AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA AMENDING
SECTION 3-23 OF THE SANFORD CITY CODE; SAID SECTION
RELATING TO POSSESSION OR CONSLrMPTION OF ALCOHOLIC
BEVERAGES IN PUBLIC PLACE~ PROVIDING FOR SEVERABILITY,
CONFLICTS AND EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA:
SECTION 1: That Section 3-23 of the Sanford City Code relating
to possession or consumption of alcoholic beverages in public places, side-
walk or street, be and the same is hereby amended to read as follows:
(a) It is unlawful for any person to purchase, use, offer
for sale, possess, consume or carry in any cup, glass,
can or other open or unsealed container, any alcoholic
beverage on the city streets, sidewalks or alleys, or
other public property owned or controlled by the City
of Sanford.
(b) It shall be unlawful for any person to consume in the
city any alcoholic beverage while on or in any public
place, sidewalk or street as heroinafter defined, except
on occasions when the consumption of alcoholic beverages
is authorized by permit of the city commission.
(c) The term "public place" shall mean any place to which
the general public is invited or has the right to resort,
including parks, streets, sidewalks, cemeteries, beaches,
lakes and school yards, or open spaces adjacent thereto.
(d) The word "sidewalk" shall mean any portion of a street
between the curbline and the adjacent property line
intended for the use of pedestrians, excluding parkways.
(e) The word "street" shall be construed to embrace streets,
avenues, boulevards, roads, alleys, lanes, viaducts and
all other public highways in the city. (0rd. No. 1608,

(f) Any person who shall violate any of the provisions of
this chapter shall be punishable as provided by section
1-8 of the City Code.
SECTION 2: If any section or portion of a section of this Ordinance
proves to be invalid, unlawful, or unconstitutional, it shall not be held to
invalidate or impair the validity, force or effect of any other section'or '
pa~t of-thisordinance.
SECTION 3: That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby reprealed.
SECTION 4: This ordinance shall become effective immediately upon
its passage and adoption.
