shall bear interest at the rate of 18% per annum until paid.
4. CONSTRUCTION SPECIFICATIONS: Contractor will install a swimming pool and appurtenant structures and equipment in accordance with the plot plan and these
construction specifications. Contractor reserves the right to substitute like or similar material, equipment or fixtures. The plot plan is intended to be a representation of
the pool to be built and is not intended to represent an 'as built" drawing, because pool location, elevation of pool, location of decking and enclosures are subject to
changes due to set -back requirements, locations of existing improvements, soil conditions and other conditions beyond the control of the contractor. All measurements
in the contract and on the plot plan are approximate and the pool dimensions contained in the contract may vary from the "as builP measurements. Deviations up to 3
inches are acceptable. Therefore, the parties agree that it is impossible to ascertain actual damages in the event of deviation from specified pool dimensions. The
parties agree to adjust the contract price of an amount calculated by multiplying the percentage reduction of surface area times one-half (1/2) of the total contract price
for diminished water surface area, and $50.00 for each vertical inch of depth deficiency measured only at the main drain and shallowest portion of the pool as liquidated
damages to owner resulting from said variations, if any. Depth is measured from the floor of the pool to the top of the water line tile. Any additional soil needed for
decking or normal grading in excess of what is dug from the pool, is at the home owner's expense. Any and all additions required by building department would be at
owners expense. If a diving board or slide is installed, there is no liability assumed for injuries as a consequence of use or misuse of the diving board or slide. If a diving
board or slide is installed later, there is no liability to the pool contractor and it shall cancel all warranties.

5. BUYERS RIGHT TO CANCEL: The Contractor shall not be obligated to commence construction of this pool until three (3) days after the signing of this contract
by the Owner. Since this contract may be construed as a Home Solicitation Sale, purchaser is hereby notified of his right to cancel under the Home Solicitation Sales
Act. This is a Home Solicitation Sale. If you do not want the goods or services contracted for, you may cancel this agreement by mailing a notice to seller. This notice
must indicate that you do not want the goods and services and must be postmarked by midnight of the third day after you signed this agreement. If you cancel this
agreement, the seller may keep all or part of the cash down payment.
6. OFFER AND AGREEMENT. This Contract Shall be deemed an offer to ATLAS POOLS OF CENTRAL FLORIDA, INC., and shall be null and void unless accepted
by a duly authorized officer of the Contractor within ten (10) days of the date and year noted the Owners' signatures. The Salesman has no authority to bind the
Contractor. All agreements and understandings are contained in this contract and the Owner warrants that there are no agreements or understandings other than are
set forth in this document. Acceptance of the terms of this contract by Contractor is to be communicated to the Owner by transmitting a copy of this contract to them
showing acceptance by the sellers by the execution of a duly authorized officer of the Contractor or by commencing construction.

Notice of Requirements
I (We) acknowledge that a new swimming pool, spa or hot tub will be constructed or
installed at 0a 75 JJr eytg-tc %`R - S &r 3a -7,j , and hereby affirm that one of
the following methods will be used to meet the requirements of Florida Statute in
Chapter 515.
The pool will be isolated from access to the home by an enclosure that
meets the pool barrier requirements of Florida Statute 515.29;
The pool will be equipped with an approved safety pool cover that
complies with ASTM F1346-91 (Standard Performance Specifications for
Safety covers for Swimming Pools, Spas, and Hot Tubs);
All doors and windows providing direct access from the home too the
pool will be equipped with an exit alarm that has a minimum sound
pressure rating of 85 decibels at 10 feet;
All doors providing direct access from the home to the pool will be
equipped with self-closing, self -latching, devises with release
mechanisms placed no lower that 54" above the floor or deck;
I (We) understand that not having one of the above installed at the time of final
inspection, or when the pool is completed for contract purposes, will constitute a
violation of Chapter 515, F.S. and will be considered as committing a misdemeanor
of the second degree, punishable by fines up to $500 and/or up to 60 days in jail as
established in Chapter 775, F.S.

2. Pool Walls shall be 5' thick and Floors shall be 6' thick and shall be pneumatically
applied Concrete with a Compressive Strength of 3,000 psi in 28 days. Concrete
Decks shall be 2,500 psi. Concrete constriction will conform to ACI Standard 318.

Florida Building Code Residential 2007, together with 2009 Revisions, ANSI/NSP
National Standard -5 for Residential Inground Swimming Pools, ANSI/NSP National
Standard -3 for Permanently Installed Residential Spas, ANSI/APSP-7 American
National Standard for Suction Entrapment Avoidance In Swimming Poole, Wading
Poole, Spas, Hot Tubs and Catch Basins and the Latest Adapted National Electric
Code (NEC).
4. All Pool Piping to be Schedule 40 PVC,- bearing the markt of NSF Approval unless
otherwise noted.
5. All Reinforcing Steel to conform to ASTM 615, Grade 40. Reinforcing shall be #3
bars at 12' on center in each direction, w/ 15' lap joints in walls and floors up .
to 6'. Over 6' use #3 bars at 6' on center in each direction in the areas over
6'.
If Concrete is twat against Baro Earth without a Separation Barrier, the minimum
cover shall be 3'. With a Barrier (Steeltex) between Concrete and Earth, the

6. All Metallic Pool Fittings within 5' of the inside wall and deck reinforcing steel to be
banded to the•Pool Reinforcing Steel with #8 AWG Copper Wire. The #8 Copper
Wire to be run internally and extemolly with the NEC approved PNC Light Conduit
form the tight Niche to the Junction Box. Completion of the pool grounding to the
Electrical Panel Ground to be by Electrician.
7. BoncLall Sheathed Cables, Raceways, Metal Piping and all Fixed Metal Parts not
separated by a permanent barrier, N within 5'-0' Horizontally' from Water and
12'-0' Vertically of Maximum Water Level.
8. Equipotential Bonding to be accomplished in accordance with Article 680 of the
Latest Adapted National Electrical Code (NEC).
9. Pool or Patio shall bear only on Rock or Clean Sand, which shall be compacted to
provide a Structurally Safe Bearing Capacity. Any Unsuitable Material encountered in
excavation shall be removed in its entirety and the area shall be balled with
acceptable material and properly compacted. Where unsuitable Material cannot be
removed, the pool must be redesigned.
10. The Contractor must protect Existing Structures from failure by acceptable methods
Scam. The Enginaw accepts no responsibility for the safety of Existing
tructu11. The Design Engineer assumes no responsibility for pool construction in Easements or
