AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
PROHIBITING ANY PERSON FROM RIDING A BICYCLE
ON ANY SIDEWALKS ON PUBLIC /RIGHT-OF-WAYS IN
ANY DISTRICTS WHICH HAVE A COMMERCIAL ZONING
CLASSIFICATION WITHIN THE CITY OF SANFORD,
UNLESS A PARTICULAR SIDEWALK HAS BEEN DESIGNATED
AS A BICYCLE PATH; PROVIDING A PENALTY; PROVID-
ING FOR THE ORDINANCE TO BECOME A PART OF THE
CITY OF SANFORD CODE; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Commissioners of the City of Sanford,
Florida, recognize that the operation of bicycles on sidewalks
situated in the public right-of-ways in the commercial and business
districts throughout the City constitute a hazard to pedestrians,
and
WHEREAS, it is the opinion of the City Commission that
sidewalks within the right-of-ways should only be used by pedestrians
and, therefore, that an ordinance is needed to prohibit the operation
of bicycles on sidewalks situated within the public right-of-ways
in the commercial and business districts throughout the City of
Sanford, Florida.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD,
FLORIDA:
SECTION I: That the operation of bicycles by any person
on any sidewalk in the public right-of-waysin any districts which
have a commercial zoning classification within the City of Sanford,
Florida, is hereby prohibited, unless a particular sidewalk has been
designated as a bicycle path by the Police Chief and approved by the
City Manager.
SECTION 2: That the violation of or failure to comply
with the ordinance shall constitute an offense against the City of
Sanford, Florida, and any offender, upon conviction, shallbe sub-
ject to a fine not to exceed Five Hundred and No/100 ($500,00)
Dollars, or imprisonment for a period not to exceed sixty (60) days
or both each fine and imprisonment.
SECTION 3: It is the intention of the City Commission
and it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the code of the City of Sanford,
Florida, and the code may be renumbered, if necessary, to accomplish
such intention.
SECTION 4: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
SECTION 5: That this ordinance shall become effective
immediately upon its passage and adoption.
