General Conditions
1. Customer will reimburse GES for any cost overages to proposed permit, bonding or other fees.
2. Compliance with the Davis -Bacon Act or Jessica Lunsford Act is not included in this proposal unless specifically identified.
3. GES shall not be required to provide surety bonds earlier than 60 days prior to the start of work or phases of work not
schedule to reach substantial completion within 6 months of issuance,
4. GES shall not be required to perform any surveying or engineering to complete the work included in this proposal.
5. Right -Of -Way permitting is not Included in this proposal unless otherwise specified.
6. MOT permitting is not included in this proposal unless otherwise specified.
Irrigation System
1. Customer will provide no less than 72 hours advance notice for any required sleeve installation.
2. Customer will provide accurate survey markers and utility locates prior to sleeve installation.
3. This proposal does not include any directional boring or cutting/patching of asphalt or concrete unless specifically identified
and priced accordingly.
4. This proposal assumes that final grade will be completed by others to within one tenth of one foot This proposal does not
include any grading unless specifically identified and priced accordingly.
5. This proposal assumes that all soils throughout the jobsite are easily penetrable and free of foreign debris. GES shall receive
additional compensation for increased labor or special equipment required.
6. GES shall not be held responsible for damage to parking lot base material as a result of sleeve installation.
7. GES shall not be held responsible for an inadequate supply of water to properly operate the irrigation system.
8. It is the responsibility of others to provide electricity, 110v and above, to all irrigation components.
9. GES will Identify the following Items on as -built drawings: points of connection, underground sleeves, controllers, rain
sensors, mainline, wire junction boxes, hose bibs, gate valves, & zone valves.
10. This proposal does not include any es -built drawings for desigrvbuild systems.
11. Unless otherwise specified, standard material & labor warranty is one year from date of substantial completion.
12. Repairs to damage by other contractors will be billed at the rate of $65/hour, plus list price on pans.
Landscape Package
1 GES shall not be held responsible for any live plant material damage resulting from inadequate water supply or the
Interruption of power to the Irrigation system.
In the event that a generator is required to operate the irrigation system for a period longer than 72 hours. GES reserves the
2' right to void all live material warranty. Including sod.
3 This proposal assumes that final grade will be completed by others to within one tenth of one foot. This proposal does not
Include any grading unless specifically identified and priced accordingly.
4 This proposal does not Include any site preparation, grading, transplanting, debris removal, tree barricading, soil amendments
or on-going maintenance unless specifically identified and priced accordingly.
S. GES shall not be held responsible for the failure of any tree staking system when winds exceed 30 mph.
6 GES shall not be held responsible for damages caused by soil conditions, inclimate weather, poor maintenance, vandalism or
herbivorous animals.

This proposal is based on current market pricing for trees and shrubs. With the volatility in the market that is occuring due to

dependent on the time frame for contract issue and/or installation dates.
