rescind this
contract. To rescind this .ontract you must notify in v<<riting of your
decision to rescind to Masterpiece Pool and Spa inc. by either certified
mail or registered mail on or before midnight of the third (3rl) business
day following the signing of this contract.
13. ARBITRATION: The parties hereby elect binding arbitration
as their exclusive method of resolving controversies betvv -en them
relating to this Contract. Arbitration proceedings shall be -'onductea in
accordance with the Rules of Arbitration and the procedures adopted by
the local Chapter of the National Spa and Pool Institute, which are
incorporated by reference into this Contract: provided that the Contractor
remains an FSPA rnember in good standing A copy of the current
Rules of Arbitration may be obtained from the Contractor or the
Executive Director of the local FSPA Chapter. Binding X bitration is
recognized under Florida law as a judicially enforceable means of
dispute resolution. The parties to this contract release the officers;
members, and staff of the Florida Pool and Spa Association, National
Spa and Pool institute and its Chapters, from all liabilities, claims or
demands whatsoever arising from any arbitration proceeding. This
release is given freely and voluntarily by the undersigned who are
authorized representatives of the parties to this Contract.
14. CU-NS-i 'F\:UC_r ;3' F- (CONTRAC : The terms set forth in
this contract were negotiated and mutually agreed upon between Buyer
and Masterpiece. In the event of any dispute as to the interpretation of
the contract, there shall be no presumption in favor of the Buyer; nor
contrary to Masterpiece in interpreting said contract.
15. CONSTRUCTION' LICEN LAW: According to Florida's
construction lien law (section 713.001-713.37, Florida statutes), those
who work on your property or provide materials and are not paid -in -full
have a right to enforce their claim for payment against your property.
This claim is known as a construction lien. If your contractor or
subcontractor fails to pay subcontractors, sub -subcontractors; material
suppliers, or neglects to make other legally required payments, thr
people who are owed money may look to your property for payments,
even if you !-lave paid your contractor in full. if you fail to pay your
contractor, your contractor may also have a cien on your property. it a
lien is filed, your property ,.,ould be sold against your will to pay for labor,
materials, or other services that your contractor or sub -contractor may
have failed to pay. Florida's construction lien laws are complex and it is
recommended that whenever a specific problem arises, you consult an
attorney.
