An Ordinance of the City of Sanford, Florida amending
the City of Sanford Comprehensive Plan, as previously
amended; providing for a small scale development
amendment of the Future Land Use Map of the Future
Land Use Element of the City of Sanford Comprehensive
Plan relative to certain real property, approximately 3.17
acres in size located at 3565 Mellonville Avenue within
the City Limits (maps relating to the property are
attached) (Tax Parcel Identification Numbers 07-20-31-
300-0190-0000 (portion of) and 07-20-31-300-0198-0000
(portion of) said property being more specifically
described in this Ordinance; providing for legislative
findings and intent; providing for assignment of the land
use designation for the property; providing for the
adoption of maps by reference; providing for
severability; providing for ratification of prior acts of the
City; providing for conflicts; providing for codification
and directions to the Code codifier and providing for the
implementation of the statutory State review process
and an effective date.
Whereas, Mellonville Holdings LLC, whose sole partner is Mohamed
Abdulhussein, is the owner of certain real property which land totals approximately 3.17
acres in size; and
Whereas, the subject property is addressed as 3565 Mellonville Avenue and
is assigned Tax Parcel Identification Numbers 07-20-31-300-0190-0000 (portion of) and
07-20-31-300-0198-0000 (portion of)) by the Property Appraiser of Seminole County;
and
Whereas, the subject property is located on the east side of Mellonville
Avenue, approximately 370 feet south of its intersection with Cornwall Road; and
Whereas, Mr. Abdulhussein intends to develop the property with a personal
single-family residence; and
Whereas, Ms. Tedrow, as the applicant on behalf of the Property Owner,

requested that the Future Land Use Map of the Future Land Use Element of the City of
Sanford Comprehensive Plan, as previously amended, relative to subject property be
changed from the assignment of the subject property from the Medium Density
Residential, MDR10, future land use designation to the Low Density Residential Single -
Family, LDRSF, future land use designation under the City's Comprehensive Plan; and
Whereas, a CAPP (Citizens Awareness and Participation Plan) meeting was
held and a CAPP report provided to the City relative to the application all being
accomplished to the satisfaction of the City; and
Whereas, Section 163.3187, Florida Statutes, relates to the amendment of
adopted local government comprehensive plans and sets forth certain requirements
relating to a process for the adoption of small scale amendments to local government
comprehensive plans and relates to processes and actions relating thereto; and
Whereas, the City's Planning and Development Services Department has
conducted a thorough review and analysis of the demands upon public facilities and
general planning and land development issues should the subject application be
approved and has otherwise reviewed and evaluated the application to determine
whether it comports with sound and generally accepted land use planning practices and
principles as well as whether the application is consistent with the goals, objectives and
policies set forth in the City's Comprehensive Plan and determined that the proposed
amendment of the City's Comprehensive Plan relative to the subject property as set
forth in this Ordinance is internally consistent with the Comprehensive Plan of the City
of Sanford and is consistent with the controlling provisions of State law; and
Whereas, the City of Sanford's Planning and Zoning Commission (P&ZC), as

the City's local planning agency, held a public hearing on November 2, 2023 in order to
consider amending the Future Land Use Map of the Future Land Use Element of the
City of Sanford Comprehensive Plan and unanimously recommended approval of the
proposed Future Land Use Map amendment to the Comprehensive Plan for the subject
property as requested by the Property Owner; and
Whereas, the City Commission concluded that the overall goals, objectives
and policies of the City's Comprehensive Plan and the controlling State law support the
approval of the application; and
Whereas, the City of Sanford has complied with all requirements and
procedures of Florida law in processing this amendment to the City of Sanford
Comprehensive Plan including, but not limited to, Section 163.3187, Florida Statutes, as
well as other controlling law; and
Whereas, additionally, this Ordinance is enacted pursuant to the home rule
powers of the City of Sanford as set forth at Article VIII, Section 2, of the Constitution of
the State of Florida; Chapter 166, Florida Statutes, and other applicable controlling law.
Now, therefore, be it enacted by the People of the City of Sanford, Florida:
Section 1. Legislative findings and intent.
(a). The City Commission of the City of Sanford hereby adopts and
incorporates into this Ordinance the City Commission agenda memorandum relating to
the application relating to the proposed amendment to the City of Sanford
Comprehensive Plan pertaining to the subject property.
(b). The City of Sanford has complied with all requirements and procedures of
Florida law in processing and advertising this Ordinance.

(c). This Ordinance is internally consistent with the goals, objectives and
policies of the Comprehensive Plan of the City of Sanford.
(d). The exhibits to this Ordinance are incorporated herein as if fully set forth
herein verbatim.
Section 2. Amendment to Future Land Use Map/Future Land Use
Designation.
(a). The Future Land Use Plan Element of the Comprehensive Plan of the City
of Sanford and the City's Future Land Use Map are hereby amended by changing the
land use designation from the Medium Density Residential, MDR10, future land use
designation to the Low Density Residential Single -Family, LDRSF, future land use
designation under the City's Comprehensive Plan, with regard to the real property which
is the subject of this Ordinance as set forth herein.
(b). The property which is the subject of this Comprehensive Plan amendment
is more specifically defined, described and depicted in the exhibits to this Ordinance
and as follows:

Section 3. Implementing Administrative Actions. The City Manager, or
designee, is hereby authorized to implement the provisions of this Ordinance as
deemed appropriate and warranted.
Section 4. Incorporation Of Maps. The maps attached to this Ordinance are
hereby ratified and affirmed and incorporated into this Ordinance as a substantive part
of this Ordinance.
Section 5. Ratification Of Prior Actions. The prior actions of the City
Commission and its agencies in enacting and causing amendments to the
Comprehensive Plan of the City of Sanford, as well as the implementation thereof, are
hereby ratified and affirmed.
Section 6. Severability. If any section, sentence, phrase, word, or portion of
this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to
impair the validitrdinorce or effect of any other action or part of this Ordinance.
Section 7. Conflicts. All ordinances or parts of ordinances in conflict herewith
are hereby repealed.
Section 8. Codification/Instructions to Code Codifier. It is the intention of
the City Commission of the City of Sanford, Florida, and it is hereby ordained that the
provisions of this Ordinance shall become and be made a part of the codified version of
the City of Sanford Comprehensive Plan and/or the Code of Ordinances of the City of
Sanford, Florida in terms of amending the Future Land Use Map of the City.
Section 9. Effective Date. The Comprehensive Plan amendment set forth
herein shall not become effective, in accordance with Section 163.3187(5)(c), Florida

Statutes, until 31 days after adoption. If challenged within 30 days after adoption, the
Comprehensive Plan amendment set forth herein shall not become effective until the
State land planning agency or the Administration Commission, respectively, issues a
final order determining that the adopted amendment is in compliance.

SYNOPSIS:
A request to amend the Future Land Use from Medium Density Residential, MDR10 to Low
Density Residential Single -Family, LDR-SF on 3.17 acres at project address 3565 Mellonville
Avenue has been received.
The property owners are Mellonville Holding LLC. The applicant is Tara Tedrow of the Lowndes
Law Firm. A CAPP (Citizens Awareness and Participation Plan) meeting was held on April 19,
2023 and a copy of the report is attached, which is satisfactory to the City.
The Affidavit of Ownership and Designation of Agent forms are attached and other information is
available in order to ensure that all potential conflicts of interests are capable of being discerned.
FISCAL/STAFFING STATEMENT:
According to the Property Appraiser's records, the subject property is vacant and being assessed
as vacant waterfront and waterfront single family with the assessed tax values and total tax bills
for 2023 shown below:

It is the applicant's intent to develop the property with his personal single-family residence. The
proposed development will facilitate new residential construction and generate additional tax
revenue to the City.
No additional staffing is anticipated if the land use amendment is approved.
BACKGROUND:
The 3.17 acre parcel is located on the east side of Mellonville Avenue, approximately 370 feet
south of its intersection with Cornwall Road. The subject properties are currently zoned SR1A,
Single Family Residential with a Future Land Use Map designation of MDR10, Medium Density
Residential.
This application is a follow up application to a Comprehensive Plan Amendment and PD Rezone,
which were approved last year.
Comprehensive Plan
Staff has outlined relevant Goals, Objectives and Policies (GOP's) that support the proposed land
use amendment:
Objective FLU 1.1: Implement the Future Land Use Map Series. The City shall adopt and
implement the Future Use Map (FLUM) series in the Future Land Use Element goals of the
Comprehensive Plan. The maximum density and Floor Area Ratio for Low Density Residential -
Single Family future land use is as follows:

OBJECTIVE FLU 1.2: Allocate Residential Land Use. The Future Land Use Map shall allocate
residential density based on the following considerations:
Policy FLU 1.2.2: Designate Low Density Residential — Single Family (LDR-SF) Districts.
The areas delineated for LDR-SF development shall include existing stable single family areas, as
well as those areas identified for future low density residential single family development in order
to provide sufficient land area to meet projected single family housing needs. Areas delineated as
LDRSF shall allow residential development with a maximum density of up to six dwelling units
per acre comprised of single family detached homes on individual lots. Supportive community
facilities and accessory land uses as defined in the LDRs may be located within areas designated
LDR-SF.

Development within the LDR-SF designation shall be required to meet the following general
criteria together with the performance criteria established in Policy FLU 1. 1.7 in this Element:
• Compatible with the quality and character of existing low density single family neighborhoods;
• Compatible with existing and anticipated future developments;
• Compatible with natural features of the land and other policies within the Comprehensive Plan
impacting natural resources.
LEGAL REVIEW:
The City Attorney has not reviewed the staff report and but has provided the following legal
comment regarding the requested Comprehensive Plan Amendment:
This matter is not a quasi-judicial matter as amendments to local government comprehensive plans
are legislative in nature. If a proposal to amend the City Comprehensive Plan is to be recommended
for denial, it would be appropriate to state the particular reason for such a recommendation to be
considered by the City Commission - such as the proposal is internally inconsistent with a goal,
objective or policy of the Comprehensive Plan or inconsistent with controlling State law or the
like.
The City Commission approved the first reading of Ordinance No. 4760 on December 11, 2023.
The City Clerk published notice of the 2"d Public Hearing in the Sanford Herald on December 27,
2023.
RECOMMENDATION:
Staff finds that the small-scale land use amendment is appropriate and suitable for the subject site
and is compatible with the surrounding land uses and is consistent with the City of Sanford
Comprehensive Plan, and Chapter 163 of Florida Statutes.
A majority vote of the Planning and Zoning Commission present and voting is required to
recommend approval, approval with conditions or denial of this policy matter to the City
Commission after a public hearing is conducted to determine if the proposed land use change is
consistent with the Goals, Objectives and Policies of the City's Comprehensive Plan and the
State's Growth Policy Act.
On November 2, 2023, at its regularly scheduled meeting, the Planning and Zoning Commission,
upon recommendation by staff, voted to recommend the City Commission approve the Small -
Scale Comprehensive Plan Amendment to amend the Future Land Use from Medium Density
Residential, MDR10 to Low Density Residential -Single Family, LDR-SF on 3.17 acres at project
address 3565 Mellonville Avenue.
Additional comments or recommendations may be presented by staff at the meeting.

The request is for a Small -Scale Comprehensive Plan Future Land Use map amendment to LDRSF,
as required under the approval of Planned Development PDR22-000004 (the "Approved PD"). This
requested Future Land Use change shall ensure that only low density single family residential homes can
be built on the property in the future, will enhance compatibility with neighboring residential uses and
protect the lakefront residential properties.
Per Future Land Use Policy 1.2.2 of the City's Comprehensive Plan, "areas delineated for LDR-SF
development shall include existing stable single family areas, as well as those areas identified for future
low density residential single family development in order to provide sufficient land area to meet projected

single family housing needs. Areas delineated as LDRSF shall allow residential development with a
maximum density of up to six dwelling units per acre comprised of single-family detached homes on
individual lots. Supportive community facilities and accessory land uses as defined in the LDRs may be
located within areas designated LDR-SF."
PROPERTY INFORMATION & COMPATIBILITY ANALYSIS
The Property has access to Mellonville Avenue. The Property is located a few thousand feet from the
Sanford International Airport and is surrounded by existing residential, industrial, warehouse and office
uses. The property fronts Silver Lake on the east; the parcel to the north is vacant waterfront property zoned
R -IAA with a future land use of low density residential ("LDR") by Seminole County. The vacant parcel
to the south has a future land use designation of Industrial and is zoned PD (under the Approved PD) by
City of Sanford; this site is owned by the applicant. The parcel to the west has several commercial buildings
and is zoned MI -2 with a future land use designation of Industrial within the City of Sanford.
Given the requirements of the Approved PD and the functional reduction in density allowed by the
requested Comprehensive Plan Amendment, we respectfully request approval of this change.

A Neighborhood Meeting to discuss a Future Land Use Change took place on April 19, 2023
at 6:00 p.m. at the Seminole County Library -Sanford Branch located at 150 North Palmetto
Street, Sanford, FL 32771 for the property located at 3565 Mellonville Avenue, Sanford, FL
32771. The parcel identification numbers are 07-20-31-300-0190-0000 (the "Property"). The
meeting was required as a part of the Citizens Awareness & Participation Plan ("CAPP")
submitted in conjunction with the applications.
