The homeowner appoints All Pro as its representative and authorizes All Pro to contact and negotiate with the Insurance company on their behalf. All Pro agrees to assist the homeowner with obtaining a fair settlement of the Insurance claim. Ifthere is a difference with the scope of work or )ob costs, All Pro may negotiate a reasonable replacement cost mutually agreed between the insurance company and All Pro. The homeowner authorizes All Pro to prosecute an action, compromise, settle, or otherwise resolve said claim exclusively with Insurance company as necessary. S. ADDITIONAL WORK OR SUPPLEMENTAL CLAIMS: All Pro reserves the right to file a supplemental claim or request with the homeownees Insurance company in the event that their estimate Is incorrect and/or additional damage is discovered after commencement. Any necessary supplemental claims that are approved and paid by the homeowner's insurance company for additional work or cost Increases will become part of this agreement and will be owed and paid to All Pro. The supplement claim payments, in addition to any depreciated amounts withheld by the Insurance company are Immediately due to All Pro upon receipt. However, any additional work that Is requested bythe homeowner that Is NOT approved by your insurance company will be the homeowner'sfinancial responsibility. Any further changes or alterations to this contract between the homeowner and All Pro must be made In writing and agreed to by both parties. 6. DIRECTION OF PAYMENT: I hereby authorize and direct you, my Insurance company, to issue payment dually and directly to All Pro Contracting Services and any applicable mortgage company, such sums as may be due and owing for all damages payable under the subject contract of insurance, with the exception of damages payable under the Contents and Additional Living Expenses applicable lines of Insurance. 7. PAYMENT SCHEDULE: Drawlf 150% is required the day the roof materials are stocked on the roof. Draw A2 50% balance Is due when the roof Is complete and has passed final inspection from the county/ city building dept. All checks are payable to ALL PRO CONTRACTING SERVICES. Any upgrades or additional work that Is requested by the homeowner, but Is not approved by the Insurance company, will be due Immediately after the work Is completed. Supplemental payments from the insurance company are due to All Pro Immediately after the work is completed. S. PAYMENT TYPE: This contract price Is based on a cash or check payment. Most credit cards are accepted forms of payment (Including Visa, MasterCard, and Discover). However, If the homeowner chooses to pay with a credit card, an additional 3% will be owed by the homeowner and added to all credit card payments in order to cover all bank merchant fees (convenience fee) for using a credit card as payment. The homeowner agrees to grant authorization to All Pro to speak with any applicable mortgage holders on matters concerning the claim, draw status, or schedule of payments. 10. INSURANCE AUTHORIZATION: The homeowner agrees to grant authorization to All Pro to speak with their insurance company regarding the scope of work, 11. PERMITS: All Pro will obtain all required permits and post at the job site. Permits must remain posted until final inspection is completed. Finalized permitswill remain with homeowner for their records. 22. ROTTEN WOOD: If wood is discovered to be rotten or deteriorated and is not covered by your insurance company, then it will be an additional cost to the homeowner. All deteriorated wood will be replace at the following price allowances: i) X' Plywood decking will be replaced at an additional charge of $65.00 per sheet of plywood installed. 2) Cedar Fascia will be replaced at $5.00 per LF. 3) 1x2 PT Furring strips will be replaced @ $1.W per LF. 4) 2x6 framing members for rafter/truss repair will be replaced at S4.00 per LF. 5) 2x4 framing members for repairs will be replaced for $3.00 per LF. 6) Cricket build and chimney flashing will be billed at $400.00 ea. as required. Any time wood rot is discovered, All Pro will alert the owners representatives & document with photos prior to replacement 13. FLASHING: If flashing is discovered to be deteriorated and must be replaced, All Pro will immediately report the condition to the homeowner and/or insurance company. If replacement of the flashing is not covered by the insurance company, then the additional cost will be paid by the holmeowner. 14. WEATHER: All Pro shall not be responsible for loss, damage, or delay caused by circumstances beyond Its reasonable control, including but not limited to any interior or exterior damages sustained due to Acts of God, such as wind events, rain, lightning, fire, or vandalism during the project and are solely the responsibility of the homeowner and their Insurance company. IS. SHINGLE & UNDERLAYMENT LAYERS: Unless otherwise noted above, this contract is based on the assumption that there is one layer of shingles and one layer of felt or other underlayment on the homeowner's roof. If additional layers are found, there will be an additional charge for the removal of each layer of shingles @ $40.00 per square and S.00 per square each layer of felt. This price includes added waste & debris removal fees. 16. ROOF ACCESSORIES: The removal and reinstallation of all solar panels and related piping on the roof will be performed by a solar panel company and be handled by the homeowner. All Pro will remove satellite dishes that are on the homeowners roof If needed, however homeowner is responsible for re -installing and calibrating satellite dish through satellite company. (" Page 2 of 4 v Initals A7- ROOF DEBRIS DISCLAIMER: All Pro acknowledges that removal of your existing roofing materials will cause debris to fall to the ground and surrounding area. All Pro will go above and beyond to magnetically sweep and hand pick the grounds surrounding the home multiple times, however there is absolutely no way to guarantee that all nails and debris will be found and picked up. All Pro will not be responsible for any debris that may cause damage or harm to Individuals at your property. PLEASE USE CAUTION IN THESE SURROUNDING AREAS FOLLOWING THE ROOF REPLACEMENT. 18. NOTICE TO HOMEOWNER: Florida Residential Building Code requires the roof deck to be re -nailed every six inches on center during all re -roof projects. If a dwelling has been re -piped and the pipes are not Installed per Florida Building -Plumbing Code, there Is a possibility of damages to the piping during the re -nailing process. It Is the sole responsibility of the homeowner to insure plumbing and HVAC lines are Installed properly before commencement of the re -roof project. All Pro is not responsible for any Interior damage from Improperly installed piping. 19. Buyers Ripht to Cancel; You have the right to rescind this agreement within 3 business days after the date you signed the work authorization agreement by notifying the contractor In writing that you are rescinding this agreement. 20. LIQUIDATED DAMAGES: If the claim Is approved by the insurance company and this agreement is cancelled by the homeowner later than (3) business days from execution, the homeowner agrees to pay All Pro twenty percent (20%) of the approved RCV estimate amount on the insurance claim as liquidated damages not as a penalty, and All Pro agrees to accept, such as reasonable and just compensation for said cancellation. This contract cannot be cancelled once work has commenced except by mutual written agreement of both parties. 21. WARRANTY: All Pro provides a Five (5) year workmanship warranty for the repairs that are listed above in this contract. This warranty covers the labor and the quality of the construction work that was performed by All Pro and does not include manufacturer's defects. The Owner's sole remedy on all material defects that are covered by a manufacturer'swarranty is strictly with the manufacturer, not with the Contractor. Failure to notify the Contractor of the need for warranty service within ten days of discovery of a warranty Item may vold warranty Item. Additionally, If the homeowner hires another Contractor to repair a warranty item, the repair amount payment will not be reimbursed by All Pro. No warranty is provided on any existing materials that are removed and/or reinstalled by All Pro within the dwelling or the property. Repair of the following Items and related damages of every kind are specifically excluded from All Pro's warranty: problems caused by lack of Owner maintenance; problems caused by Owner abuse, Owner misuse, vandalism, Owner modification, or alteration; and ordinary wear and tear. Damages resulting from mold, fungus, and other organic pathogens are excluded from this warranty unless caused by the sole and active negligence ofcontractor as a direct result of a construction defect, which caused sudden and significant amounts of water Inflltration Into a part of the structure. Deviations that arise such as the minor cracking of concrete, stucco, and plaster; minor stress fractures In drywall due to the curing of lumber; warping and deflection of wood; shrinking/cracking of grouts and caulking; fading of paints and finishes exposed to sunlight are all typical (not material) defects in construction, and are strictly excluded from Contractor's warranty. 22. MISCELLANEOUS: A. All Pro assumes no responsibility for structural Integrity of the roof deck or of the building on which the roofing is to be installed. Homeowner represents all structures to be In sound condition capable of withstanding normal roofing construction and operations. B. Homeowner Is solely responsible for providing All Pro prior to the commencing of construction with such water, electricity, or other utility as may be required by the contractor to affect the work covered by this contract, Homeowner hereby grants All Pro the right to display signs and advertising at the project site. C. Where colors are to be matched, All Pro shall make every reasonable effort using standard colors and materials, but does not guarantee a perfect match. D. This contract Is based upon the work to be performed by All Pro not Involving asbestos -containing or toxic materials and that such materials will not be encountered or disturbed during the course of performing the work. In the event that such materials are encountered, All Pro shall be entitled to reasonable compensation for all additional expenses incurred as a result of the presence of asbestos containing or toxic materials. E. Homeowner shall be entitled to order changes and the contract price shall be adjusted accordingly. Upon removal of existing roofing, conditions which require additional work, such as rotten wood, termite damage, or deficiencies in existing roofing underlayments are sometimes encountered, if the scope or work, outlined on the face of this proposal does not contemplate such conditions. All Pro will promptly report conditions to the homeowner. Unless otherwise noted In this agreement, the price quoted does not include removing and replacing fascia, trim, sheathing, rafters, structural members, siding, masonry, painting, or caulking. If during the course of the work, It should become apparent that any such portions of the structure should be repaired or replaced, the homeowner may authorize All Pro to do such additional work for an extra charge. F. Homeowner acknowledges the roofing project may cause disturbance, vibration, dust, or debris to fall into the Interior or attic. All Pro shall not be responsible for any disturbance, damage, or clean up to the interior or attic. The homeowner agrees to remove or protect property below the roof In order to minimize potential interior or exterior damage. G. All Pro Is not responsible for inadequacy of drainage or ponding on the roof. All Pro does not provide engineering, architectural, or design services. It Is the homeowner's responsibility to retain a licensed architect to determine proper design and code compliance. All Pro Is not responsible for the existing design or flashing Issues. Any change In construction or specifications necessary to conform toexisting or future building codes, zoning laws, or regulations shall be considered additional work tobe billed as an extra charge on a time and material basis. H. The homeowner acknowledges and understands while All Pro is actively completing the work under the contract, the work environment, Inducing all roof areas, is a dangerous environment. Homeowner agrees not to enter the work environment while work is being performed under the contract. I. If a dispute shall arise between All Pro and the homeowner with respect to any matters relating to this Contract or the breach thereof, such dispute, other than collection matters which may be handled through arbitration or normal collection, procedures, shall be decided by arbitration administered by and in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association and must be Initiated within the applicable statute of limitations. This agreement to arbitrate shall be specifically enforceable under the prevailing arbitration law. The award rendered by the arbitrator shall be final, and judgement may be entered upon It In any court having jurisdiction thereof. Any award shall include court costs and reasonable attorney's fees to the prevailing party plus interest. J. All overhead and profit that is paid on the claim by the homeowners' insurance company shall be paid and is owed to All Pro. 23. ACCORDING TO FLORIDA'S CONSTRUCTION LIEN LAW: Section 713.001-713.37 Florida Statutes), Those who work on your property or provide materials and services and are not paid in full have a right to enforce their dalm for payment against your property. This claim Is known as a construction lien. If your contractor or a subcontractor falls to pay subcontractors or material suppliers, those people who are owed money may look to your property for payment, even If you have already paid your contractor in full. If you fail to pay your contractor, your contractor may also have a lien on your property. This means if a lien is riled on your property could be sold against your will to payfor labor, materials, or other services that your contractor or a subcontractor may have failed to pay. To protect yourself, you should stipulate in this contract that before final payment Is made, your contractor is required to provide you with a written release of lien from any person or company that has provided toyou a'Notice to Owner'.
