Acceptance
This proposal becomes a binding AGREEMENT between Buyer(s) and SUPERIOR FENCE AND RAIL, INC. when signed below
by buyer(s).
Itis understood and agreed that the Company is relying upon the prompt and timely performance by the Buyer(s) of any and all duties
and obligations of the Buyer(s) hereunder including, but not limited to, PAYMENT on the date and in the manner specifically stated
herein, time being of the essence. In the event the Buyer(s) breach(es) this agreement, the Buyer(s) agree(s) that the Company shall be
entitled to any COURT COSTS and reasonable ATTORNEY'S FEES incurred in the enforcement of this agreement, plus interest on
the unpaid balances from the due date in this agreement until payment is received by the seller at the highest rate of interest allowed
by the law in the State of Florida. Further understood that any legal action concerning this agreement shall be filed in the appropriate
court in and for Seminole County, Florida. Further Buyer(s) is (are) solely responsible for locating, staking and clearing fence lines.
Buyer(s) also agree(s) to be solely responsible for damage of any nature to underground obstructions, and to indemnify the Company
from any liability which it might incur pursuant to the services involved in the performance of this AGREEMENT. (THIS INCLUDES
SPRINKLER SYSTEMS). SUPERIOR FENCE AND RAIL, INC. will assist the customer, upon request, in determining where the
fence is to be erected, but under no circumstances will (The Company) assume responsibility, concerning property lines or in any way
guarantee their accuracy. If the property pins cannot be located, it is recommended that the customer have the property surveyed.
Alteration Lien
This AGREEMENT may not be altered except by the written consent of the parties. By virtue of the improvements made pursuant to
this contract upon the subject real property the Company has the right to file a NOTICE TO OWNER under section 713.06 Florida
Statutes. And a CLAIM OF LIEN under Section 713.08, Florida Statutes to enforce its mechanics lien in the event payment by the
Buyer(s) is not made pursuant to this contract.
Payment Schedule
Down Payment
Final Payment upon completion.
Cancellation
Should Buyer(s) cancel the AGREEMENT, Buyer(s) recognize(s) that the Company has suffered damages resulting from ordering
appropriate supplies, preparing for its performance, and other cost associated with the sale of this job. Cancellation prior to the
commencement of work is therefore subject to a charge of 25% of the contract price. Installation dates approximate due to various
circumstances such as weather, workload, obtaining building permits and utility locates. SUPERIOR FENCE AND RAIL, INC. will
strive to install fencing in a timely manner, however customer may not cancel this contract due to rescheduling for circumstances
beyond (The Company's) control.
Additional Terms
The parties agree that upon installation the materials supplied pursuant to this contract become part of the REAL PROPERTY and an
IMPROVEMENT thereon. Furthermore Buyer(s) represent(s) to the Company that he/she or they hold(s) legal title to the subject real
property or is (are) authorized to act as agent(s) for the true owner(s). Buyer(s) agree (s) that the seller may remove the fencing for
non-payment within ninety (90) days from the date said fencing is installed, and may do so with this written permission of the Buyer(s),
and the seller will not be a trespasser, nor will the seller be liable for any damage incurred in the removal of said fencing. That it
will not be necessary that the seller proceed with any legal process in order to remove said fencing for nonpayment. That title to said
fencing remains in the seller until totally paid4onby the-Buyer(s) and this AGREEMENT does establish a security interest to the seller
in said fencing
Warranty
ALL PRODUCTS WARRANTED AS PER MANUFACTURER. Buyer(s) understand and acknowledge that wood fence materials are
rough mill cut pieces. Wood Fence material(s) has a tendency to shrink and warp in hot humid weather. Cracks in wood are normal and
accepted occurrence. SUPERIOR FENCE AND RAIL, INC. WILL GUARANTEE THE WORKMANSHIP ON INSTALLATIONS
FOR THREE YEARS FROM THE DATE OF SIGNED CONTRACT. SUPERIOR FENCE AND RAIL, INC. is not liable for sprin-
kler lines and heads.
