ORD~NANC~ NO. ~928
AN ORDINANCE OF THE CITY OF S~FORD, FLORIDA,
CLOSING, VACATING, AND ABANDONING A PORTION
OF THAT CERTAIN 10 FOOT NORTH/SOU~ UTILITY
EASE~NT LYING NORTH OF A~ ABUTTING
COASTLINE ROAD AND LYING BET~EN CODISCO WAY
A~ CENTR~ P~K DRIVE; PROVIDING FOR SEVERA-
BILITY, CONFLICTS A~ EFFECTI~ DATE.
~EREAS, the owners of that certain real property that
~ertain 10 foot North/South utility easement lying North of and
abutting Coastline Road and lying between Codisco Way and Central
Park Drive, applied to the City of Sanford, Florida, their
application to have said property closed, vacated and abandoned;
and
~EREAS, a public hearing was held on February 8, 1988,
for consideration and determination as to whether or not the
closing, vacating and abandoning of that easement should be
allowed; and
~EREAS, the City Co~ission has determined that the
closing, vacating and abandoning of that certain property does
not conflict with the Comprehensive Plan of the City of Sanford,
Florida, and that the public health, economy, comfort, order,
convenience, and welfare will be promoted by such closing,
vacating and abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA:
Section 1: That certain 10 foot North/South drainage
and utility easements lying North of and abutting Coastline Road
and lying between Codisco Way and Central Park Drive, more
particularly described as follows:
All of the portion of a 10 foot North/South
utility easement lying between Lots 4 and 5
of Sanford Central Park according to the Plat
recorded in Plat Book 33, Pages 64, 65 and 66
of Public Records of Seminole County,
Florida.
Such easements, by this ordinance, are declared closed, vacated,
and abandoned.
SECTION 2: If any section or portion of a section of
this ordinance proves to be invalid, unlawful or unconstitu-
tional, it shall not be held to impair the validity, force or
effect of any other section or part of this ordinance.
SECTION S: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby revoked.
SECTION 4: That this ordinance shall become effective
immediately upon its passage and adoption.
