HomeMy WebLinkAbout2045 ORDINANCE NO. 2045 AN ORDINAN~ OF THE CITY OF SANFORD, FLORIDA, TO AN~X WITHIN THE CORPORA~ AREA OF THE CITY OF SANFORD, FLORIDA, UPON ~OPTION OF SAID ORDINANCE, A PORTION OF THAT CERT~N PROPERTY LYING BET~EN THIRD STREET AND JE~TT LANE AND BET~EN KEN~L ROW AND ~ISCH RO~; SAID PROPERTY BEING SITUA~D IN SEMINOLE COUNTY, FLORIDA, IN ACCORDANCE WITH [E VOLU~ARY ~NEXATION PROVISIONS OF SITION 171.044, FLORIDA STATUTES; PROVIDING FOR SEVERABILITY, CONFLICTS AND [FECTIVE DA~. ~EREAS, there has been filed with the City Clerk of ~he City of Sanford, Florida, a petition containing the n~es of ~he property o~ers in the area described hereinafter requesting annexation' to the c o~orate area of the City of Sanford, Florida, O~ ~nd requesting to be included therein; and 0 ~EREAS, the Property ~praiser ~ S~inole County, Rlorida, having certified that there is one property o~er in the area to be annexed and that said property owner has signed the ~etition for Annexation; and ~EREAS, it has been determined that the property ~escribed her einafter is reasonably compa~ and con~guous to the ~orporate areas of the City of Sanford, Florida, and it has ~aurther been determined that the annexation of said p~perty will not result in the creation of any enclave; and ~ ~EREAS, the City of Sanford, Florida, is in a position ~o provide municipal services to the property described herein, ~nd that the City Commission of the City of Sanford, Florida, m it in the best interest of the City to accept said ~tition lee s n to annex said property. ~d NOW, ~EREFORE, BE IT ENACTED BY THE PEOP~ OF THE CITY SA~ORD, FLORIDA: S~TION 1: That the property described below, situated seminole County, Florida, be and the s~e is hereby annexed to ~0 ~nd made a part of the City of Sanford, Florida, pursuant to the ol a annexation provisions of Florida ~ unt ry Section 171.044, ~tatutes: Blocks 19 and 30 (Less the South 110' of East 198' of Block 30 ), M.M. Smiths Subdivision as recorded in Plat Book 1, Page 55 of the Public Records of Seminole County, Florida. SECTION 2: That upon this ordinance becoming effective, the property owner and any resident on the property described herein shall be entitled to all the rights and privileges and immunities as are from time to time granted to residents and property owners of the City of Sanford, Florida, as further provided in Chapter 171, Florida Statutes, and shall further be subject to the responsibilities of residence or ownership as may from time to time be determined by the governing authority of the City of Sanford, Florida, and the provisions of said Chapter 171, Florida Statutes. SECTION 3: If any section or portion of a section of zhis ordinance proves to be invalid, unlawful or unconstitu- tional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 4: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 5: That this ordinance shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this 14th day of August , A.D. 1989.
