AN ORDINANCE OF THE CITY OF SANFORD,
FLORIDA, AMENDING ARTICLE I. INSURANCE
COMPANIES, SECTIONS 26.1, AND 26-2, OF
THE SANFORD CITY CODE; PROVIDING FOR
SEVERABILITY, CONFLICTS AND EFFECTIVE
DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: Section 26.1, Tax on gross receipts from
premiums for firemen's relief and pension fund, of the Sanford
City Code is hereby deleted in its entirety.
SECTION 2: Section 26.1, Tax on gross receipts from
premiums for firefighters' retirement system, is hereby added to
the Sanford City Code as follows:
(a) There is hereby assessed and imposed on every
insurance company, corporation or other insurer now engaged in or
carrying on, or who shall hereafter engage in or carry on, the
business of insuring property against loss or damage by fire or
tornado, and excise or license tax amounting to 1.85 per cent of
the gross amount of receipts of premiums from the policyholders
on all premiums collected on fire and tornado insurance policies
covering property within the corporate limits of the city. Such
tax shall be in addition to all other license taxes now levied by
the city.
(b) The tax provided for in subsection (a) of this
section shall be payable and collected in the manner provided by
Florida Statutes, Section 175.01 et seq.
(c) All money derived from the tax imposed by this
section is hereby appropriated to the firefighters' retirement
system of the city which shall be administered in accordance with
the provisions of Florida Statutes, Section 175.01 et seq. (Code
1954, §§23-1--23-4; Ord. No. 968, § 1, 5-26-69)

SECTION 3: Section 26.2, Tax on gross receipts from
premiums for policemen's retirement fund, of the Sanford City
Code, is hereby deleted in its entirety.
SECTION 4: Section 26.2, Tax on gross receipts from
premiums for police officer's retirement system, is hereby added
to the Sanford City Code as follows:
(a) In addition to any other lawful license or excise
tax now levied by the city, there is hereby assessed and imposed
on every insurance company, corporation or other insurer now
engaged in or carrying on, or who shall hereafter engage in or
carry on, the business of casualty insuring as shown by the
records of the state treasurer in his capacity as state insurance
commissioner, an excise or license tax in the amount of .85 per
cent of the gross amount of receipts of premiums from
policyholders on all premiums collected on casualty insurance
policies covering property within the corporate limits of the
city.
(b) The tax provided for in subsection (a) of this
section shall be payable and collected in the manner provided by
Florida Statutes, Section 185.01 et seq.
(c) All money received from the tax imposed by this
section shall be paid immediately into the police officers
retirement system of the city. (Code 1954, §§ 23-5--23.7)
SECTION 5: If any section or portion of a section of
this ordinance proves to be invalid, unlawful or unconstitu-
tional, it shall not be held to impair the validity, force or
effect of any other section or part of this ordinance.
SECTION 6: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby revoked.

SECTION 7: That this ordinance shall become effective
immediately upon its passage and adoption.
