AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, TO
ANNEX WITHIN THE CORPORATE AREA OF THE CITY OF
S~NFORD, FLORIDA, UPON ADOPTION OF SAID ORDINANCE,
A PORTION OF THE PROPERTY LYING BEI~:~:~ FIFTH
VARD AND JERRY AVENUE; SAID PROPERTY BEING SITURI~D
IN SEMINOLE COUNTY, FLORIDA, IN ACCORDANCE WITH THE
VOLUNTARY ANNEXATION PROVISIONS OF SECTION 171.044,
FLOPJDA STATUTES: PROVIDING FOR SEVF~RABILITY, CON-
FLICTS, AND E~'ECTIVE DATE.
~,~tEREAS ~ there has been filed with the City Clerk of the City of
Sanfcrd, Florida, petitions containing the names of the property owners in
the area described hereinafter requesting annexation to the corporate area
of the City of Sanford, Florida, and requesting to be included therein; and
~HEREAS~ the Property Appraiser of Seminole County, Florida, having
certified that there are two c~ners in the area to be annexed, and that said
property owners have signed the Petition for Annexation; and
~EREAS, it has been determined that the property described herein-
after is reasonably cc~pact and contiguous to the corporate areas of the City
of Sanford, Florida, and it has further been determined that the annexation
of said property will not result in the creation of an anclave; and
WHEREAS, the City of Senford, Florida, is in a position to provide
municipal services to the property described herein, and the City Conmission
of the City of Sanford, Florida, deems it in the best interest of the City
to accept said petition and to annex said property.
NOW, THEPdEFORE, BE IT ENACIED BY THE PEOPLE OF THE CITY OF SANFOPD,
FLORIDA:
SECTION 1: That the property described below situated in Sen~inole
County, Florida, be and the same is hereby annexed to and made a part of the
City of Sanford, Florida, pursuant to the voluntary annexation provisions of
Section 171.044, Florida Statutes:
SW ~ of Blk 70 M.M. Smith's Subdivision,
Plat Book 1 Page 55, Public Records of
Seminole County, Florida.
SECTION 2: That upon this Ordinance becoming effective, the
property owners and any resident on the property described herein shall
be entitled to all the rights and privileges and intounities as are frc~. time
to time granted to residents and property owners of the City of Sanford,
Florida, and as are further provided in Chapter 171, Florida Statutes, ana
shall further be subject to the responsibilities of residence or ownership
as may frcm time to time be determined by the governing authority of the City
of Sanford, Florida, and the provisions of said Chapter 171, Florida Statutes.
SECTION 3: If any section or portion of a section of this Ordinance
proves to be invalid, unlawful or unconstitutional, it shall not be held to
invalidate or inlDair the validity, force or effect of any othelr section or"
'part of ~this ordinance.
SECTION 4: That all Ordinances or parts of Ordinances in conflict
herewith, be and the same are hereby repealed.
SECTION 5: That this Ordinance shall become effective immediately
upon its passage and adoption.
