AN ORDINANCE OF THE CITY OF SANFORD,FLORIDA,
AMENDING SECTION I OF ARTICLE 8 OF ORDINANCE
NO. 1097, SAID ORDINANCE BEING THE ZONING
ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
SAID SECTION BEING ENTITLED PLANNED UNIT
DEVELOPMENT DISTRICT; SAID AMENDMENT CHANGING
SUB-PARAGRAPH 8 OF THE REVIEW AND APPROVAL
PROCEDURES AS TO DEVELOPMENT PLANS TO ALLOW
THE CITY COMMISSION TO REINSTATE ANY LAPSED
DEVELOPMENT PLAN FOR AN ADDITIONAL PERIOD OF
ONE YEAR; SAID AMENDMENT FURTHER PROVIDING
THAT IN THE EVENT A DEVELOPMENT PLAN LAPSES
THE CITY COMMISSION SHALL FILE A NOTICE OF
REVOCATION WITH THE RECORDED DEVELOPMENT
PLAN AND REZONE THE REVOCATED UNDEVELOPED
AREA AFTER RECOMMENDATIONS FROM THE PLANNING
AND ZONING COMMISSION; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Commission of the City of Sanford
adopted Ordinance No. 1439 on May 22, 1978, said ordinance being
an emergency ordinance pursuant to the provisions of Section 166.041,
(3)(b), Florida Statutes; said ordinance authorizing the continued
development of platted property in those presently existing areas
which are zoned PUD (Planned Unit Development), and
WHEREAS, the City Commission has determined after
appropriate public Hearings that the portion of the zoning ordinance
relative to PUD (Planned Unit Development) should be amended as to
the Development Plan provisions to ~lloWthe CityCommisSiOn ~to .rein-
state a lapsed Development Plan for an additional period of one (1)
year, and, further, to rezone undeveloped areas in the event the
Development Plan is revoked after receiving recommendations from
the Planning and Zoning Commission.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD,
FLORIDA:
SECTION 1: That sub-paragraph 8 of the Review and
Approval procedures in the Planned Unit Development District set
forth in Article VIII of the zoning ordinance of the City of
Sanford is hereby amended to read as follows:
ARTICLE VIII. SUPPLEMENTARY REGULATIONS
1. Planned Unit Development District
C. Review and Approval Procedures.
(8) Approval of the City Commission shall be in effect for at
least a two year period, however, if no construction has
begun within two years after approval of the Development
Plan schedule, or if the applicant fails to maintain the
approved Development Plan schedule, the approval of the
Development Plan of the undeveloped area shall lapse and
be of no further effect. At its discretion and for good
cause, the City Commission may reinstate any lapsed
Development Plan for an additional period of one (1) year.
If the approval of a Development Plan lapses under this
provision, the City Commission shall take the necessary
rezoning action to remove the undeveloped area of the
Planned Unit Development from the official zoning map,
file a notice of revocation with recorded Development Plan,
and upon zoning recommendations from the Planning and Zoning
Commission, rezone the revocated undeveloped area.
SECTION 2: It is the intention of the City Commission
and it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the code of the City of Sanford,
Florida and the code may be renumbered, if necessary, to accomplish
such intention.
SECTION 3: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
SECTION 4: That this ordinance shall become effective
immediately upon its passage and adoption.
