The City of Sanford requires payment of a plan review fee at the time of permit submittal. A copy of the executed contract is required
in order to calculate a plan review charge and will be considered the estimated construction value of the job at the time of submittal.
The actual construction value will be figured based on the current ICC Valuation Table in effect at the time the permit is issued, in
accordance with local ordinance. Should calculated charges figured off the executed contract exceed the actual construction value,
credit will be applied to your permit fees when the permit is issued.. -

homeowners from qualifying as contractors and to express any applicable restrictions and responsibilities.

I understand that state law requires construction to be done by a licensed contractor and have applied %r
an owner -builder permit under an exemption from the law. The exemption specifies that I, as the owner of
the property listed, may act as my own contractor with certain restrictions even though I do not have a
license.

I understand that building permits are not required to be signed by a property owner unless he or she is
responsible for the construction and is not hiring a licensed contractor to assume responsibility.
I understand that, as an owner -builder, I am the responsible party of record on a permit. I understand that I
may protect myself from potential financial risk by hiring a licensed contractor and having the permit filed
'n his or her name instead of my own name. I also understand that a contractor is required by law to be
Ii nsed in Florida and to list his or her license numbers on all permit and contracts.
I understand that I may build or improve a one -family or two-family residence or a farm outbuilding. I
may also build or improve a commercial building if the costs do not exceed $75,000. The building or
residence must be for my own use or occupancy. It may not be built or substantially improved for sale or
ease. If a building or residence that I have built or substantially improved myself is sold or leased within
1 year after the construction is complete, the law will presume that I built or substantially improved it
or sale or lease, which violates this exemption.
understand that, as the owner -builder, I must provide direct, onsite supervision of the construction.
I understand that I may not hire an unlicensed individual person to act as.my contractor or to supervise
ons working on my building or residence. It is my responsibility to ensure that the persons whom I
em p y have the licenses required by law and by city ordinance.
I understand that it is a frequent practice of unlicensed persons to have the property owner obtain an
owner -builder permit that erroneously implies that the property owner is providing his or her own labor
and materials. I, as an owner -builder, may be held liable and subjected to serious financial risk for any
injuries sustained by an unlicensed person or his or her employees while working on my property. My
omeowner's insurance may not provide coverage for those injuries. I am willfully acting as an owner-
uilder and am aware of the limits of my insurance coverage for injuries to workers on my property.
I understand that I may not delegate the responsibility for supervising work to a licensed contractor who is
not licensed to perform the work being done: Any person working on my building who Is not -licensed
must work under my direct supervision and must be employed by me, which means that I must
omply with laws requiring the withholding of federal income tax and social security contributions
nder the Federal Insurance Contributions Act (FICA) and must provide workers' compensation
or the employee. I understand that my failure to follow these laws may subject me to serious financial
risk.

civil court. It is also important for you to understand that, if an unlicensed contractor or employee of an
ndividuaI or firm is injured while working on your property, you may be held liable for damages. If you
btain an owner -builder permit and wish to hire a licensed contractor, you will be responsible for verifying
whether the contractor is property licensed and the status of the contractor's workers' compensation
coverage.

A violation of this exemption is a misdemeanor of the first degree punishable by a term of imprisonment
not exceeding 1 year and a $1,000.00 fine in addition to any civil penalties. In addition, the local
permitting jurisdiction shall withhold final approval, revoke the permit, or pursue any action or remedy
for unlicensed activity against the owner and any person performing'work that requires licensure under
the permit issued.

RE: Fence between 111 and 113 S. Holly Ave
Dear Mr. Gibson;
We are the owners, Robert and Tina Meck, of the property at 111 S. Holly Avenue. Jerry
Mills has approached us as the adjacent new property owner at 113 S. Holly Ave, with a
request to install a 6' stockade fence with a double gate between the north side of his
residence and the south wall of ours, set back more than 10' from the west face of both
residences. He has agreed to pay for the fence and gates and maintain the system, as
depicted in his site plan drawing recently submitted to you for permitting, and as
attached.
We fully support Mr. Mills' request for this portion of the fence which will be jointly
accessed by both parties. This fence in no way provides Mr. Mills with additional
property, it will be there primarily for a sense of security for both property owners and
our respective HVAC units.

' RIGHT-OF-WAY USE AGREEMENT
This Agreement entered into this 10th day of November
,2016 by and between the City of Sanford, a Florida Municipal
Corporation whose Post Office address is P. O. Box 1788,
Sanford, Florida 32772-1788, (hereinafter called the "CITY') and
Jerry W. Mills whose Post Office address is 701 W. 3'd Street,
Sanford, Florida 32771, (hereinafter called the "REQUESTOR").
WITNESSETH:
WHEREAS, the CITY is the owner of certain street rights-of-way within the incorporated limits
of the City of Sanford; and
WHEREAS, these public rights-of-way are held by the CITY for the benefit and general use
of the public for functions including, but not limited to, vehicular and pedestrian travel and land
access, and installation and maintenance of various public utilities, and for conveyance, treatment,
and disposal of stormwater; and
WHEREAS, it is City policy to preserve the utility of these public rights-of-way for the above
stated purposes; and
WHEREAS, written authorization is required for any private use of public lands; and
WHEREAS, the REQUESTOR has requested authorization from the CITY to utilize and/or
improve a portion of the public right-of-way immediately adjacent to their property for a specific
private purpose.
NOW THEREFORE, in consideration of the premises herein the parties agree as follows:
SECTION 1. RECITALS
The above recitals are true and correct and form a material part of this Agreement upon
which parties have relied.
SECTION 2. PURPOSE
The purpose of this Agreement is to document agreements and conditions thereto whereby
the CITY will agree to a right-of-way use/improvement by the REQUESTOR of a portion of public
right-of-way contiguous to the REQUESTOR's property located at 113 Holly Avenue, Sanford,
Florida 32771, legal description: South 42.1 Feet of Lot 9. Block 3, Tier 10, Town of Sanford
Plat Book 1. Pa-ge 61.
The Agreement will allow the REQUESTOR to maintain a six foot fence , on a portion of
the public right-of-way constructed pursuant Building Permit No. 16-3056 issued on
November 10, 2016 Any improvements or modifications to the fence shall be subject to the
following conditions:

A) Construction dimensions, materials, color, and details of all required improvements
shall be as approved by the City.
B) The authorized improvement shall in no way be extended or modified by the
REQUESTOR without prior written approval of the City.
C) REQUESTOR shall otherwise fully comply with all applicable portions of the City Land
Development Regulations.
SECTION 3. MAINTENANCE RESPONSIBILITIES
The REQUESTOR, and his successors and assigns, shall be responsible for perpetual
maintenance of the improvement installed under this Agreement. This shall include maintenance of
the improvement and unpaved portion of right-of-way adjacent thereto. REQUESTOR may, with
written City authorization, remove said installation/improvement fully restoring the right-of-way to its
previous condition.
If the REQUESTOR does not continuously maintain the improvement and area in accordance
with previously stated criteria, or completely restore the right-of-way to its previous condition, the
CITY shall, after appropriate notice, restore the area to its previous condition at the REQUESTOR's
expense and, if necessary, file a lien on the REQUESTOR's property to recover costs of restoration.
SECTION 4. TERMINATION
The CITY reserves the right to unilaterally terminate this Agreement at any time, providing
notice as prescribed below. The REQUESTOR agrees that upon receipt of notice of termination of
this Agreement that he will expeditiously remove the installationrmprovement and return the land to
its previous condition. All restoration must be completed within thirty (30) days of receipt of the
termination notice from the CITY.
SECTION 5. INDEMNIFICATION
To the fullest extent permitted by law, REQUESTOR agrees to defend, indemnify, and hold
harmless the City, its councilpersons, agents, servants, or employees (appointed, elected, or hired)
from and against any and all liabilities, claims, penalties, demands, suits, judgments, losses,
expenses, damages (direct, indirect or consequential), or injury of any nature whatsoever to person
or property, and the costs and expenses incident thereto (including costs of defense, settlement, and
reasonable attorney's fees up to and including an appeal), resulting in any fashion from or arising
directly or indirectly out of or connected with the use of the City's right-of-way.
SECTION 6. NOTICES
Any notices required or permitted hereunder shall be in writing and shall be deemed properly
made when deposited in the United States mail, postage paid, and addressed as set forth herein, or
at such other address as shall have been specked by written notice to the other party delivered in
accordance herewith:
