RIGHT OF ENTRY AGREEMENT AND LICENSE FROM SANFORD BURGERS LLC
TO THE CITY OF SANFORD RELATING TO TESTING AND MAINTENANCE OF AN
EXISTING RAW WATER PUMPING STATION
THIS RIGHTOF ENTRY AGREEMENT AND LICENSE is made and entered
into thisoday oft, 2023 by and between Sanford Burgers LLC, whose address
\� is 2154 Eastridge Center, Eau Claire, Wisconsin, 54701-3403, hereinafter referred to as
the "OWNER", and theCITY OF SANFORD, a Florida municipal corporation, whose
address is 300 N. Park Avenue, Florida 32771, hereinafter referred to as the CITY.
WITNESSETH:
IN CONSIDERATION of the mutual promises contained herein and the payment
of ONE DOLLAR ($1.00), as good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged by the OWNER, the OWNER and theCITY
agree as follows:
1. Upon execution of this Agreement the OWNER hereby grants to theCITY, its
employees, agents, contractors and other representatives the license and right to enter
upon the property described in the Exhibit attached hereto (the area and land beingthe
p rope rtyid e ntified by the Seminole County Property Appraiser as Tax Parcel
Identification Number: 11-20-30-300-0100-0000, for the purposes of accessing, testing
and maintaining an existing City Raw Water Pumping Station located adjacent to this
parcel in such ways, means and manners as the CITY deems appropriate.
2. The rights granted by the OWNER to the CITYherein shall expire Capon the CITY
filing an affidavit in the Public Records (land records) of Seminole County so stating.
3. To the extent and limits permitted by controlling State law, Section 768.28,
Florida Statutes, the CITY shall indemnify the OWNER for its negligent work within the
property.
IN WITNESS WHEREOF, the parties hereto have executed this instrument for
the purpose herein expressed.
