Any architectural drawings required for this project will be paid for in full by the property owner before the start of the project. Should a revision on the project be necessary the cost of revising the plans, time speiif at the city and any additional pen -nit fees will be in addition to the Total Project Price. 2. All special order item(s).a 50% deposit for those item(s) will be collected on the date'the item(s) is ordered, the final 50% for the,item(s) will be due upon delivery to the job site. All special ordered item(s) are non refundable,or' retumable. All materials are the property of XBC until such time as they are paid for in full. .. 3, XBC will contact Florida's call before you dig service on projects that require this type of service. it is the customer's responsibility to disclose any and all pertinent information about the property or location work is to be commenced. Any damages that result from the property owner's lack of disclosing mformation' wil l be at the cost of the property owner. 4. X-Treme Building:Contractors, Inc. (XBC) prices projects based on standard conditions. In the event thatthe property conditions are such that the materials are unable to be used, any additional cost incurred by XBC, with a limit of $2000.00, shall be in addition to the Total Project Price. Should the amount be over and above $2,000.00, we will discontinue work and earnestly seek to obtain a solution to offer a proposal for a change order to the original contract. 5 XBC will, at various times, have building materials and equipment delivered to the project location. Such items are typically completed with large trucks and equipment. Deliveries may cause ruts in the grass or sod and/or leakage on driveways, and other possible damage. if there are specific requirements or instructions regarding deliveries of equipment and materials, it is required that these criteria be disclosed"prior in writing at the time ofecintractsigning. 6. XBC is,not responsible for any personal items, lost, broken or missing. XBC will not be responsible to move any personal property out ofthe way of the project. 7. Material ordered for this project will be the property of XBC until such time as they are paid for in full. All special'order item(s) need to be paid for in full before the installation of the special item(s). A deposit of 50%0 of the item(s) shall be collected before XBC will order any special order item(s). 8. Any work, changes, adjustments,additions, deletions, or manipulations, etc. done to any system or portion of the project by anyone other than XBC, will void the contract and warranty. 9. All products used for this project willbe subject to the manufacture warrantee. 10. All projects shall be completed in professional manner and in compliance with all applicable codes. 11. During the course of the project, the construction area shall not be entered by any person notaccompanied by a XBC representative. The materials and equipment shall not be disrupted in any way. The construction area shall no be altered or changed and there shall be no additions or deletions. Additionally, if any person sustains any personal injury, or cause any"personal injury or cause property damage to the equipment or materials with or without consent, XBC shall not be held responsible. Purchaser shall hereby indemnify, defend and hold harmless.XBC, it's agents, employees, and subcontractors from any`claim, loss, damage or expense arising form such personal injury or property damage, including attorney fees. 12. XBC maintains a general set of model project plans that are used for references and example. if one of these plans was offered as a model to the project proposed ,"the'actual building of the specific project will be similar to the examples viewed, but may differ slightly due to such things as dimensions, material, and building codes, etc. 13, Property owner must disclose any information about the property before work is commenced. Should there be information that is disclosed that causes additional man hours or materials; this cost will be added to the Total Project Price. t 14. XBC shall, not be liable for any delay due to circumstances beyond its control including, but not limited to', strikes, unavailability of materials, adverse weather, accidents, and any agencies that control permitting issuance and or inspections. 15, It is understood that all conversation about the project is to go thru XBC and not its agents, employees and subcontractors. Project Price and Terms The Total Project Price shall be Forty Five Thousand Three Hundred Seventy Five Dollars and .23 ($45,375.23), which shall include (4) Four payments.
