AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING
SECTION 11-30 (b) OF THE CITY CODE TO PERMIT AUTOMOBILE
SALVAGE YARDS AS A CONDITIONAL USE IN AN AREA ZONED
MI-2; AM]ENDING ORDINANCE NO. 1097 (ZONING ORDINANCE)
ARTICLE V, SECTION 12, PARA. B TO AND ITEM 6 PERMITTING
AUTOMJBILE SALVAGE YARDS AS A CONDITIONAL USE IN AN AREA
ZONED MI-2 AND PROVIDING REGULATIONS. CONCERNING LOCATION,
ENCLOSURE, LANDSCAPING, BURNING AND PARKING REQUIREMENTS;
PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, application was made to the Planning and Zoning
Commission to locate an automobile salvage yard in an area zoned
MI-2 within the City, and
WHEREAS, the Planning and Zoning Commission in a regularly
scheduled public meeting held on November 17, 1983, voted to authorize
the use, and
WHEREAS, the City Commission of the City of Sanford, Florida,
heard the matter and after discussion in a regularly scheduled public
meeting held on January 9, 1984, voted to authorize amendments to
the City Code which would permit automobile salvage yards as a conditional
use in an area zoned MI-2 provided certain regulations are complied
with.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA:
SECTION 1: That Section ll-30(b) providing for the keeping
of junk cars, parts and debris in commercial areas, be and the same
is hereby amended to read as follows:
(b) The keeping of junk cars, parts and debris in commercial
areas is prohibited, except as a conditional use in an area zoned
MI-2.
SECTION 2: Ordinance No. 1097 (Zoning Ord.) Article V,
Section 12, Para. B, is hereby amended by adding Item 6 as follows:
(6) Automobile salvage yards subject to the following
regulations:
a. Location only within a medium industrial district (MI-2)
as a conditional use.
b- Not to be located closer than one thousand (1,000)
feet to any secondary, primary, or interstate highway,
except as follows:
io Junkyards which are screened by natural objects,
plantings, fences or other appropriate means so as
not to be visible from the main traveled way of the
highway or otherwise removed from sight.
2. Junkyards 8r scrap metal processing facilities
which are located in areas which are zoned for
industrial use.
3. Junkyards or scrap metal processing facilities
which are not visible from the main, traveled way
of any interstate, primary highway, or secondary
highway.
c. Completely enclosed within a building or open storage
enclosed by a seven foot high suitablemasonry and/or
wood site proof fence sothat no open storag~ and/or
processing activities shall be visible ~from any public
street or any point on the abutting property line.
d. The enclosure wall shall be maintained in goDd order
and repair and no advertisements or signs shall be
allowed on said wall.
e. Any side of the wall abutting the public street or
highway shall be landscaped and maintained a~all times.
f. There shall be no burning activities within ~he salvage/
junkyard site.
g. Adequate paved parking shall be provided and maintained
as required by the municipal off-street parking
requirements.
h. The definition of salvaga/junkyard shall be as set forth
in F.S. 339.241(2) (a) and (b).
i. No salvage yard perimeter fence shall be located closer
than one hundred (100) feet to the property line of
any residentially zoned area.
SECTION 3: If any section or portion of a section of this
ordinance proves to be invalid, unlawful, or unconstitutional, it shall
not be held to invalidate or impair the validity, force or effect of
any other section or part of this ordinance.
SECTION 4: That all ordinances or parts of ordinances in
conflict herewith, be and the same are hereby repealed.
SECTION 5: This ordinance shall become effective immediately
upon its passage and adoption.
