Ordinance No. 1763
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
CLOSING, VACATING AND ABANDONING A PORTION OF
RAND AVENUE (RAND'S MALL) LYING BETWEEN EAST
FIRST STREET AND EAST COMMERCIAL STREET AND
BETWEEN NORTH PARK AVENUE AND NORTH PALMETTO
AVENUE, RETAINING EASEMENTS FOR PUBLIC
UTILITIES AND PEDESTRIAN TRAFFIC, PROVIDING
FOR SEVERABILITY , CONFLICTS AND EFFECTIVE
DATE.
WHEREAS, the owner of that certain real property
abutting a portion of Rand Avenue (Rand's Mall) lying between
East First Street and East Commercial Street and between North
Park Avenue and North Palmetto Avenue, applied to the City of
Sanford, Florida, his application to have said right-of-way
WHEREAS, a public hearing was held on May 28, 1985, for
consideration and determination as to whether or not the closing,
vacating and abandoning of that certain portion should be
allowed; and
WHEREAS, the City Commission has determined that the
closing, vacating and abandoning of said air rights does not
conflict with the Comprehensive Plan of the City of Sanford,
Florida, and that the public health, economy, order, convenience
and welfare will be promoted by such closing, vacating and
abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA;
SECTION 1: That a portion of Rand Avenue (Rand's Mall)
lying between East First Street and East Commercial Street and
between North Park Avenue and North Palmetto Avenue, more
particularly described as follows:
That portion of Rand Avenue (Rand's Mall)
lying East of and abutting Lot 6, Block 2,
Tier 3, E. R Trafford's Map of the Town of
Sanford, Plat Book 1, Page 58, and between
the North Right-of-Way line of East First
Street and the South Right-of-Way line of
that certain East-West alley lying between
North Park Avenue and North Palmetto Avenue,
Public Records of Seminole County, Florida;
be and the same is hereby closed, vacated and abandoned,
providing, however, that the City hereby retains an easement for
public utilities and pedestrian traffic.
SECTION 2: If any section or portion of a section of
this ordinance proves to be invalid, unlawful, or
unconstitutional, it shall not be held to invalidate or impair
the validity, force or effect of any other section or part of
this ordinance.
SECTION 3: That all ordinances or parts of ordinances
in conflict herewith, be and the same are hereby repealed.
SECTION 4: That this ordinance shall become effective
immediately upon its passage and adoption.

the City Hall in the City of Sanford, Florida, on the 26th
day of June, 1985.
