(the -'Tenant'"). whose address is 106 Ventura Drive. Sanford Florida 32725 and the City of Sanford. Florida (the "Landlord*). whose address is 300 North Park Avenue- Sanford. Florida X2771. The parties entered into that certain Lease Agreement in 1991" which has been amended and extended from time -to -time. and is novo in line to terminate on June 15. 2024 all of which prior documents are on file as public records of the Cit-' of Sanford. The parties have determined that it is mutually beneficial to amend and renew the Lease Agreement. as previously amended. for a term terminatin- on .lune 15. 2029- unless terminated in accordance with the provisions of the Lease Agreement or by the Cite upon 90 days advance written notice at an%- time without cause or with cause in the sole and absolute discretion of the Cith . The parties reco-nize that the Lease Agreement is in good standing in all respects. Additionally. although previously stated in prior documents. the terms and conditions of the Lease Agreement shall be such that the Tenant shall pay the Landlord $10.00 per year as rent: shall procure_ have and maintain proper insurance as required by the Landlord: the Tenant agrees to reasonably cooperate with programs and activities of the Landlord that are recreational or tourist related and involve the promises and the activities of the Landlord or the Tenant. Further. hoxvever. the Tenant agrees that the "K9 'rrainin'.z Yard"" may operate and fully function under the direction of" the City of Sanford Police Department within that area. Bonaparte, Jr., ICMA-CM, City Manager SUBJECT: Sanford Aero Modelers, Inc.; Lease Extension Ap Site 10 Property / STRATEGIC PRIORITIES: ❑ Unify Downtown & the Waterfront ❑ Promote the City's Distinct Culture ❑ Update Regulatory Framework ❑ Redevelop and Revitalize Disadvantaged Communities SYNOPSIS: Approval by the City Commission of an extension and amendment to the property lease with Sanford Aero Modelers, Inc. relating to the City -owned property known as Site 10 is requested. FISCAL/STAFFING STATEMENT: The lease payment of $10 per year continues. Providing that they provide the required insurance to the City. BACKGROUND: The City owns approximately 2,129.55 acres east of the City limits commonly known as Site 10. Sanford Aero Modelers, Inc. leases a portion of the property which is depicted in the aerial map attached. The City Commission approved the original lease with the Sanford Aero Modelers in 1994 and it has been extended and amended from time -to -time. It is now set to terminate on June 15, 2024. Sanford Aero Modelers, Inc. would like to renew the lease. Sanford Aero Modelers, Inc. pays the City $10 per year and is required to have proper insurance in place to protect the City. Sanford Aero Modelers, Inc. provides recreational opportunities for the remote -control airplane enthusiast. LEGAL REVIEW: The Assistant City Attorney has assisted in this matter and has no legal objection to the action. RECOMMENDATION: City staff recommends approval of the extension and amendment to the Lease Agreement with Sanford Aero Modelers, Inc. SUGGESTED MOTION: "I move to approve the extension and amendment, as proposed." Attachment: Extension and Amendment to the Lease Agreement (with aerial map).
