RELATING TO THE REGULATION OF THE PURCHASE OF
PERSONAL PROPERTY CONSISTING OF PRECIOUS ~ETALS
BY SECONDHAND DEALERS WITHIN THE CITY OF SANFORD;
PROVIDING FOR KEEPING OF CERTAIN RECORDS BY SUCH
DEALERS; PROHIBITING THE DISPOSAL OF CERTAIN PER-
SONAL PROPERTY CONSISTING OF PRECIOUS METALS WITH~
IN TEN DAYS OF RECEIPT OF SAb~; PROVIDING FOR THE
FILING OF CERTAIN REPORTS WITH THE CHIEF OF POLICE;
PROHIBITING THE TRANSACTION OF BUSINESS INVOLVING
PRECIOUS METALS WITH MINORS; PROVIDING FOR THE
ARRANGEMENT OF PRECIOUS METALS IN SUCH A MANNER
AS TO FACILITATE INSPECTION; PROVIDING FOR PEN-
ALTIES, SEVERABILITY, CONFLICTS AND EFFECTIVE
DATE.
WHEREAS, it is the desire of the City Commission of the
City of Sanford, Florida, to set forth regulations governing
the purchase and disposition of personal property made of
gold, silver, ~latinumor other precious metal by secondhand
dealers within the City of Sanford, Florida,
NOW, THEP~FORE, BE IT ENACTED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA:
SECTION 1: Definitions.
The following words and phrases when used in
this Ordinance shall have the meanings respectively ascribed
to them in this section:
~. "Secondhand Dealer" shall mean any person
engaged in the business of purchasing or selling at reta{1 or
wholesale or otherwise dealing in any old, used or secondhand
materials of any kind or description, whether with a fixed place
of business or as an itinerant.
B. "Precious Metal" shall mean any rare and
costly mineral or element, such as gold, silver, or platinum.
SECTION 2: Register of Transaction.
A. Any person engaged in business as a second-
hand dealer shall keep a register in connection with his business,
said register to be ~pproved as to type and form by the Chief
of Police, and at the time of each transaction, shall enter or
cause to be entered therein an accurate description of the
person from whom any article of p~rsonal property made of gold,
silver, platinum or other precious metal is purchased or received,
and shall include in the description, but not be limited to, the
name, dateof birth, sex, race, place of residence and drivers
license, or, if none, other governmental identification numbers
of the person, together with an accurate description of any
article of personal property made of gold, silver, platinum,
or other precious metal so purchased or received, which descrip-
tion shall contain any mark, brand, monogram, hallmark, word
or letters which may be engraved, stamped, etched or otherwise
permanently marked upon the article. The register shall, at
all times, be kept open and available for the inspection and
examination of the Chief of Police or any other person authorized
by the Chief of Police to inspect the register.
Bo Any and all persons engaged in business as
as~condhand dealer shall,'in keeping the register required in
ParagraphA above, take the following precautions to insure the
accuracy of the personal identification required:
(1) Require the customer, as a condition to
the purchase~ to Sign his name on the registration form.
(2) Require reasonable proof of identity
which would include, but not be limited to, display of a driver's
license or other governmental identification cards or certificates.
C. It shall be unlawful for any customer to give
or display false identification to the dealer or to sign a false
name o
SECTION 3: Disposal of Property Prohibited.
No articles of personal property made of gold,
silver, platinum or other precious metals shall be sold, melted,

altered, or otherwise disposed of by any secondhand dealer
until ten (10) days have elapsed from the time the Chief of
Police has had made available to him a copy or transcript of
the register in which such articles ofpersonal property made
of gold, silver, platinum or other precious metals are entered,
and said articles shall not be transferred from within the city
limits of Sanford during the said ten (10) day period of time.
SECTION 4: Transcript of Register to be Made Available
to Chief of Police.
All secondhand dealers shall, not later than
12:00 noon of each business day, make available to the Chief.
of Police or his representative, a full and complete copy or
transcript of the preceeding business day as required by
Section 2.
SECTION 5: Dealing with Minors Prohibited.
It shall be unlawful for any secondhand dealer
to buy, take or receive by way of purchase or exchange any
articles made of gold, silver, platinum or other precious metals
from any person under the age of eighteen (18) years.
SECTION 6: Arrangement of Stock to Facilitate Inspection.
All articles of personal property made of
gold, silver, platinum or other precious metals purchased or
received by secondhand dealers shall be so arranged in stock as
to enable the stock to be inspected by the police department or
any other person with such authority.
SECTION 7: Penalty Provision.
The violation of or failure to comply with
any provision of this Ordinance shall constitute a misdemeanor
against the City and shall subject the offender, upon conviction,
to a fine not to exceed Five Hundred Dollars ($500.00) or im-
prisonment for a period not to exceed sixty (60) days.
SECTION 8: Conflicts.
If any section or portion of a section of this
Ordinance proves to be invalid,-unlawful or unconstitutional,

it shall not be held to invalidate or impair the validity,
force or effect of any other section or part of this Ordinance.
SECTION 9: Severability.
That all ordinances or parts of ordinances in
conflict herewith, be and the same are hereby repealed.
SEC%IQN 10: Effective Date.
That this Ordinance shall become effective
i~ediately upon its passage and adoption.
