ORDINANCE NO. 1671 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, VACATING AND ABANDONING EASEMENTS AND A PORTION OF MAPLE CONCOURSE, ALL LYING BETWEEN 17 & 92 (SEMINOLE BOULEVARD) AND FULTON STREET AND BETWEEN POPLAR AVENUE EXTENDED NORTHERLY AND FRENCH AVENUE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the owners of that certain real property lying between 17 ~& 92 (Seminole Boulevard) and Fulton Street and between Poplar Avenue extended Northerly and French Avenue, applied to the City of Sanford, Florida, their application to have said property vacated and abandoned; and WHEREAS, a public hearing was held on November 28, 1983, for consideration and determination as to whether or not the vacating and abandoning of that certain portion should be allowed; and WHEREAS, the City Commission has determined that the vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience and welfare will be promoted by such vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That a portion of Maple Concourse, lying between 17 & 92 (Seminole Boulevard) and Fulton Street and between Poplar Avenue extended Northerly and French Avenue, further described as: All of the remaining portion of Maple Concourse that was not vacated and abandoned pursuant to City of Sanford, Florida Ordinance No. 1124, adopted April 23, 1973, and said abandonment as recorded in Official Records Book 977, Page 418, Official Records of Seminole County, Florida, extending in a Northerly direction from the intersection of Maple Concourse and Fulton Streeet, as shown in the plats of LAKE MONROE INDUSTRIAL PARK, Plat Book 14, Page 29, Public Records of Seminole County, Florida, and LAKE MONROE INDUSTRIAL PARK AMENDED REPLAT, as recorded in Plat Book 14, Page 78, Public Records of Seminole County, Florida. is hereby vacated and abandoned in the City of Sanford, Florida. SECTION 2: That 14 foot utility easement described as follows: That 14 foot utility easement lying between Lot 8, LAKE MONROE INDUSTRIAL PARK AMENDED REPLAT, Plat Book 14, Page 78, and Lots 7, i0 and ii, of LAKE MONROE INDUSTRIAL PARK, Plat Book 14, Page 29, Public Records of Seminole County, Florida. Said utility easement extending from the intersection of said easement and Fulton Street and running continuously Northerly to its termination point at the Northwesterly corner of Lot 6, LAKE MONROE INDUSTRIAL PARK, per Official Records Book 14, Page 29, Public Records of Seminole County, Florida. is hereby vacated and abandoned in the City of Sanford, Florida. SECTION 3: That 14 foot utility casement described as follows: That 14 foot utility easement lying between Lot 7, LAKE MONROE INDUSTRIAL PARK, Plat Book 14, Page 29, and Lot 8~ LAKE MONROE INDUSTRIAL PARK AMENDED REPLAT, Plat Book 14, Page 78, extending from the Northwesterly corner of said Lot 8 and running East to termination point at the Northeasterly corner of said Lot 8 and the Southeasterly corner of said Lot 7. is hereby vacated and abandoned in the City of Sanford, Florida. SECTION 4: If any section or portion of a section of this ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or part of this ordinance. SECTION 5: That all ordinances or parts of ordinances in conflict herewith, be and the same are hereby repealed.
