AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
"OPTING-OUT" OF SEMINOLE COUNTY'S
TRANSPORTATION IMPACT FEE ORDINANCE NO. 87-
04; RESTRICTING AGAINST COLLECTION OF COUNTY
TRANSPORTATION OR ROAD IMPACT FEES WITHIN THE
CITY; PROVIDING FOR, SEVERABILITY, CONFLICTS
AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Sanford,
Florida, has determined it to be in the best interest of the
citizens of the City of Sanford, Florida, that the City of
Sanford immediately "opt-out" of Seminole County's Transportation
Impact Fee Ordinance No. 87-04; and
WHEREAS, the constitutional authority of the City of
Sanford to "opt-out" of Seminole County's Transportation Impact
Fee Ordinance 87-04 is derived from Article VIII, Section l(f) of
the Florida Constitution; and
WHEREAS, Seminole County does not have authority to
unilaterally impose County impact fees within the municipal
limits of the City of Sanford, Florida.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF
THE CITY OF SANFORD, FLORIDA, AS FOLLOWS:
SECTION 1: "Opt-Out" Provision.
The City of Sanford, Florida, "opts-out" of Seminole
County's Transportation Impact Fee Ordinance No. 87-04. There
shall not be imposed or collected any County transportation or
road impact fees on any parcel of real property or any
residential or commercial building within the municipal limits of
the City of Sanford, Florida.
SECTION 2: Codification.
It is the intention of the City Commission of the City
of Sanford, Florida, and it is hereby ordained that the
provisions of this Ordinance shall become and be made a part of
the Code of Ordinances of the City of Sanford, Florida; that the
Sections of this Ordinance may be renumbered or relettered to
accomplish such intention; that the word, "Ordinance" may be

changed to "Section," "Article," or other appropriate word.
SECTION 3: Conflicts.
All Ordinances or parts of Ordinances in conflict with
any of the provisions of this Ordinance are hereby repealed.
SECTION 4: Severability.
If any Section or portion of a Section of this
Ordinance proves to be invalid, unlawful, or unconstitutional, it
shall not be held to invalidate or impair the validity, force, or
effect of any other Section or part of this Ordinance.
SECTION 5: Effective Date.
This Ordinacne shall become effective immediately upon
its passage and adoption.
