Customers will be billed in writing for progress payments as each pool phase is completed, Progress payments are payments for a completed pool phase.
Progress payments are due upon receipt, and the next phase of the pool will not proceed until the progress payment is paid. Payments will be declared late
after 10 days from the Invoiced date and they shall bear Interest at the rate of 18% per annum until paid. Any additional work or extras will be thin a change
order or addendum and will be due at time of signing change order or addendum.
The contractor shall not be obligated to commence consuudion of this pool until three days allot the signing of this contract by the Owner. Since this
contract hisy be construed as a Home Solicitation Sale. Purchaseris hereby notified of this right to cancel under the Homr Solicitation Solos Act.
The contract price Is lot all materials, equipment, and Libor required for the construcion of theswimming pool graphically described in the plot plan
signed by the owner and generally described in the specifications below. Furthermore, if owner finances pool with Contractor, this agreement is subject to
the Home Improvement Installment Contract and Mortgage executed by owner(s).
4. CONSTRUCTION SPECIFICATIONS: Contractor will install a swimming pool and appurtenant structures and equipment In accordance with the plot
plan and these construction specifications. Contractor reserves the right to substitute like or similar material, equipment or fixtures. The plot plan is
intended to be a representation of the pool to be built and not intended to represent an "as built' drawing because pool location, elevation of pool, location
of decking and enclosures are subject to change due to set back requirements, location ofexisting improvements, soil conditions and other conditions
beyond the control of the contractor. All measurements in this contract and on the plot plan are approximate and the pool dimensions contained in the
contract may vary from the "as built" measurements. Deviations up to three (3) inches a(o accsplabio. Therefore, the parties agree that it Is Impossible to
ascertain actual damages in the event ofdeviation from specified pool dimensions. The parties agree to adjust the contract price of anamount calculated
by multiplying the percentage reduction of surface area limes one-half (112) of the total contract price for diminishod water surface area, and $5.00 for each
vertical inch of depth deficiency measured only at the main drain and the shallowest portion ofthe pool as liquidated damages to ownerresulting from said
variations, if any. Depth is measured from the floor of the pool to the lop of the waterline tile. Any additional soil needed for (locking or normal grading in
excess of what is dug from the pool, is at home owner's expense.
If a diving board orslide is installed, there is no liability assumed for injuries as a consequence of use or misuse ofthe diving board or slide.
If a diving board or slide is installed later, there is no liability to the poolcontractor and it shall cancel all warranties.
