Acceptance This proposal becomes a binding AGREEENT between Buyer(s) and Preferred Fence, L.L.C. (the
Company) when signed below by Buyer(s).
it is understood and agreed that the Company is relying upon the prompt and timely performance by
the Buyer(s) of any and all duties and obligations of the Buyer(s) of any and all duties and obligations
of the Buyer(s) hereunder, including, but not limited to, PAYMENT on the date and in the manner specif-
ically stated herein, time being of the essence. In the event the Buyer(s) breach(es) this agreement.
the Buyer(s) agree(s) that the Company shall be entitled to any COURT COSTS and reasonable
ATTORNEY'S FEES incurred in the enforcement of this agreement, plus interest on the unpaid bal-
ances from the due date in this agreement until payment is received by the seller at the highest rate of
interest allowed by law in the State of Florida.
Alteration This AGREEMENT may not be altered except by the written consent of the parties.
Lien By virtue of the improvements made pursuant to this contract upon the subject real property, the
Company has the right to file a NOTICE TO OWNER under Section 713.06, Florida Statutes, and a
CLAIM OF LIEN under Section 713.08, Florida Statutes, to enforce its mechanics lien in the event pay-
ment by the Buyer(s) is not made pursuant to this contract.
Cancellation Should Buyer(s) cancel the AGREEMENT, Buyer(s) recognize(s) that the Company has suffered dam-
ages resulting from ordering appropriate supplies and preparing its performance. Cancellation prior to
the commencement of work is therefore subject to a charge of 25% of the contract price.
Additional Terms The parties agree that upon installation the materials supplied pursuant to this contract become part of
the REAL PROPERTY and an IMPROVEMENT thereon.
Furthermore, Buyer(s) represent(s) to the Company that he, she or they hold(s) legal title to the sub-
ject real property or is (are) authorized to act as agent(s) for the true owner(s).
Further, Buyer(s) is (are) solely responsible for locating, staking and clearing fence lines. Buyer(s) also
agree(s) to be solely responsible for damage of any nature to underground obstructions_ and to indem-
nify the Company from any liability which it might incur pursuant to the services involved in the per-
formance of this AGREEMENT.
Buyer(s) understand(s) and acknowledge(s) that there is no warranty on wood fence materials.
