PUBLIC UTILITY AND ACCESS EASEMENT FROM HABITAT TO SANFORD
THIS QUIT CLAIM DEED made the 18th day of October A. D. 2023 by HABITAT
FOR HUMANTY IN SEMINOLE COUNTY, FLORIDA, INC., also/known as HABITAT
FOR HUMANITY OF SEMINOLE COUNTY AND GREATER APOPKA, FLORIDA, INC., a
Florida non-profit corporation whose principal address is 251 Maitland Avenue, Suite 312,
Altamonte Springs, Florida 32701, and whose mailing address is Post Office Box 181010,
CASSELBERRY, Florida 32718, hereinafter called the "GRANTOR", and the CITY OF
SANFORD, a municipal corporation organized and existing under the laws of the State of
Florida, whose address is 300 North Park Avenue, Sanford, Florida 32771, hereinafter
called the "GRANTEE".
W TNESSETH:
FOR AND IN CONSIDERATION OF the sum of ONE AND NO/100 DOLLAR ($1-00)
and other good and valuable consideration, the receipt and sufficing of which is hereby
acknowledged, GRANTOR does hereby grant and convey to the GRANTEE and its
assigns, an easement and right-of-way for public utility and stormwater purposes, with full
authority to enter upon, excavate, construct and maintain, as the GRANTEE and its assigns
may deem necessary, electrical poles, telephone poles, wires, utility lines, guy wires and
appurtenances, ditches, water pipes, sewer pipes, gas pipes and mains, communication
lines and facilities, sidewalks, access roads and any other utility facilities, and associated
facilities, over, under, upon and through the following -described lands situate in the County
of Seminole, State of Florida, to -wit:
Address: 2201 Historic Goldsboro Boulevard
Legal Description:
A portion of Lots 27 and 28, Dixie, according to the plat thereof, as recorded
in Plat Book 2, Page 103, of the Public Records of Seminole County, Florida,
described as follows:
Commencing at the Northwest corner of said Lot 27, thence with the
East line of said Lot 27, South 00016'14" West, 57.00 feet, to the Point
of Beginning. Continue with the East line of said Lots 27 and 28, South
0016'14" West, 131.00 feet, to the Southeast corner of said Lot 28;
thence departing the East line of said Lot 28, and with the South line of
said Lot 28, North 8948'01" West, 25.00 feet; thence departing the

South line of said Lot 28, North 06020'32" East, 94.54 feet; thence
North 22019'43" East, 39.94 feet, to the Point of Beginning. Containing
2,157.50 square feet or 0.05 acres, more or less.
TO HAVE AND TO HOLD the right to reasonably enter upon the contiguous lands of
the GRANTOR in order to accomplish the aforesaid actions and free ingress and egress
over and across the said property.
FURTHER, TO HAVE AND TO HOLD said easement and right-of-way unto said
GRANTEE and its assigns forever.
THE GRANTEE and its assigns shall have the right to clear, keep clear and remove
from said right-of-way all trees, undergrowth, and other obstructions that may interfere with
location, excavation, operation or maintenance of the utilities or any facilities installed
thereon by the GRANTEE and its assigns, and the GRANTOR, and the successors and
assigns of the GRANTOR, agree not to build, construct or create, or permit others to build,
construct or create any buildings or other structures on the said easement and/or right-of-
way that may interfere with the location, excavation, operation or maintenance of the
utilities, or any facilities installed thereon.
IN WITNESS WHEREOF, the said GRANTOR has signed and sealed these
presents the day and year first above written.
