ORDINANCE NO 1733 -
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, .,_
CLOSING, VACATING, AND ABANDONING A PORTION
OF WEST FOURTH STREET LYING BETWEEN
POMEGRANITE AVENUE AND THE EAST RIGHT-OF-WAY
LINE OF JESSAMINE AVENUE,~RESERVING A UTILITYEASE-
MENT;PROVIDINGFOR SE~ERABILITY, CONFLICTS AND~'ECTIVE
WHEREAS, the owner of that certain real property
abutting a portion of West Fourth Street lying between
Pomegranite Avenue and the East Right-of-Way line of Jessamine
Avenue, applied to the City of Sanford, Florida, their
application to have said property closed, vacated, and
abandoned; and
WHEREAS, a public hearing was held on December 10, 1984,
for consideration and determination as to whether or not the
closing, vacating and abandoning of that certain portion
should be allowed; and
WHEREAS, the City Commission has determined that the
closing, vacating, and abandoning of that certain property
does not conflict with the Comprehensive Plan of the City of
Sanford, Florida, and that the public health, economy, comfort,
order, convenience and welfare will be promoted by such
closing, vacating, and abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE
CITY OF SANFORD, FLORIDA:
SECTION 1: That a portion of West Fourth Street lying
between Pomegranite Avenue and the East Right-of-Way line of
Jessamine Avenue, further described as:
That portion of West Fourth Street lying
between the East Right-of-Way line of
Pomegranite and the East Right-of-Way
line of Jessamine Avenue, less the Westerly
127.5 feet thereof, Florida Land
Colonization Company Limited Map of The
St. Gertrude Addition to the Town of
Sanford, Plat Book 1, Page 116, Public
Records of Seminole County, Florida.

Sanford, Florida, providing however that the City hereby
reserves a utility easement over said property.
SECTION 2: If any section or portion of a section of
this ordinance proves to be invalid, unlawful, or unconstitutional,
it shall not be held to invalidate or impair the validity,
force or effect of any other section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances
in conflict herewith, be and the same are hereby revoked.
SECTION 4,: That this ordinance shall become effective

ford, Florida, do hereby certify that a true and correct
copy of the foregoing Ordinance No. 1733, PASSED and ADOPTED
by the City Commission of the City of Sanford, Florida, on
the 14th day of January, 1985, was POSTED at the front door
of the City Hall in the City of Sanford, Florida, on the
15th day of January, 1985.
