Acceptance of permit is verification that I will notify the owner of the property of the requirements of Florida Lien Law, FS 713.
The City of Sanford requires payment of a plan review fee at the time of permit submittal. A copy of the executed contract is required
in order to calculate a plan review charge and will be considered the estimated construction value of the job at the time of submittal.
The actual construction value will be figured based on the current ICC Valuation Table in effect at the time the permit is issued, in
accordance with local ordinance. Should calculated charges figured off the executed contract exceed the actual construction value,
credit will be applied to your permit fees when the permit is issued.

The existing windows are aluminum frame (proposed windows will be vinyl frame energy effiecient).
Design style of proposed 19 windows are 11 double hung and 8 2 panel sliders (same as what is existing).
Existing siding on the home is clapborad wood 5" laps. (proposed replacement is 5" lap vinyl siding same look as existing
wood clap on home).

We are reviewing the permit package submitted to replace 19 windows and siding. Based on the information provided it
appears that the request is required to be presented for review and approval by the Historic Preservation Board
HPB). Before making this determination, further information is necessary. Please provide answers to the following
questions so that we can continue to assess the package.
The replacement spec sheets show vinyl windows, but the house appears to have aluminum currently per existing window
survey.
What is the material of the current windows on the house?
What is the material of the proposed replacement windows.
Are the design of the windows (sliding, double hung, etc.) proposed to be the same design and in the same
location with no change in size?
The replacement siding information is also unclear.
What is the current material and style of siding on the house and what is the proposed replacement (Dutch lap or
clap board)?
Upon receipt of this information, a meeting date before the HPB will be determined. If you have any questions, please let
me know.

FINDINGS OF FACT

The applicant has requested Board approval to

relative to property located at 400 Myrtle Avenue.
Additional Findings: The project is located at 400 Myrtle Avenue in the Old
Sanford Residential Historic District. The property is located at the southwest corner of
Myrtle Avenue and West 4th Street. The current zoning is SR-1, Single Family
Residential, with a future land use designation of LDR-SF, Low Density Residential
Single Family. The existing land use is single family residential. The applicant has
requested approval to remove and replace:
1). 19 windows .(size for size), and
2). the existing siding.
The applicant proposal was to remove and replace 19 windows size for size and the
existing siding. The single family structure located on the property, which was
constructed in 1990, is a non-contributing structure with 19 existing windows. The
applicant has proposed to remove and replace the existing windows with 11 double
hung windows and 8 two panel sliders, the same as the existing in size (dimensions)
and shape. The replacement windows are proposed to be energy efficient extruded vinyl
frame. The applicant has also proposed to replace the deteriorated 7" clapboard wood
laps on the structure with 7" lap vinyl siding with the same look as the wood clap
currently on the structure, but modified her application, ore tenus, at the hearing before
the Board after it being discussed that Schedule "S" of the City's Land Development
Regulations, as set forth in the Code of Ordinances of the City of Sanford, requires fiber
cement siding.
CONCLUSIONS OF LAW
a). Pursuant to Section 8.0 of Schedule "S" of the City's Land Development
is
Regulations as set forth in the Code of Ordinances of the City of Sanford, the Historic
Preservation Board has reviewed the proposed Certificate of Appropriateness and all
matters relating thereto in accordance with the procedures for constructing structures
within historic districts as set forth in Schedule "S".
b). The proposed construction is consistent with the purpose and intent of
Schedule "S" and comply with the design guidelines in Schedule "S" and is in character
with the surrounding Historic District, the required architectural standards, and will not
adversely impact the Historic District. Specifically, Schedule "S" states that:
1). If windows or window details are determined to be irreparable, they may
be replaced provided that on the primary facades of contributing buildings, replacement
windows shall match the existing original windows in size, configuration, material,
design and placement. A window survey and specifications for each window must be
submitted with the Certificate of Appropriateness application. On secondary facades,
replacement: windows may of a different design or type provided the windows are
consistent with the style of the building. Typically aluminum windows are not repaired,
but are replaced. The applicant has submitted a generalized window survey with the
request. Other than the material change request, the applicant has proposed a "size for
size" replacement of the windows. Vinyl windows, as proposed, were available at the
time of construction.
2). The total glazing area on any facade shall not exceed 30% of the fagade
surface. The total glazing area on the fagade does not exceed 30% of the total fagade
surface.

3). Windows on new houses shall have definition and a profile. Windows with
flat profiles are prohibited. The applicant has submitted to replace the existing non -
profile windows with new non -profile windows. They are in character with the structure
and are consistent with what is currently on the structure.
4). Windows and doors shall be glazed in clear glass with no more than 10%
daylight reduction. The use of reflective glass and reflective film is prohibited on all
buildings. The specification sheets provided by the applicant do not reference any
daylight reduction.
5). Windows shall be proportioned such that the height shall be equal to or
greater than the width, with the exception of historically appropriate window groupings.
The double hung replacement windows proposed are taller than they are wide while the
slider windows are wider than they are tall.
6). Rectangular windows shall be casement and single or double hung;
circular and hexagonal windows may be fixed or pivot. The replacement windows are
not proposed as casement windows with hinges nor fixed or pivot. For new construction,
additions and; alterations, use the wall finish most acceptable for the architectural style.
Although constructed in 1990, the construction style appears to mimic a frame
vernacular architectural style. The frame vernacular typically had clapboard siding. The
applicant modified the request initially made relative to siding in order to adhere to the
requirement for fiber cement siding.
c). To the extent that a conclusion of law as set forth herein also constitutes a
factual finding, then such shall be taken to be so as part of this Development Order.
d). The proposed Certificate of Appropriatenessis hereby found and 4
determined to comply with the aforestated requirements.
e). Additionally, the Certificate of Appropriateness sought is hereby found and
determined to be consistent with the City of Sanford Comprehensive Plan and
development of the property as proposed would be consistent with and in compliance to
applicable land development regulations and all other applicable regulations and
ordinances as set forth in the Code of Ordinances of the City of Sanford.
ORDER
NOW, THEREFORE, IT IS ORDERED THAT:
1). The aforementioned application for a Certificate of Appropriateness is
APPROVED subject to the provisions hereof.
2). This Development Order granting approval of a Certificate of
Appropriateness touches and concerns the aforedescribed property.

3). The following conditions of approval are hereby imposed and agreed upon
a). New windows may be vinyl; however, must match existing original in
design, dimensions, profile and other visual qualities.
b). New siding must be fiber cement siding and shall be installed as
clapboard design consistent with dimensions, profile and other visual qualities of the
existing clapboard.

2017) Florida Building Code (FBC) structural requirements excluding the

2. Product anchors shall be as listed and spaced as shown on details. Anchor
