Any additional work (including replacement required under item #3) will be an additional cost 2. Contractor shall not assume liability or be held liable for any damages to personal property or physical injury as a result of vibrations caused by hammering or walking on structures or any other normal work operations necessary for completion of the work scope and shall not assume liability for any damages to improperly maintained or improperly constructed structures resulting from normal work operations necessary for completion of the work scope. 3. It is understood and agreed that this contract shall not become binding upon Contractor until it is approved, accepted by Contractor or until performance commences or whichever occurs first. 4. Any and all leftover materials are the property of Contractor, and all materials remain the property of Contractor until paid in full. 5.
