AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING CHAPTER 2 OF THE CITY CODE BY
CREATING ARTICLE XIV TO ESTABLISH A HUMAN
RELATIONS ADVISORY BOARD, PROVIDING TERMS OF
OFFICE AND DUTIES OF THE BOARD; PROVIDING FOR
SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD,
FLORIDA THAT CHAPTER 2, ARTICLE XIV OF THE CITY CODE IS HEREBY
CREATED AS FOLLOWS:
SECTION 1. CREATED; COMPOSITION; APPOINTMENT OF
MEMBERS.
There is hereby created and constituted a Human
Relations Advisory Board for the City, which shall consist of
eleven (11) persons to be appointed and confirmed by the City
Commission.
SECTION 2. PURPOSE.
The purpose of the iiuman Relations Advisory Board is to
engender mutual understanding and respect for all citizens of
Sanford, regardless of their age, economic, social, racial,
religious, or ethnic group membership; to promote and encourage
just treatment and equal opportunity for all citizens; and to
provide a forum for discussion and resolution of those matters
which tend to cause inter-group tensions.
SECTION 3. TERMS; ORGANIZATION; OFFICERS; MEETINGS.
The members of the Human Relations Advisory Board
created by this article shall be appointed for a term of three
(3) years; initially, four (4) members of the Human Relations
Advisory Board shall be appointed for terms of one (1) year, four
(4) members of the Human Relations Advisory Board shall be
appointed for terms of two (2) years, and three (3) members of
the Human Relations Advisory Board shall be appointed for terms
of three (3) years; thereafter the terms shall be three (3)
years. The Mayor shall initially appoint the Chairman of the
Human Relations Advisory Board. Immediately upon appointment,
the members of the Human Relations Advisory Board shall meet and
organize and shall elect from their membership a Vice-Chairman
and a Secretary, whose terms of office shall be for the period of
one year or until their successors are elected by the members of
the Human Relations Advisory Board. Thereafter the Chairman,
Vice-Chairman and Secretary shall be appointed by the Human
Relations Advisory Board. The Human Relations Advisory Board
shall conduct such meetings as may be necessary to properly
perform its duties and functions and shall establish rules or
bylaws to govern the manner in which its meetings and affairs are
conducted. Meetings shall occur at least monthly, shall be held
at City Hall and shall be open to the public. Notice of meetings
shall be properly exhibited in accordance with the Sunshine Law
and minutes shall be kept at all meetings and shall be made
available to the public upon request.
Special meetings may be called by the Chairman by
providing twenty-four (24) hours' notice to the members and to
the public. Two thirds (2/3) of the membership may call special
meetings provided twenty-four (24) hour prior public notice is
given.
SECTION 4. COMPOSITION OF THE BOARD.
The City Commission shall select as members of the
Human Relations Advisory Board residents of the City of Sanford,
and whenever possible, the membership should include an attorney,
representatives from industry, commerce, law enforcement, and
persons with expertise in the field of human relations, including
but not limited to psychology, counseling and sociology. The
membership of the Human Relations Advisory Board should be
broadly representative of the several social, economic,
religious, ethnic and racial groups that comprise the population
of the City of Sanford. No employee of the City of Sanford shall
be eligible for membership on the Human Relations Advisory Board.
Members of the Human Relations Advisory Board may be
removed by majority vote of the City Commission for misfeasance,
malfeasance and/or dereliction of duty. Failure to attend two
consecutive meetings of the Human Relations Advisory Board
without prior approval of the Chairman shall constitute automatic
removal from Board membership. In the event of a vacancy on the
Human Relations Advisory Board, a successor shall be appointed by
the City Commission for the unexpired term of the removed Board
member.
SECTION 5. DUTIES; EXPENDITURES.
(a) The Human Relations Advisory Board is empowered
and directed to consider and study the entire area of human
relations in the City, and shall advise, counsel and consult with
the City Commission and the City Manager in connection with the
field of human relations within the City. The Human Relations
Advisory Board shall consider all matters submitted to it by the
City Commission or the City Manager and shall offer suggestions
and recommendations on its own initiative in regard to human
relations. It shall receive petitions and suggestions from the
citizens of the City and shall cooperate with citizens groups,
civic clubs, governmental agencies and other organizations
regarding the field of human relations and related subjects.
(b) The Human Relations Advisory Board shall provide a
service to the citizens of Sanford and the City Commission by
promoting cooperation and understanding among all members of the
Sanford community. The Human Relations Advisory Board shall
analyze the problems and/or needs of the community and recommend
appropriate action to the City Commission. It shall channel
citizens' complaints, suggestions or requests to the proper
authorities and shall respond to citizens' grievances,
suggestions or requests by conducting forums to be participated
in by representatives from the City and other agencies and
organizations.
(c) The members of the Human Relations Advisory Board
shall receive no compensation and may expend only such sums as
may be authorized and appropriated by the City Commission.
(d) The Human Relations Advisory Board shall recommend
to the'City Commission such overall policies and actions as seem
warranted, but shall not become involved with the day-to-day
affairs of normal City functions.
SECTION 6: If any section or portion of a section of
this ordinance proves to be invalid, unlawful or unconstitu-
tional, it shall not be held to impair the validity, force or
effect of any other section or part of this ordinance.
SECTION 7: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby revoked.
SECTION 8: That this ordinance shall become effective
immediately upon its passage and adoption.
